Justice V.GIRI\n\n Dated :23\/06\/2009\n\n O R D E R\n                        V.GIRI, J\n                     .......................\n                  W.P.(C).10465\/2009\n                     .......................\n          Dated this the 23rd day of June, 2009\n\n                      JUDGMENT\n<\/pre>\n<p>      Petitioner availed a loan from the 1st respondent,<\/p>\n<p>Bank, noted as agricultural gold loan to the tune of<\/p>\n<p>Rs.1,23,000\/-.   Essentially the loan was availed          by<\/p>\n<p>pledging the gold ornaments and according to the<\/p>\n<p>petitioner,   it was    used for agricultural purpose.<\/p>\n<p>Petitioner submits that though he is entitled to the<\/p>\n<p>benefit under the Agriculture Debt Relief, he has not<\/p>\n<p>been granted the same. This has been challenged by<\/p>\n<p>the petitioner and hence the writ petition.<\/p>\n<p>2.    Bank has filed a statement pursuant to the<\/p>\n<p>directions issued by this Court.            It seems that the<\/p>\n<p>petitioner   availed an Agricultural Gold Loan (AGL)<\/p>\n<p>2488\/06 of Rs.1,23,000\/- on 14.10.2006. Gold loans<\/p>\n<p>are short term loans which are repayable within a<\/p>\n<p>period of one year. Petitioner also has a Savings Bank<\/p>\n<p>account with the bank. Petitioner executed a pledge<\/p>\n<p>letter towards the loan account. He had availed two<\/p>\n<p>W.P.(C).10465\/2009<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>other loans of Rs.1,00,000\/-         and    Rs.75,000\/-<\/p>\n<p>respectively. Gold loan is given for a period of one<\/p>\n<p>year. On the      expiry of the said period, petitioner<\/p>\n<p>availed another       Gold Loan for an amount of<\/p>\n<p>Rs.1,23,000\/- and closed the earlier gold loan account<\/p>\n<p>by transferring the amount from the loan account to<\/p>\n<p>the Savings Bank Account. Petitioner withdrew the<\/p>\n<p>amount from the savings bank account and remitted<\/p>\n<p>the cash withdrawn, in the gold loan account which<\/p>\n<p>was then sought to be closed. Then a fresh gold loan<\/p>\n<p>was sanctioned in favour of the petitioner and a fresh<\/p>\n<p>pledge letter was executed on 15.10.2007. According<\/p>\n<p>to the petitioner, the gold loan was closed in October<\/p>\n<p>2007,    but     had   it remained as a defaulted loan<\/p>\n<p>account beyond 31.12.2007, he would have been given<\/p>\n<p>the benefit of the Agriculture Debt Relief Scheme.<\/p>\n<p>3.   I heard learned counsel on both sides.        The<\/p>\n<p>extent of concession granted under the Scheme for<\/p>\n<p>agricultural loan     is   dependent on the extent of<\/p>\n<p>property held by the petitioner. Petitioner had actually<\/p>\n<p>W.P.(C).10465\/2009<br \/>\n<span class=\"hidden_text\">                            3<\/span><\/p>\n<p>closed the first loan and he cannot now be heard to say<\/p>\n<p>that an independent transaction was manipulated by<\/p>\n<p>the Bank authorities. The amount sanctioned under<\/p>\n<p>the new loan had been transferred to the SBI account,<\/p>\n<p>had withdrawn the same and then deposited it in the<\/p>\n<p>agricultural gold loan account.    What the Bank has<\/p>\n<p>done is a refinancing facility and it so happened that<\/p>\n<p>the said facility was afforded in October 2007.       Be<\/p>\n<p>that as it may, it cannot be disputed that the petitioner<\/p>\n<p>was not a defaulter vis-a-vis the new loan account as<\/p>\n<p>on 31.12.2007. He is therefore, not entitled to be<\/p>\n<p>treated as a defaulter under the Agriculture Debt<\/p>\n<p>Relief Scheme.
