KADIYA &amp; 4 - Respondent(s)\n \n\n=========================================================\n \nAppearance\n: \nPARTY-IN-PERSON\nfor Petitioner(s) : 1, \nRULE SERVED for Respondent(s) : 1 - 3. \nMR\nJK SHAH, ASST GOVERNMENT PLEADER for Respondent(s) : 4 -\n5. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/03\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThe<br \/>\npetitioner, party-in-person has prayed to quash and set aside the<br \/>\norders of the Tribunal passed in Application Nos. 183 of 1990, 33 of<br \/>\n2005 and 126 of 2006 and further to direct the respondent authorities<br \/>\nto promote the petitioner to the post of Junior Clerk with effect<br \/>\nfrom October 1986 and to pay the arrears thereof.\n<\/p>\n<p>2.\tThe<br \/>\npetitioner was appointed as Laboratory Assistant cum Peon in Gram<br \/>\nSeva Mandir, Nardipur in 1978.  In the year 1984, the petitioner was<br \/>\nrendered surplus in the said school and was therefore absorbed as<br \/>\nLaboratory Assistant-cum-Peon in a school at Kalol.  Thereafter, in<br \/>\nthe year 1988, a post of Laboratory Assistant cum Peon in the school<br \/>\nat Kalol was reduced and one Shri B.S. Parmar being the junior most<br \/>\nwas held to be surplus.  This action was challenged before the<br \/>\nTribunal and the Tribunal set aside the order declaring the said Mr.<br \/>\nParmar as surplus and directed that the petitioner be declared<br \/>\nsurplus and be absorbed in some other school.  The petitioner was<br \/>\nthereafter absorbed in the higher secondary school at Vamej.  The<br \/>\npetitioner was held surplus there also and was absorbed in a School<br \/>\nat Kalol in the  month of October 1996 and since then the petitioner<br \/>\nhas been promoted as Junior Clerk in the year 1999.\n<\/p>\n<p>3.\tHeard<br \/>\nMr. Heduji Hiraji Thakore, party-in-person and learned AGP, Mr. J.K.<br \/>\nShah at length.  The Tribunal while considering the case of the<br \/>\npetitioner has relied upon the decision dated 16.10.1989 and rejected<br \/>\nthe claim of the petitioner on the ground that on being declared<br \/>\nsurplus the petitioner was absorbed in another school and in such<br \/>\ncase the peons working in that school had to be given priority.  This<br \/>\ncourt is in complete agreement with the view taken by the Tribunal<br \/>\nand does not see any reason for causing interference.\n<\/p>\n<p>4.\tAt<br \/>\nthis stage, an attempt is made by the petitioner-party in person to<br \/>\nequate himself with the surplus teachers, supervisors and other<br \/>\nhigher posts.  In my view, such an equal footing cannot be given in<br \/>\ncase of peons more particularly when no special rules have been<br \/>\nframed for surplus peons.\n<\/p>\n<p>5.\tThis<br \/>\ncourt is of the view that considering the overall facts and<br \/>\ncircumstances of the case, no case is made out for interfering with<br \/>\nthe order of the Tribunal.  This petition is devoid of any merits and<br \/>\ndeserves to be dismissed.  Petition is accordingly dismissed.  Rule<br \/>\nis discharged.
