Learned APP waives<br \/>\nservice.\n<\/p>\n<p>2.\t\tThe applicant &#8211;\n<\/p>\n<p>convict who vide judgment and order dated 01\/06\/2006 rendered by the<br \/>\nLd. Addl. Sessions Judge, Gandhinagar, in Sessions Case No. 32 of<br \/>\n2005 has been convicted for the offences punishable under sections<br \/>\n302, etc., of the IPC and sentenced to undergo imprisonment for life<br \/>\nand fine, has  forwarded the present application through jail seeking<br \/>\ntemporary bail for period of 30 days on the ground of providing<br \/>\nfinancial assistance to his family.\n<\/p>\n<p>3.\t\tThe jail remark sheet<br \/>\nforwarded with the application by the jail authority reveals that the<br \/>\napplicant convict has undergone 5 years and 09 months in jail. It<br \/>\nfurther transpires that the applicant convict has enjoyed temporary<br \/>\nbail on five occasions and furlough leave on two occasions and on all<br \/>\nthe occasions, he surrendered in time before the jail authority.\n<\/p>\n<p>4.\t\tConsidering the facts<br \/>\nand circumstances of the case, the  application is allowed in part.<br \/>\nThe applicant-convict is ordered to be released on  temporary bail<br \/>\nfor the period of 15 [fifteen] days from the date of his actual<br \/>\nrelease, upon furnishing personal bond in the sum of Rs.5,000\/-<br \/>\n[Rupees five thousand only] before the jail authority on usual terms<br \/>\nand conditions.
