Justice ANTONY DOMINIC\n\n Dated :30\/07\/2009\n\n O R D E R\n                      ANTONY DOMINIC, J.\n                    ================\n                 W.P.(C) NO. 21540 OF 2009 (J)\n                =====================\n\n            Dated this the 30th day of July, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>      Delay in considering Ext.P7 application made by the<\/p>\n<p>petitioner for additional power allocation of 400 KVA is what is<\/p>\n<p>complained of in this writ petition.\n<\/p>\n<p>      2.   Petitioner submits that on 4\/10\/2004, they had applied<\/p>\n<p>for increasing the contract demand by 150 KVA. Prior to the said<\/p>\n<p>application was made, on 4\/11\/2005, there was an inspection in<\/p>\n<p>the premises of the petitioner conducted by the Anti Power Theft<\/p>\n<p>Squad of the Board. That led to the issuance of Ext.P2 mahazar<\/p>\n<p>and Ext.P3 penal bill, which was confirmed by the Deputy Chief<\/p>\n<p>Engineer. When the application dated 4\/10\/2004 referred to<\/p>\n<p>above was received by the respondents, they by Ext.P1 informed<\/p>\n<p>the petitioner that application can be considered only after the<\/p>\n<p>amount due under Exts.P2 and P3 is paid. Exts.P2 and P3 were<\/p>\n<p>challenged before this Court and by Ext.P4 judgment rendered in<\/p>\n<p>WP(C) No.22806\/06, the parties were relegated to pursue their<\/p>\n<p>grievances before the Kerala State Electricity Regulatory<\/p>\n<p>Commission. Proceedings are still pending before the Regulatory<\/p>\n<p>WPC 21540\/09<br \/>\n<span class=\"hidden_text\">                                 :2 :<\/span><\/p>\n<p>Commission and as in the meanwhile, when the petitioner<\/p>\n<p>received Ext.P1, they challenged the said order before this Court<\/p>\n<p>by filing WP(C) No.23768\/07. That writ petition was disposed of by<\/p>\n<p>Ext.P5 judgment directing to allow increase in the contract<\/p>\n<p>demand, on the petitioner complying with the formalities and<\/p>\n<p>without insisting on the amount due under Exts.P2 and P3 since<\/p>\n<p>the issue was pending before the Regulatory Commission. It is<\/p>\n<p>stated that though belatedly the judgment was complied with and<\/p>\n<p>accordingly Ext.P6 HT agreement was also entered into between<\/p>\n<p>the parties.\n<\/p>\n<p>       3.   Subsequently, the petitioner made Ext.P7 application<\/p>\n<p>for additional allocation of 400 KVA, which requirement arose on<\/p>\n<p>the setting up of a Cardiology Department and its incidental<\/p>\n<p>facilities. Referring to Exts.P8 and P9, petitioner submits that<\/p>\n<p>they had already got the approval of the Chief Electrical Inspector<\/p>\n<p>and that all necessary documents have been enclosed to Ext.P7.<\/p>\n<p>It is stated that Ext.P7 application is also not considered for the<\/p>\n<p>reason that the amount due under Exts.P2 and P3, which dispute<\/p>\n<p>is still pending before the Regulatory Commission has not been<\/p>\n<p>paid by the petitioner.     It is in these circumstances the writ<\/p>\n<p>petition is filed praying for a direction to the respondents to<\/p>\n<p>WPC 21540\/09<br \/>\n<span class=\"hidden_text\">                                :3 :<\/span><\/p>\n<p>consider and pass orders on Ext.P7, without insisting on payment<\/p>\n<p>of the amount due under Exts.P2 and P3.\n<\/p>\n<p>       4.   If as stated by the petitioner, dispute regarding their<\/p>\n<p>liability to pay the amount claimed under Exts.P2 and P3 is still<\/p>\n<p>pending before the Regulatory Commission following Ext.P4<\/p>\n<p>judgment of this Court, that cannot be a reason for not<\/p>\n<p>considering Ext.P7 application made by the petitioner.<\/p>\n<p>       5.   Therefore, the writ petition is disposed of with the<\/p>\n<p>following directions.\n<\/p>\n<p>       (1)  That if Ext.P7 application is complete in all respects<\/p>\n<p>and the petitioner has complied with all other requirements for<\/p>\n<p>additional allocation of power as sought for in Ext.P7, the 3rd<\/p>\n<p>respondent shall consider Ext.P7 on merits, without insisting on<\/p>\n<p>the petitioner remitting the amount claimed under Exts.P2 and<\/p>\n<p>P3.\n<\/p>\n<p>       (2)  Orders shall be passed on Ext.P7, as expeditiously as<\/p>\n<p>possible, at any rate within 4 weeks of production of a copy of<\/p>\n<p>this judgment along with a copy of this writ petition.<\/p>\n<p>                                       ANTONY DOMINIC, JUDGE<br \/>\nRp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court L.F.Hospital vs Kerala State Electricity Board on 30 July, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 21540 of 2009(J) 1.
