Modi, learned advocate, who, at the request of the<br \/>\nCourt, has agreed to act as amicus curiae.\n<\/p>\n<p>2.\tThe<br \/>\nappellant State has preferred this appeal under Section 378 of the<br \/>\nCriminal Procedure Code assailing the order of acquittal dated<br \/>\n10.5.1996 passed by the Additional Chief Judicial Magistrate, Gondal,<br \/>\nin Criminal Case No. 711 of 1991, acquitting present respondents\/<br \/>\noriginal accused of the charge of committing offence under Sections<br \/>\n7(1) and 16 of the Prevention of Food Adulteration Act, 1954 ( &#8216;PFA<br \/>\nAct 1954&#8217; for the sake of brevity) for the reasons stated thereunder.\n<\/p>\n<p>3\tIt<br \/>\nwas the case of the prosecution before the Court that concerned Food<br \/>\nInspector in discharge of his duty had collected sample of Chilli<br \/>\npowder on 13.5.1991 from the shop of the accused and after completing<br \/>\nthe formalities, one of the samples was sent for analysis and the<br \/>\nreport indicated that the sample was not in conformity with the<br \/>\nstandards prescribed. After obtaining sanction to lodge complaint,<br \/>\nsame was lodged against the accused\/respondent for the offence under<br \/>\nSections 7 &amp; 16 of the PFA Act. Trial Court summoned the accused,<br \/>\ntheir plea were recorded and after recording plea of not guilty to<br \/>\nthe charge, the trial commenced. At the end of trial only on a<br \/>\nsolitary ground acquitted the accused vide order of acquittal dated<br \/>\n10.5.1996, which is impugned in this appeal.\n<\/p>\n<p>4.\tShri<br \/>\nNanavaty, learned Additional Public Prosecutor for the appellant<br \/>\nsubmitted that the ground which is relied upon by the Court for<br \/>\nacquitting accused namely inadmissibility of Public Analyst Report on<br \/>\naccount of his not signing the report on the same day is no more a<br \/>\ngood law, and that ground ought not to have been made sole ground for<br \/>\nacquitting the accused of the charges levelled against them. Shri<br \/>\nNanavaty submitted that recently this Court has, in such a situation,<br \/>\nremanded the matter to the trial court as the trial court did not<br \/>\nadvert to any other aspects in the matter.\n<\/p>\n<p>5.\tShri<br \/>\nNanavaty, relying upon the decision of this Court in the case of<br \/>\n<a href=\"\/doc\/1179818\/\">State of Gujarat vs. Prafulchandra Ranchhodkumar<\/a> in Criminal Appeal<br \/>\nNo.493 of 1996 decided on 11.1.2010 submitted that the trial Court<br \/>\nwas not justified in recording acquittal on the ground of Public<br \/>\nAnalyst report being inadmissible or not of any material when the<br \/>\nsample was not examined. Shri Nanavaty submitted that the Division<br \/>\nBench of this Court in the case of State of Guajrat vs. Vishramdas<br \/>\nVirumal, reported in 2000(4) GLR 2884 has held that in such a case,<br \/>\nreport cannot be ignored without examining the Public Analyst as a<br \/>\nwitness either by the Court or by the accused raising doubt about the<br \/>\ncorrectness of the report. Shri Nanavaty also relied upon another<br \/>\ndecision reported in case of <a href=\"\/doc\/1088726\/\">State of Gujarat vs. Uttamchand<br \/>\nHathichand Shah &amp;<\/a> ors, reported in 2007(2) GLH 249.\n<\/p>\n<p>6.\tShri<br \/>\nNanavaty submitted that relying upon above two judgments, this Court<br \/>\nin case of <a href=\"\/doc\/1179818\/\">State of Gujarat vs. Prafulchandra  Ranchhodkumar (Supra)<\/a><br \/>\ndecided to remand the matter back for appropriate examination of the<br \/>\ncase. He submitted that in the instant case also, this Court may<br \/>\nremand the matter.\n<\/p>\n<p>7.\tThis<br \/>\nCourt heard Shri D.K. Modi, learned advocate who appears as amicus<br \/>\ncuriae, and has submitted that after long gap of almost 20 years,<br \/>\nremanding the matter would serve no purpose. He has submitted that<br \/>\nthe sample was taken in the year 1990, acquittal order is pronounced<br \/>\nin the year 1996 and, now the matter is remanded back to the trial<br \/>\nCourt for further trial on the aspect of remaining points, same would<br \/>\nact as prejudice against the respondents original accused.\n<\/p>\n<p>8.\tThis<br \/>\nCourt is in complete agreement with learned Additional Public<br \/>\nProsecutor with regard to the erroneous findings of the Court in<br \/>\nrespect of inadmissibility of Public Analyst Report. But, this Court<br \/>\nis not inclined to remand the matter. Shri Modi, therefore was called<br \/>\nupon to make submission in respect of any other point which may be<br \/>\navailable to the accused respondents to rely upon any other ground<br \/>\nfor sustaining the acquittal which are not adverted to by the Court<br \/>\nof the first instance. In this case, thus, Shri Modi submitted that<br \/>\nthe sample food article being Chilli Powder which was in  a gunny bag<br \/>\nfrom which the sample was collected and now it is to be seen from the<br \/>\ncertified copy of the testimony of the Food Inspector which is placed<br \/>\non record by learned Additional Public Prosecutor. It can be seen<br \/>\nthat the Food Inspector has not given any evidence with regard to the<br \/>\nstirring and\/ or mixing the entire quantity of the chilli powder so<br \/>\nas to make it homogeneous representing of the entire quantity of the<br \/>\nsample. Therefore, this being  a serious lacuna in the case of the<br \/>\nprosecution, the order of acquittal  needs to be sustained.\n<\/p>\n<p>9.\tShri<br \/>\nModi&#8217;s submission with regard to non-stirring of the entire quantity<br \/>\nof powder appears to be correct. He relies upon the decision of  the<br \/>\nDelhi High Court in the case of State vs. Mahavir  reported in<br \/>\n2009(3) Crimes 209(Del.) with regard to requirement of stirring and<br \/>\nmaking entire quantity homogeneous before taking sample that was the<br \/>\ncase of Lal Mirchi Powder.\n<\/p>\n<p>10.\tThis<br \/>\nCourt is of the view that when the sizable record is destroyed as<br \/>\nreported, the remand would not serve any useful purpose especially<br \/>\nwhen the sample in question had been collected way back in the year<br \/>\n1991 and the acquittal is recorded in the year 1996. The order of<br \/>\nacquittal needs no interference in view of the fact that the same is<br \/>\nsustainable on other grounds.\n<\/p>\n<p>11.\tThis<br \/>\nCourt is of the view that in view of the peculiar facts and<br \/>\ncircumstances of the case, the order of acquittal need not be<br \/>\ninterfered with. Accordingly, the appeal is dismissed. Bail bonds, if<br \/>\nany, stand cancelled.\n<\/p>\n<p>(S.
