KRUTI M SHAH\nfor Applicant(s) : 1 - 4. \nMR SJ SHUKLA APP for Respondent(s) :\n1, \n======================================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/09\/2010\n \n\nORAL\nORDER<\/pre>\n<p>\tThe<br \/>\n\tpresent application has been filed under Section 438 of the Code of<br \/>\n\tCriminal Procedure, 1973 for the grant of anticipatory bail in<br \/>\n\tconnection with I-C.R.No.108\/2010 registered with Jetpur City Police<br \/>\n\tStation, District : Rajkot for the offences punishable under<br \/>\n\tSections 324 and 114 of the Indian Penal Code and under Section<br \/>\n\t37(1) and 135 of the Bombay Police Act.\n<\/p>\n<p>\tLearned<br \/>\n\tcounsel, Ms.K.M. Shah for the applicants does not press this<br \/>\n\tapplication qua applicants-accused nos.1 and 2 viz., Pravinbhai<br \/>\n\tBhikhubhai Limasiya and Nileshbhai Bhikhubhai Limbasiya respectively<br \/>\n\tand, hence, the present application is confined to<br \/>\n\tapplicants-accused nos.3 and 4 viz., Vijyaben W\/o Bhikhubhai<br \/>\n\tLimbasia and Arunaben W\/o Pravinbhai Limbasiya respectively. Learned<br \/>\n\tcounsel, Ms.Shah submitted that it is a case of cross-complaint,<br \/>\n\twhere the quarrel took place between the labourers resulting into<br \/>\n\taccident. She further submitted that the present application may be<br \/>\n\tallowed as all the family members have been implicated.\n<\/p>\n<p>\tLearned<br \/>\n\tA.P.P., Mr.Shukla resisted the application.\n<\/p>\n<p>\tHaving<br \/>\n\theard learned counsel appearing for the applicant-accused and<br \/>\n\tlearned A.P.P. for the State and the fact that the application is<br \/>\n\tnot pressed qua the applicants-accused nos.1 and 2 and since it is<br \/>\n\tconfined to female members, applicants-accused nos.3 and 4 and also<br \/>\n\tconsidering the nature of offences and manner in which it is alleged<br \/>\n\tto have been committed, this is a fit case, where the discretion<br \/>\n\tunder Section 438 of the Criminal Procedure Code is required to be<br \/>\n\texercised and the present application deserves to be allowed.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tthe present application is partly allowed. The applicants-accused<br \/>\n\tnos.3 and 4 viz., Vijyaben W\/o Bhikhubhai Limbasia and Arunaben W\/o<br \/>\n\tPravinbhai Limbasiya respectively are ordered to be released on bail<br \/>\n\tin the event of their arrest in connection with I-C.R.No.108\/2010<br \/>\n\tregistered with Jetpur City Police Station in respect of the offence<br \/>\n\talleged against them on their executing bond of Rs.5,000\/- (Rupees<br \/>\n\tFive thousand only) each with one solvent surety of the like amount,<br \/>\n\tby them, by the concerned Police Officer and on conditions that they<br \/>\n\tshall;\n<\/p>\n<p>a)\tremain present before the trial Court regularly as \tand when directed on the dates fixed;\n<\/p>\n<p>b)\tremain present at the concerned Police Station on 28.09.2010 between 11.00 a.m. and 2.00 p.m;\n<\/p>\n<p>c)\tnot directly or indirectly make any inducement, threat or promise to any person acquainted with the fact of the \tcase so as to dissuade him from disclosing such facts to the \tCourt or to any Police Officer;\n<\/p>\n<p>d)\tnot to obstruct or hamper the police investigation \tand not to play mischief with the evidence collected or yet to be collected by the police;\n<\/p>\n<p>e)\tat the time of execution of bond, furnish their address to the Investigating Officer and the Courts concerned, \tand shall not change their residence till the final disposal of the case or till further orders;\n<\/p>\n<p>f)\tnot leave India without the permission of the Court \tand if having Passport, shall deposit the same before the trial Court within a week;\n<\/p>\n<p>g)\tIt<br \/>\nshould be open to the Investigating Officer to file an application<br \/>\nfor remand if he considers it proper and just; and the learned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>This<br \/>\n\torder will hold good if the applicant is arrested at any time within<br \/>\n\t90 days from today. The order for release on bail will remain<br \/>\n\toperative only for a period of ten days from the date of their<br \/>\n\tarrest, during which it will be open to the applicants to make fresh<br \/>\n\tapplication for being enlarged on bail in usual course which when it<br \/>\n\tcomes before the competent Court, will be disposed of in accordance<br \/>\n\twith law, having regard to all the attending circumstances and the<br \/>\n\tmaterials available at the relevant time uninfluenced by the fact<br \/>\n\tthat anticipatory bail was granted.\n<\/p>\n<p>Rule<br \/>\n\tis  made absolute to the aforesaid extent qua applicants-accused<br \/>\n\tnos.3 and 4 viz., Vijyaben W\/o Bhikhubhai Limbasia and Arunaben W\/o<br \/>\n\tPravinbhai Limbasiya respectively. Rule is discharged qua<br \/>\n\tapplicants-accused nos.1 and 2<br \/>\n\tviz., Pravinbhai Bhikhubhai Limasiya and Nileshbhai Bhikhubhai<br \/>\n\tLimbasiya respectively.
