ORAL JUDGEMENT<\/p>\n
     The short question that arises in this petition
\n     is whether the maintenance awarded to the petitioners
\n     under section 125 of the Criminal Procedure Code, 1973
\n     shall be awarded from the date of the application or from
\n     the date of the order.\n<\/p>\n
     2.Petitioner No.1 was being    ill   treated   by
\n     respondent No.  1. On 5th August, 1987, petitioner No.1
\n was driven out of her matrimonial home            and   she,
\ntherefore, went to her parents at Ranavav. On the next
\nday i.e. 6th August, 1987, respondent No.1, his brother
\nand   few     others went to Ranavav and informed the
\npetitioner No. 1 and her parents that respondent No.       1
\nwas not ready and willing to accept petitioner No. 1 and
\nto cohabit     with her.     He, however, agreed to pay
\nmaintenance to the petitioners. An agreement was drawn
\non the same day and under the said agreement, respondent
\nNo. 1 agreed to pay Rs.           600\/every month to the
\npetitioners by way of maintenance.         Respondent No. 1
\npaid the maintenance for three months and, thereafter,
\nstopped     paying   the   said   amount    of maintenance.
\nPetitioners were,      therefore,    constrained   to   file
\napplication under section 125 of the Criminal Procedure
\nCode for maintenance from respondent No.          1.    Said
\napplication being Criminal Miscellaneous Application No.
\n586 of 1987 was presented before the Court of 30th
\nNovember, 1987.     Said application was finally allowed by
\nthe learned Judicial Magistrate, First Class, Porbandar
\nunder his judgment and order dated 31st March, 1993.
\nLearned Magistrate awarded a sum of Rs.           600\/- for
\nmaintenance of the petitioners. The Court, however, held
\nthat    the    petitioners   had    not claimed that such
\nmaintenance be awarded from the date of the application
\nand,    therefore,    he   directed    that the amount of
\nmaintenance be paid to the petitioners from the date of
\nthe order.\n<\/p>\n
3.Feeling aggrieved, the petitioners      preferred
\nCriminal Revision Application No. 11 of 1993 before the
\nlearned Sessions Judge, Porbandar who, under his judgment
\nand order dated 8th December, 1993, has recorded that the
\ndelay in disposing of the application made under section
\n125   of   the   Code was caused to some extent for
\nadministrative reasons and also on account of respondent
\nNo. 1. It has been noted that respondent No. 1 did not
\nremain present before the Court on several occasions. He
\nexamined   himself on 29th November, 1991 and other
\nwitnesses in his support on 2nd January, 1993.   However,
\nthe Court held that since the petitioner had not made a
\nprayer that the amount of maintenance be paid from the
\ndate of the application, learned Magistrate had rightly
\nmade award effective from the date of the order. Feeling
\naggrieved, the petitioners have preferred this petition
\nbefore this Court.\n<\/p>\n
4.It is true that under section 125 (2) of the
\nCode, maintenance would be payable from the date of the
\norder. However, discretion has been conferred upon the
\ntrial Judge to make such maintenance payable from the
\n date of the application for maintenance. Thus, it is the
\ndiscretion of the trial Judge to award maintenance either
\nfrom the date of the application for maintenance or from
\nthe date of the order.        However, such discretion is
\nrequired to be exercised judiciously.      In the present
\ncase, I am of the view that the Courts below have wrongly
\nrefused the maintenance from the date of the application
\non the ground that there was no such prayer.          It is
\nundisputed that respondent No.         1 was liable to pay
\nmaintenance to the petitioners since 6th August, 1987,
\nthe date of the agreement. However, he did not respect
\nthe said agreement and neglected to pay the maintenance.
\nIt was in the said circumstance that the petitioners had
\nto make an application for maintenance.     Respondent No.
\n1 has avoided to attend the proceedings before the
\nlearned Magistrate. Thus, substantial delay has been
\ncaused in disposing of the application under section 125
\nof the Code on account of respondent No.          1.     The
\npetitioners should not be made to suffer on account of
\nsuch unsavoury behaviour of the respondent No.1.          I,
\ntherefore, consider it fit to interfere with the orders
\nof the Courts below and direct that the maintenance
\nawarded to the petitioners herein by the learned Judicial
\nMagistrate, First Class, Porbandar under his judgment and
\norder   dated   31st   March,     1993   made on Criminal
\nMiscellaneous Application No.      586 of 1987 shall be
\npayable   from   the   date    of    the   application for
\nmaintenance.The judgment and order of         the    learned
\nAdditional Sessions Judge, Porbandar passed in Criminal
\nRevision Application No. 11 of 1993 is quashed and set
\naside.\n<\/p>\n
5.Petition   is allowed accordingly.     Rule is made
\nabsolute.    Respondent No.   1 is directed to pay the
\narrears of   maintenance as directed hereinabove within the
\nperiod of    three months from to day. Writ shall be sent
\nforthwith.\n<\/p>\n
