Justice K.SURENDRA MOHAN\n\n Dated :31\/12\/2010\n\n O R D E R\n                K.SURENDRAMOHAN, J.\n               ----------------------------------------------\n                  WP (C) No. 38760 of 2010\n               ----------------------------------------------\n          Dated this the 31st day of December, 2010\n\n                        J U D G M E N T\n<\/pre>\n<p>     The petitioner is the owner of a building which is<\/p>\n<p>assessed to building tax under the Kerala Building Tax<\/p>\n<p>Act, 1978. According to the petitioner the tax assessed is<\/p>\n<p>exorbitant. He is also entitled to exemption in respect of<\/p>\n<p>substantial portions of the building.                        Therefore the<\/p>\n<p>petitioner has challenged Ext.P2 assessment order before<\/p>\n<p>the appellate authority under the Act. The said appeal,<\/p>\n<p>Ext.P3, is submitted before the 2nd respondent.                      Along<\/p>\n<p>with Ext.P3, the petitioner has also submitted Exts.P4 and<\/p>\n<p>P5 applications for stay of recovery of the tax that has<\/p>\n<p>been assessed.\n<\/p>\n<p>     2. According to the petitioner he has paid the first<\/p>\n<p>instalment of the tax assessed. Therefore, he is entitled to<\/p>\n<p>a stay of recovery of the balance amount of tax, pending<\/p>\n<p>final disposal of Ext.P3 appeal. Though Exts.P4 and P5<\/p>\n<p>stay petitions have been filed he complains that no orders<\/p>\n<p><span class=\"hidden_text\">WP (C) No. 38760 of 2010       2<\/span><\/p>\n<p>have been passed thereon till date. In the meantime he<\/p>\n<p>apprehends that the tax assessed would be recovered<\/p>\n<p>from him by initiating coercive action. Therefore he has<\/p>\n<p>filed this writ petition, seeking necessary reliefs.<\/p>\n<p>     3. Since Exts. P4 and P5 applications for stay are<\/p>\n<p>pending before the 2nd respondent, I do not think it<\/p>\n<p>necessary to consider the contentions of the petitioner on<\/p>\n<p>the merits.     It is sufficient that Exts. P4 and P5 are<\/p>\n<p>directed to be disposed of expeditiously.<\/p>\n<p>     4.
