The suit, i.e., O.S.1014\/03 has been instituted by<br \/>\n        the   plaintiff,   who   is   a   member   of   the   8th<br \/>\n        defendant-Society,  Sree  Agasthasramam  registered under<br \/>\n        the Travancore-Cochin Literary Scientific And  Charitable<br \/>\n        Societies Registration Act, 1955 (hereinafter called &#8216;The<br \/>\n        Act&#8217;)  seeking  a  declaration  that  the decision of the<br \/>\n        executive committee that consiste[b[b[bd of defendants  1<br \/>\n        to  7  to  enhance the emoluments of the first defendant,<br \/>\n        who is also a member of the executive committee  is  null<br \/>\n        and  void and that defendants 1 to 7 are not empowered to<br \/>\n        permit  the  first  defendant  to  have   such   enhanced<br \/>\n        remuneration  and  for  a  permanent  interim injunction,<br \/>\n        restraining the defendants from  withdrawing  any  amount<br \/>\n        from  the  funds  of  the 8th defendant without the prior<br \/>\n        approval of the general body.  The dispute is mainly with<br \/>\n        respect to the disbursal of the  income  derived  by  the<br \/>\n        Society  from  Sree  Agasthya  Medical Centre wherein the<br \/>\n        first defendant is also the Chief Physician.    According<br \/>\n        to the plaintiff, the byelaws of the Society specifically<br \/>\n        interdicted  any  such  enhancement  as  ordered  by  the<br \/>\n        executive committee.    The   application   for   interim<br \/>\n        injunction  was  disallowed by the trial court vide order<br \/>\n        in I.A.4725\/03 and the lower appellate court as per order<br \/>\n        in C.M.A.158\/03.\n<\/p>\n<p>        \t2.   I find that the decision of the suit as such<br \/>\n        would depend on the interpretation as to  the  powers  of<br \/>\n        the executive  committee.    Another point raised is that<br \/>\n        the authority of the executive committee to  continue  in<br \/>\n        office,  beyond  the period of one year vide Section 7 of<br \/>\n        the Act as the provision specifically provided  that  the<br \/>\n        governing  committee  has to be elected every year by the<br \/>\n        general body.    The  present  executive  committee   was<br \/>\n        elected in  2001,  it  is  pointed  out.  I find that the<br \/>\n        above matters call for detailed evidence and  discussions<br \/>\n        and  are  not  envisaged  to  be  adjudicated  in  a writ<br \/>\n        proceedings.  The counsel for  the  writ  petitioner  has<br \/>\n        sought  for  a direction that no enhanced remuneration be<br \/>\n        disbursed  to  the  first  defendant   till   the   final<br \/>\n        determination of the suit.  I find that the circumstances<br \/>\n        do not  call  for  such  a  direction.
