Justice R.BASANT\n\n Dated :19\/06\/2007\n\n O R D E R\n                               R.BASANT, J.\n\n                            ----------------------\n\n                            B.A.No.3679 of 2007\n\n                        ----------------------------------------\n\n                  Dated this the  19th  day of June 2007\n\n\n\n\n                                   O R D E R\n<\/pre>\n<p>      Application   for   anticipatory   bail.     The   petitioners   are<\/p>\n<p>accused 1,3 and 4.   Altogether  there  are  four  accused persons.<\/p>\n<p>They face allegations inter alia under Sections 341,353 and 427<\/p>\n<p>read   with   34   I.P.C.     The   alleged   incident   took   place   on<\/p>\n<p>10\/6\/2007.     On  receipt of a complaint from the  local  Panchayat<\/p>\n<p>President,   the   local   Sub   Inspector   of   Police   is   alleged   to   have<\/p>\n<p>gone   to   the   scene   of   occurrence   where   he   was   allegedly<\/p>\n<p>threatened,   intimidated   and   deterred   by   the   accused   persons.<\/p>\n<p>This, in short, is the allegation.  Crime was registered promptly.<\/p>\n<p>Investigation   is   in   progress.              The   petitioners   apprehend<\/p>\n<p>imminent arrest.\n<\/p>\n<\/p>\n<p>      2.     The   learned   counsel   for   the   petitioner   submits   that<\/p>\n<p>the   petitioners   are   absolutely   innocent.     Influential   Panchayat<\/p>\n<p>President is able to prevail upon the S.I to raise unnecessary and<\/p>\n<p>false   allegations   against   the   petitioners.       The   petitioners<\/p>\n<p>apprehend   danger   to   themselves   if   the   police   were   to   arrest<\/p>\n<p><span class=\"hidden_text\">B.A.No.3679\/07                            2<\/span><\/p>\n<p>them and keep them in custody.  The offence under Section 353<\/p>\n<p>I.P.C is the non-bailable offence.   The same has been made non-<\/p>\n<p>bailable   recently   in   2006.     I   have   considered   all   the   relevant<\/p>\n<p>inputs.          I   am   satisfied   that   in   the   peculiar   facts   and<\/p>\n<p>circumstances   of   this   case,   the   petitioners   can   be   given<\/p>\n<p>opportunity to surrender before the learned Magistrate and the<\/p>\n<p>learned   Magistrate   can   be   directed   to   consider   the   application<\/p>\n<p>for bail on merits and pass appropriate orders.<\/p>\n<p>      3.        In   the   result,   this   petition   is   allowed.     Following<\/p>\n<p>directions are issued under Section 438 Cr.P.C.<\/p>\n<p>      (i)       Petitioners   shall   surrender   before   the   learned<\/p>\n<p>Magistrate having jurisdiction at 11 a.m on 26\/6\/2007.  They may<\/p>\n<p>apply for bail on the same day after giving sufficient prior notice<\/p>\n<p>to the learned Public Prosecutor in charge of the case.<\/p>\n<p>      (ii)      The learned Magistrate shall consider the application<\/p>\n<p>for bail on merits and pass appropriate orders on that day itself.<\/p>\n<p>      (iii)     If   the   petitioners   do   not   appear   before   the   learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above shall<\/p>\n<p>thereafter   stand   revoked   and   the   police   shall   be   at   liberty   to<\/p>\n<p>arrest the petitioners and deal with them in accordance with law,<\/p>\n<p>as if these directions were not issued at all.\n<\/p>\n<p>\n<span class=\"hidden_text\">B.A.No.3679\/07                       3<\/span><\/p>\n<p>       (iv)    If they were arrested prior to 26\/6\/2007, they shall be<\/p>\n<p>released   on   their   executing   a   bond   for   Rs.25,000\/-   (Rupees<\/p>\n<p>twenty five thousand only) without any sureties, undertaking to<\/p>\n<p>appear before the learned Magistrate on 26\/6\/2007.<\/p>\n<pre>\n\n\n\n\n                                                 (R.BASANT, JUDGE)\n\njsr\n\n\n                               \/\/ True Copy\/\/          PA to Judge\n\n\n<span class=\"hidden_text\">B.A.No.3679\/07    4<\/span>\n\n\n       R.BASANT, J.\n\n\n\n\n\n         CRL.M.CNo.\n\n\n\n\n\n            ORDER\n\n\n\n\n\n21ST DAY OF MAY2007\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Hashim vs The Station House Officer on 19 June, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 3679 of 2007() 1.
