SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/03\/2009 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India,<br \/>\nthe petitioner has prayed for an appropriate writ, order and\/or<br \/>\ndirection directing the respondent to pay interest for the duration<br \/>\nand amounts as stated in para 9 of this petition at the rate of 10%.\n<\/p>\n<p>2.\t\tLearned<br \/>\nadvocate for the petitioner has vehemently submitted that the<br \/>\npetitioner is entitled to the interest on the amount, which was paid<br \/>\nin the year 2007 and 2008 on delayed payment of arrears of pay, leave<br \/>\nencashment, gratuity, pension, etc. <\/p>\n<p>3.\t\tAt<br \/>\nthe outset, it is required to be noted that this Court is at pains to<br \/>\nobserve that prima facie, it appears that the judgement and decree<br \/>\ndated 30th June,2006 passed by the learned 6th<br \/>\nAdditional Senior Civil Judge and Judicial Magistrate, First Class,<br \/>\nAhmedabad (Rural) in Special Civil Suit No.201 of 2004, is not<br \/>\nsustainable. It is very unfortunate that the State Government has not<br \/>\npreferred any appeal against that order and the petitioner was paid<br \/>\napproximately Rs.17,93,979\/-.  Be that as it may. It is to be noted<br \/>\nthat the amount is paid to the petitioner on the basis of judgement<br \/>\nand decree of the trial court and even the petitioner also filed<br \/>\nExecution Petition. The petitioner ought to have claimed the interest<br \/>\nin the Execution Petition, which the petitioner has not claimed in<br \/>\nthe Execution Petition and subsequently, the present Special Civil<br \/>\nApplication is preferred. There is no deliberate delay on the part of<br \/>\nState Authority in disbursement of retiral benefits.\n<\/p>\n<p>4.\t\tLooking<br \/>\nto the facts and circumstances of the case also, the petitioner is<br \/>\nnot entitled to any interest as claimed in the petition. Even the<br \/>\nconduct of the petitioner, while withdrawing earlier petition being<br \/>\nSpecial Civil Application No.85 of 2000 also deserves to be<br \/>\ncondemned. Though Special Civil Application was pending before this<br \/>\nCourt, he filed another suit, subsequently he withdrew the said<br \/>\npetition. The petitioner withdrew the aforesaid Special Civil<br \/>\nApplication but did not point out the aforesaid fact of suit before<br \/>\nthis Court. In view of the above conduct,  the petitioner is not<br \/>\nentitled to any discretionary relief under Article 226 of the<br \/>\nConstitution of India.\n<\/p>\n<p>5.\t\tUnder<br \/>\nthe circumstances, there is no substance in the present petition and<br \/>\nthe same deserves to be dismissed.
