The amount of Rs.25,000\/- deposited in this Court to the<br \/>\ntransferred to the Tribunal in the concerned claim case. The Tribunal<br \/>\nto make investments as per the award.??\n<\/p>\n<p>2.1\tIn<br \/>\naforesaid civil application, this Court by order dated 25.9.2008<br \/>\ncalled for necessary information from the claims Tribunal to clarify<br \/>\nas to whether any amount is deposited by the Insurance Co. and how<br \/>\nmuch amount is withdrawn by the claimants. This Court has received<br \/>\nthe report from the claims Tribunal wherefrom it appears that<br \/>\nrespondent claimant has withdrawn Rs.5 lacs  on 10.10.1995 and<br \/>\nRs.6,85,090\/- on 1.12.1995 and in all, Rs.11,85,090\/- has been<br \/>\nwithdrawn by the claimants from the claims Tribunal.\n<\/p>\n<p>3.\tIn<br \/>\nview of this facts, learned advocate Mr.Parikh for the appellant ?<br \/>\nInsurance Co. submitted that present appeal is filed by appellant ?<br \/>\nInsurance Co. challenging the award in question passed by MAC<br \/>\nTribunal, Bharuch and now, the appellant ?  Insurance Co. is<br \/>\nchallenging the limited aspect raising the contention against the<br \/>\nawarded interest by the claims Tribunal @ 15% upon the compensation.<br \/>\nTherefore, he submitted that this Court may consider this limited<br \/>\nchallenge raised by Insurance Co.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate Mr.Bhatt for the respondents claimants submitted that claims<br \/>\nTribunal has rightly awarded 15% interest upon the amount of<br \/>\ncompensation and for that, the claims Tribunal has not committed any<br \/>\nerror in granting 15% interest in favour of claimants.\n<\/p>\n<p>5.\tI<br \/>\nhave considered the submissions made by both the learned advocates<br \/>\nand also perused the award in question passed by claims Tribunal. The<br \/>\nclaims Tribunal has awarded 15% interest upon the amount of<br \/>\ncompensation but, nowhere claims Tribunal has discussed this aspect<br \/>\nthat on what basis the claims Tribunal has awarded 15% interest upon<br \/>\nthe amount of compensation. Therefore, considering the date of<br \/>\naccident ?  7.8.1987, the amount of compensation has been awarded by<br \/>\nclaims Tribunal. Therefore, according to my opinion, if this amount<br \/>\nof interest is little bit on higher side and in such circumstances,<br \/>\nin number of cases, the Apex Court has taken into account 10%<br \/>\ninterest  and passed the order accordingly. In case of <a href=\"\/doc\/35549\/\">Bijoykumar<br \/>\nDugar v. Bidyadhar Dutta<\/a> reported in 2006 ACJ 1058, the accident had<br \/>\ntaken place on 15.4.1988 and the High Court has enhanced the interest<br \/>\n@ 18%  which was reduced by the Apex Court to the extent of 10%.<br \/>\nTherefore, considering the aforesaid decision; date of accident as<br \/>\nwell as the facts of this case, when the claims Tribunal has not<br \/>\ndiscussed the issue at all for granting the interest @ 15%, in my<br \/>\nconsidered opinion, the interest of justice would best be met, if<br \/>\ninstead of 15% interest, 10% interest is awarded to the claimants.\n<\/p>\n<p>6.\tAccordingly,<br \/>\nthe award of interest passed by claims Tribunal is reduce from 15% to<br \/>\n10% and accordingly, the amount of compensation with interest is to<br \/>\nbe worked out and whatever amount required to be refunded by the<br \/>\nclaimants after proper verification, the respondents claimants are<br \/>\ndirected to refund the same to the appellant ?  Insurance Co. by<br \/>\nAccount Payee Cheque after a period of six months. Accordingly,<br \/>\npresent appeal is partly allowed.\n<\/p>\n<p>7.\tThe<br \/>\nappellant ?
