WADHWA\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Delay condoned.\n<\/p>\n<p>     Leave granted.\n<\/p>\n<p>     We have heard learned counsel on both sides.<br \/>\n     This appeal  by special  leave arises from the judgment<br \/>\nof the\tDivision Bench of the Punjab and Haryana High Court,<br \/>\nmade on April 18, 1995 in Civil Writ Petition No.9648\/1994.\n<\/p>\n<p>     The first\trespondent had\tpurchased furniture and said<br \/>\nto be  used the\t bank car  for unofficiaal purposes. On that<br \/>\nground, he  was surcharged.  The inspection report dated May<br \/>\n4,  1993   would  indicate  that  the  first  respondent  as<br \/>\npresident of  the Bank had not used the car while performing<br \/>\nduties\tand  responsibilities  according  to  the  statutory<br \/>\nprovisions and\tthe expenditure\t incurred in that behalf and<br \/>\nthe value  of the  furniture  purchase\twere  liable  to  be<br \/>\nrecovered from then personally. The enquiry conducted in the<br \/>\nbehalf\trevealed   that\t the   first  respondent   had\tmade<br \/>\nunauthorised use  of the  bank car  and had made purchase of<br \/>\nthe furniture  etc. It\twas opined  that he  had  needlessly<br \/>\nincurred the expenditure and, therefore, the same was liable<br \/>\nto be  recovered from  him as  surcharge. When he challenged<br \/>\nthis order  in the  High Court,\t the High  Court allowed the<br \/>\nwrit  petiton  and  quashed  the  surcharge  order  and\t the<br \/>\nAnnexure P.5  imposing surcharge  with cost of Rs.5,000\/- to<br \/>\nbe borne  by the  State with  the liberty to proceed against<br \/>\nthe appellant for recovery thereof. When the matter had come<br \/>\nup before  us, we  directed the Joint Registrar, Cooperative<br \/>\nSocieties to  give an  opportunity of  hearing\tto  the\t Ist<br \/>\nrespondent and\tthen to pass a reasoned order whether he had<br \/>\ncaused any  loss to Bank of which he is the Chairman. In the<br \/>\norder dated  April 9,  1997, the  Registrar, after elaborate<br \/>\nconsideration  held   that  the\t  respondent  had   incurred<br \/>\nexpenditure in\tthe sum\t of Rs.1,15,888\/- towards the use of<br \/>\nthe vehicle  to attend\tvarious official  functions. He also<br \/>\nincurred expenditure  in the  sum of  Rs.1,01,650.48 towards<br \/>\nthe expenditure\t for  the  purchase  of\t the  furniture.  He<br \/>\nactually performed  the journey\t and used  the\tcar  in\t the<br \/>\ndischarge of  his duties  as a\tChairman of the Board of the<br \/>\nDirectors of  the Bank.\t He also purchased the furniture and<br \/>\nthe furniture  is being\t used by the Bank and thereby he has<br \/>\nnot caused any pecuniary loss to the Bank.\n<\/p>\n<p>     In view  of the above finding, the direction issued for<br \/>\nrecovery of  the costs\tpersonally from the first respondent<br \/>\nis not\twarranted and the High Court has rightly quashed the<br \/>\nsurcharge order.\n<\/p>\n<p>     The appeal is accordingly allowed.
