Justice ANTONY DOMINIC\n\n Dated :21\/12\/2009\n\n O R D E R\n                      ANTONY DOMINIC, J.\n             --------------------------------------------------\n                 W.P.(C) NO.10820 OF 2004 (K)\n             --------------------------------------------------\n         Dated this the 21stday of December, 2009\n\n                          J U D G M E N T\n<\/pre>\n<p>     First petitioner was a protection labourer on daily wages at<\/p>\n<p>Ananirathi and the 2nd petitioner was engaged for feeding<\/p>\n<p>animals and cleaning the cages of the animals, on daily wages.<\/p>\n<p>The first prayer in this writ petition is to revise the monetary<\/p>\n<p>benefits due to them, implementing the benefit of Ext.P1 order.<\/p>\n<p>     2.    Along with the counter affidavit filed by the first<\/p>\n<p>respondent they have produced Ext.R1(a) Government Order<\/p>\n<p>dated 29th January, 2004 directing to keep Ext.P1 in abeyance, in<\/p>\n<p>view of the discrepancies that were noticed. Therefore Ext.P1 has<\/p>\n<p>not been implemented, and           therefore, the petitioners cannot<\/p>\n<p>claim the benefit of Ext.P1.\n<\/p>\n<p>     3. The second prayer made             is to provide the insurance<\/p>\n<p>coverage and safety gadgets and maintain dress code and to<\/p>\n<p>issue identity cards.     In so far as the insurance coverage is<\/p>\n<p>concerned, the same is available only to regular employees and<\/p>\n<p>to temporary staff , with more than 5 years service. Petitioners do<\/p>\n<p>not satisfy this condition. If so, they cannot ask for this benefit.<\/p>\n<p>     4.     As far as the prayer for gadgets is concerned,<\/p>\n<p>Government Pleader submits that at the place to which               the<\/p>\n<p>WPC.No. 10820\/04<br \/>\n<span class=\"hidden_text\">                                  :2 :<\/span><\/p>\n<p>petitioners&#8217; were allotted, there is a wireless station providing<\/p>\n<p>for communication. In so far as the prayer for maintaining dress<\/p>\n<p>code and issue of identity card is concerned, Government Pleader<\/p>\n<p>points out that these facilities are not available to daily wages<\/p>\n<p>employees like the petitioners. The third prayer is to maintain a<\/p>\n<p>muster roll and daily wages register. The counter affidavit shows<\/p>\n<p>that these documents are maintained.\n<\/p>\n<p>      5.   The next prayer is to convert them as SLR workers.<\/p>\n<p>Paragraph 9 of the counter affidavit filed by respondents 2 to 6<\/p>\n<p>show that this issue has already been turned down by this court in<\/p>\n<p>the judgment in O.P.NO.37833\/02 and if so, this claim also cannot<\/p>\n<p>be considered.\n<\/p>\n<p>      The last prayer made is for their continuance in service.<\/p>\n<p>Daily wages employees like the petitioners can be appointed<\/p>\n<p>subject to requirements and if so the petitioners cannot claim that<\/p>\n<p>they should be engaged continuously.
