JUSTICE GOPAL KRISHAN VYAS\n   ____________________________________\n\n\nMr. Sajjan Singh for the appellants.\n\nBY THE COURT :<\/pre>\n<p>        In this second appeal, the appellant-defendants<\/p>\n<p>are     challenging   the   judgment   and   decree    dated<\/p>\n<p>27.08.2007 passed by Addl. District Judge, Sojat City in<\/p>\n<p>Civil    Appeal   No.13\/2006,     whereby,    the     learned<\/p>\n<p>appellate Court affirmed the judgment and decree dated<\/p>\n<p>24.07.2006 passed by the Civil Judge (Jr. Dn.), Sojat in<\/p>\n<p>Civil Original Suit No.30\/2001.\n<\/p>\n<p>        According to facts of the case, suit for mandatory<\/p>\n<p>and permanent injunction was filed by respondent-<\/p>\n<p>plaintiff Ghanshyam Vaishnav.          In the suit, it was<\/p>\n<p>specifically prayed that appellant-defendants have made<\/p>\n<p>encroachment upon the public way which is in existence<\/p>\n<p>since last 50 years in village Dornadi and respondent-<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>plaintiff as also all the villagers are having easementary<\/p>\n<p>right of public way, therefore, it was prayed that<\/p>\n<p>encroachment so made by the appellant-defendants<\/p>\n<p>may be removed and they may be restrained from<\/p>\n<p>making any encroachment upon the public way.             The<\/p>\n<p>learned trial Court, after framing 9 issues and recording<\/p>\n<p>oral evidence of P.W.-1 Ghanshyam, P.W.-2 Sagar Devi<\/p>\n<p>and P.W.-3 Mangu Singh and taking on record 10<\/p>\n<p>documents,     so   also,   recording   evidence    of   four<\/p>\n<p>witnesses on the side of the defence, decreed the suit in<\/p>\n<p>favour of the respondent-plaintiff. The    said    judgment<\/p>\n<p>and decree     dated 24.07.2006 was challenged by the<\/p>\n<p>defendants by way of filing appeal before the Addl.<\/p>\n<p>District Judge, Sojat City.       Learned appellate Court<\/p>\n<p>affirmed the adjudication made by the trial Court and<\/p>\n<p>dismissed the appeal filed by the present appellants.<\/p>\n<p>      Learned counsel for the appellants vehemently<\/p>\n<p>argued that the finding arrived at by both the Courts<\/p>\n<p>below is perverse and , so also, ignoring the universal<\/p>\n<p>truth that in the villages and old cities of India there are<\/p>\n<p>chabutari at both sides of the gate of a house and that<\/p>\n<p>is rightly constructed by them, therefore, the decree<\/p>\n<p>passed by the trial Court for removal of the said<\/p>\n<p>chabutari is illegal.   Further, it is argued that matter of<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>regularization    was      pending      before      the    Panchayat,<\/p>\n<p>therefore, the learned trial Court has committed error<\/p>\n<p>while misreading the material evidence and relied upon<\/p>\n<p>inadmissible evidence, therefore, the finding arrived at<\/p>\n<p>by the trial Court as well as appellate Court is illegal and<\/p>\n<p>contrary to law.        It is also argued by learned counsel<\/p>\n<p>for the appellants that alleged finding against the<\/p>\n<p>appellants for encroachment upon the public way is also<\/p>\n<p>illegal and without any evidence on record.                        The<\/p>\n<p>learned trial Court has failed to consider that the<\/p>\n<p>plaintiff   has   not    proved       the    case   in    his   favour,<\/p>\n<p>therefore, the Courts below have committed manifest<\/p>\n<p>perversity    and,      accordingly,        judgment      and   decree<\/p>\n<p>passed by both the Court below deserve to be set aside.<\/p>\n<p>It is lastly argued by learned counsel for the appellant<\/p>\n<p>that the learned Courts below have committed material<\/p>\n<p>illegality while deciding issues No.4, 5 and 6 jointly in<\/p>\n<p>favour of the respondent-plaintiff.\n<\/p>\n<p>       I have considered the arguments advanced by<\/p>\n<p>learned counsel for the appellants and, so also, perused<\/p>\n<p>the judgments of both the Courts below.\n<\/p>\n<p>       Admittedly, there is no title in favour of the<\/p>\n<p>appellant-defendants to show that the land in question<\/p>\n<p>where the alleged encroachment has been made by<br \/>\n<span class=\"hidden_text\">                              4<\/span><\/p>\n<p>them is belonging to them nor they have proved before<\/p>\n<p>the Court that they are in possession of the said land<\/p>\n<p>for so many years whereas respondent-plaintiff proved<\/p>\n<p>by cogent evidence that the land where the appellants<\/p>\n<p>have made encroachment and constructed the chabutari<\/p>\n<p>is public way.   The finding of fact arrived at by both the<\/p>\n<p>Courts below cannot be interfered with while exercising<\/p>\n<p>jurisdiction under Section 100, C.P.C. in this second<\/p>\n<p>appeal.\n<\/p>\n<p>      Further, upon perusal of both the judgments<\/p>\n<p>under challenge, no substantial question of law emerges<\/p>\n<p>for consideration.    More so, it is obvious from the fact<\/p>\n<p>that admittedly there is no title or any right accrued to<\/p>\n<p>the appellant-defendants to retain possession of the<\/p>\n<p>land of public way.    It is also required to be observed<\/p>\n<p>that the scope of second appeal is very limited.        The<\/p>\n<p>Court can interfere if any substantial question of law is<\/p>\n<p>involved in the matter; but, here in this case, no<\/p>\n<p>question of law is borne out warranting interference.<\/p>\n<p>      In this view of the matter, there is no force in this<\/p>\n<p>second appeal.
