ARIJIT PASAYAT AND ASOK KUMAR GANGULY, JJ.]\n\n\n    The Judgment of the Court was delivered by\n\n    DR. ARIJIT PASAYAT, J. 1. Heard learned counsel for the\nparties.\n\n    2. Challenge in this appeal is to the judgment of a learned\nSingle Judge of the Himachal Pradesh High Court upholding the\nconviction of the appellant for offence punishable under Section\n61(1)(a) of the Punjab Excise Act, 1914 (hereinafter referred to as\n'the Act').\n\n    3. The allegation against the accused-appellant was that he\nwas carrying illicit liquor in a container wrapped in a gunny bag.\nThe accused was driving truck bearing No.HPA-1975 and the truck\nwas stopped and search was carried out. On checking the\ncontainer, it was found that it contained five bottles of illicit liquor.\nOn analysis by the Chemical Examiner, the sample which was\ncollected was found to be illicit liquor.\n\n    4. Learned Chief Judicial Magistrate, Solan, found the\nappellant guilty of the offence punishable under Section 61(1)(a) of\nthe Act and sentenced him to simple imprisonment for six months\nand to pay a fine of Rs.5,000\/- with default stipulation.\n   5. The matter was carried in appeal by the appellant before the\nlearned Sessions Judge who dismissed the appeal. The appellant\nchallenged the order of the learned Sessions Judge before the\nHigh Court by filing criminal revision which, by the impugned order,\ndismissed the appeal.\n\n   6. In support of the appeal learned senior counsel for the\nappellant submitted that the evidence adduced by the prosecution\nto establish the accusations was not sufficient to record the\nconviction. Additionally, it is submitted that though the learned\nChief Judicial Magistrate was of the view that six months' sentence\nwould be harsh, yet, being of the view that the minimum sentence\nimposable was six months, imposed the sentence of six months.\nAccording to learned senior counsel for the appellant, the\noccurrence took place on 25th May 1995 at which point of time\nthere was no minimum sentence prescribed as amendment to\nSection 61(1)(a) bringing in the concept of minimum sentence was\nintroduced by Himachal Pradesh Act No.8\/1995 dated 23rd June\n1995.\n\n   7. Learned counsel for the respondent, on the other hand,<\/pre>\n<p>submitted that the relevant date would be the date of conviction<br \/>\nand not the date of commission of the offence.\n<\/p>\n<p>   8. Prior to the amendment by the Himachal Pradesh<br \/>\nAmendment Act, Section 61(1)(a) read as follows :\n<\/p>\n<p>   &#8220;61.(1)   Penalty    for   unlawful   import,   export,   transport,<br \/>\n   manufacture, possession, etc.: Whoever, in contravention of<br \/>\n   any section of this Act or of any rule, notification issued or<br \/>\n   given thereunder or order made, or of any license, permit or<br \/>\n   pass granted under this Act,-\n<\/p>\n<p>          (a) imports, exports, transports, manufactures, collects or<br \/>\n          possesses any (intoxicant); or<\/p>\n<p>          (b) &#8230; &#8230; &#8230;\n<\/p>\n<p>          (c) &#8230; &#8230; &#8230;\n<\/p>\n<p>    shall be punishable for every such offence with imprisonment<br \/>\n    for a term which may extend to three years and with fine upto<br \/>\n    two thousand rupees and if found in possession of a working<br \/>\n    still for the manufacture of any intoxicant shall be punishable<br \/>\n    with the minimum sentence of six months imprisonment and<br \/>\n    fine of two hundred rupees.&#8221;\n<\/p>\n<p>    9. A bare reading of the above provision makes it clear that<br \/>\nthough the maximum sentence was prescribed, there was no<br \/>\nminimum sentence prescribed.\n<\/p>\n<p>    10. It is trite law that the sentence imposable on the date of<br \/>\ncommission of the offence has to determine the sentence<br \/>\nimposable on completion of trial. This position is clear even on a<br \/>\nbare reading of Article 20(1) of the Constitution of India, 1950 (in<br \/>\nshort, &#8216;the Constitution&#8217;). The said provision reads as under:\n<\/p>\n<blockquote><p>    &#8220;20. Protection in respect of conviction for offences.-(1) No<br \/>\n    person shall be convicted of any offence except for violation of<br \/>\n    a law in force at the time of the commission of the act charged<br \/>\n    as an offence, nor be subjected to a penalty greater than that<br \/>\n    which might have been inflicted under the law in force at the<br \/>\n    time of the commission of the offence.&#8221;<\/p><\/blockquote>\n<p>    11. Wills in his Constitutional Law of the United States (at page\n<\/p>\n<p>516) brought out a lucid classification of the penal law which are ex<br \/>\npost facto :\n<\/p>\n<p>     (i)     when they make criminal an act which was innocent<br \/>\n             when done;\n<\/p>\n<p>     (ii)    when they make a crime greater than it was when it was<br \/>\n             committed;\n<\/p>\n<p>     (iii) when they make the punishment greater than the<br \/>\n             punishment was at the time the act was committed;\n<\/p>\n<p>     (iv) when they change the rule of evidence as to deprive a<br \/>\n             defendant of a substantive right; and<\/p>\n<p>     (v) when they make retrospective qualifications for an<br \/>\n             offence which are out a proper exercise of the police<br \/>\n             power.\n<\/p>\n<p>Under Article 20(1) of the Constitution what is prohibited is the<br \/>\nconviction and sentence in criminal proceedings under ex post<br \/>\nfacto law.\n<\/p>\n<p>    12. Considering the quantity of illicit liquor seized and the<br \/>\npassage of time, while upholding the conviction, we restrict the<br \/>\nperiod of sentence to the one already undergone.\n<\/p>\n<p>    13. The bail bonds executed to give effect to the order of bail<br \/>\ndated 09th September 2002 shall stand discharged.\n<\/p>\n<p>    14.
