In the facts and circumstances of the<br \/>\ncase and by consent of both the sides, this matter is taken up for<br \/>\nhearing today.\n<\/p>\n<p>2.\t\tThis<br \/>\napplication is preferred under Section 439 of the Code of Criminal<br \/>\nProcedure for regular bail in connection with FIR registered as CR<br \/>\nNo. I 73 of 2008 registered with Kapadvanj Police Station for the<br \/>\noffences punishable under Sections 147, 148, 149, 307, 395, 323 of<br \/>\nIPC and Section 25(1)(C) of the Arms Act.\n<\/p>\n<p>3.\t\tMr<br \/>\nPR Abichandani, learned advocate for the petitioner submitted that<br \/>\nconsidering the role attributed to the present petitioner, he was not<br \/>\ndirectly involved in the commission of offences punishable under<br \/>\nSections 147, 148, 149, 307, 395, 323 of IPC and Section 25(1)(c) of<br \/>\nthe Arms Act.  The petitioner is aged about 75 years and therefore,<br \/>\nno useful purpose would be served by keeping him behind the bar.<br \/>\nThus, the learned advocate for the petitioner submitted that<br \/>\nconsidering the aforesaid facts and circumstances of the case, the<br \/>\npetitioner may be enlarged on regular bail.\n<\/p>\n<p>4.\t\tMr<br \/>\nHL Jani, learned Additional Public Prosecutor representing the State<br \/>\nsubmitted that considering the role played by the petitioner and the<br \/>\nmanner in which he instigated the other accused persons to commit the<br \/>\noffences punishable under Sections 147, 148, 149, 307, 395, 323 of<br \/>\nIPC and Section 25(1)(c) of the Arms Act, no discretionary relief may<br \/>\nbe granted to the petitioner and the petition does not call for any<br \/>\ninterference and it is liable to be dismissed.\n<\/p>\n<p>5.\t\tMr<br \/>\nHardik Dave, learned advocate for the original complainant submitted<br \/>\nthat the petitioner is an influential person and taking into account<br \/>\nthe role attributed to the petitioner which is reflected in the FIR<br \/>\nat Annexure-A to the petition, no interference is called for in the<br \/>\napplication preferred by the petitioner and the petition deserves to<br \/>\nbe dismissed.\n<\/p>\n<p>6.\t\tConsidering<br \/>\nthe rival submissions and on perusal of the averments made in the<br \/>\npetition as well as FIR at Annexure-A to the petition, the petitioner<br \/>\nalong with other accused persons is booked for the offences<br \/>\npunishable under Sections 147, 148, 149, 307, 395, 323 of the IPC and<br \/>\nSection 25(1)(c) of the Arms Act.  I have also perused the statements<br \/>\nof Balrambhai and Chandreshbhai Jadavji, which have been relied upon<br \/>\nby the learned Additional Public Prosecutor.  Considering the role<br \/>\nattributed to the petitioner and the manner in which the alleged<br \/>\noffences are committed by the petitioner, prima facie, I am inclined<br \/>\nto exercise my discretion in favour of the petitioner, without<br \/>\nentering into merits of the case or discussing the evidence in<br \/>\ndetail.\n<\/p>\n<p>7.\t\tIn<br \/>\nthe facts and circumstances of the case, the petition is allowed and<br \/>\nthe petitioner is ordered to be enlarged on bail in connection with<br \/>\nCR No. I 73 of 2008 registered at Kapadvanj Police Station on<br \/>\nexecuting a bond of Rs.10,000\/- [Rupees ten thousand only] with one<br \/>\nsurety of the like amount to the satisfaction of the Trial Court and<br \/>\nsubject to the conditions that he shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nenter in the territorial limits of Kheda District, except for the<br \/>\npurpose of attending Court proceedings and marking presence at the<br \/>\nconcerned police station, till the trial is over;\n<\/p>\n<p>[e]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[f]\tmark<br \/>\nhis presence at the concerned Police Station on any day of every<br \/>\nfirst week of English calendar month between 9.00 AM and 2.00 PM.<br \/>\ntill the trial is over;\n<\/p>\n<p>[g]\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[h]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>7.\t\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\t\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>9.\t\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the petitioner on bail.\n<\/p>\n<p>10.\t\tIt<br \/>\nwould be open for the petitioner to make necessary application before<br \/>\nthe learned District and Sessions Judge, if the petitioner is<br \/>\nrequired to attend urgent meeting in Kheda District.\n<\/p>\n<p>10.\t\tRule<br \/>\nis made absolute to the aforesaid extent.
