A  single  judge\nwho  was  seized  of  the  case\t rejected  the\tapplication.\nThereupon  N  presented\t an  appeal  against  the  order  of\nrejection of his application before the Supreme Court  under\nS. 476-B, Code of Criminal Procedure.\nHeld,  that the appeal did not lie to the Supreme Court\t but\nthat  it lay to the Appellate Bench of the High Court.\t The\ndecrees of a single judge of the High Court exercising civil\njurisdiction  were ordinarily appealable to the\t High  Court\nunder  cl.  1o of the Letters Patent of the  Allahabad\tHigh\nCourt\tread  with  cl.\t 13  of\t the  U.  P.   High   Courts\n(Amalgamation)\t Order,\t  1948,\t and  as  such\t the   Court\nconstituted  by the single judge was a court subordinate  to\nthe Appellate Bench of the High Court within the meaning  of\ns. 195(3) of the <a href=\"\/doc\/500548\/\">Code.\nM.   S. Sheriff v. The State of Madras,<\/a> [1954] S.C.R.  1144,\ndistinguished.\n\t\t\t    677\n\n\n\nJUDGMENT:\n<\/pre>\n<p>CRIMINAL   APPELLATE   JURISDICTION:  In   the\t matter\t  of<br \/>\nmaintainability of appeal in the Supreme Court of India.<br \/>\nMohan Lal Agarwala, for the petitioner.\n<\/p>\n<p>G.   C. Mathur and C. P. Lal, for the respondent No. 1.<br \/>\n1960.\tSeptember  14.\t The  Judgment\tof  the\t Court\t was<br \/>\ndelivered by<br \/>\nRAGHUBAR  DAYAL\t J.-Narain Das filed a civil  writ  petition<br \/>\nunder  Art.  226 of the Constitution in the  High  Court  of<br \/>\nJudicature   at\t  Allahabad.   He  subsequently\t  moved\t  an<br \/>\napplication  under s. 476 of the Code of Criminal  Procedure<br \/>\n(hereinafter  called the Code) for making a complaint  under<br \/>\ns. 193, Indian Penal Code, against Phanish Tripathi alleging<br \/>\nthat a certain statement in an affidavit filed by the latter<br \/>\nwas  false.  The learned Judge who heard  this\tapplication,<br \/>\nholding that the appellant had not succeeded in showing that<br \/>\nany  portion of the affidavit of Tripathi filed on  May\t 14,<br \/>\n1959,  was  false, dismissed the same.\tIt is  against\tthis<br \/>\norder of the learned Judge of the High Court that Narain Das<br \/>\nhas  filed  this memorandum of appeal under s. 476B  of\t the<br \/>\nCode.\tThe Registry has submitted the memorandum of  appeal<br \/>\nwith  a\t report\t for determining the  question\twhether\t the<br \/>\nappeal is competent in this Court.\n<\/p>\n<p>Section 476 of the Code is to be found in Ch.  XXXV which is<br \/>\nheaded\t&#8216;Proceedings in case of certain\t Offences  Affecting<br \/>\nthe  Administration of Justice&#8217;.  Section 476  empowers\t any<br \/>\nCivil, Revenue or Criminal Court, when it is of the  opinion<br \/>\nthat  it  is expedient in the interests of justice  that  an<br \/>\ninquiry\t should be made into any offence referred to  in  s.<br \/>\n195(1) (b) or (c) which appears to have been committed in or<br \/>\nin relation to a proceeding before it, to file a  complaint,<br \/>\nafter  such  inquiry  as  it  thinks  necessary,  before   a<br \/>\nMagistrate  of\t Class\thaving jurisdiction.   It  is  clear<br \/>\ntherefore that where an offence referred to in s. 195(1) (b)<br \/>\nor  (c) is committed in or in relation to a proceeding in  a<br \/>\nCivil Court, an inquiry under s. 476 and. the action taken<br \/>\n<span class=\"hidden_text\">678<\/span><br \/>\non that inquiry by the Civil Court, are in relation to\tthat<br \/>\nproceeding itself.\n<\/p>\n<p>Any person aggrieved by an order of a Court under s. 476. of<br \/>\n&#8216;the  Code  may appeal in view of s. 476B to  the  Court  to<br \/>\nwhich the former Court is subordinate within the, meaning of<br \/>\ns.  195(3),  which  provides that for the  purposes  of\t the<br \/>\nsection\t a  Court shall be deemed to be subordinate  to\t the<br \/>\nCourt  to which appeals ordinarily lie from  the  appealable<br \/>\ndecrees\t or sentences of such former Court, or, in the\tcase<br \/>\nof  a  Civil Court from whose decrees no  appeal  ordinarily<br \/>\nlies,  to  the,, principal Court  having  ordinary  original<br \/>\ncivil\tjurisdiction  within  the  local  limits  of   whose<br \/>\njurisdiction such Civil Court is situate.  The decrees of  a<br \/>\nsingle Judge of the High Court exercising civil jurisdiction<br \/>\nare ordinarily appealable to the High Court under el. 10  of<br \/>\nthe Letters Patent of the Allahabad High Court read with el.<br \/>\n13 of the United Provinces High Courts (Amalgamation) Order,<br \/>\n1948.  It is true that the decision of a single Judge of the<br \/>\nHigh  Court is as much a decision of the High Court  as\t the<br \/>\ndecision of the appellate Bench hearing appeals against\t his<br \/>\ndecrees.  But the Court constituted, by the single Judge  is<br \/>\na Court subordinate to the appellate Bench of the High Court<br \/>\nin view of the artificial judicial subordination created  by<br \/>\nthe  provisions of s. 195(3) to the effect&#8217; &#8216; a Court  shall<br \/>\nbe  deemed to be subordinate to the Court to  which  appeals<br \/>\nordinarily  lie\t from the appeal. able decrees&#8230;&#8217;.  In\t the<br \/>\ncase of a Civil Court which passes appealable decrees,\tthat<br \/>\nCourt  is  deemed to be subordinate to the  Court  to  which<br \/>\nappeals ordinarily lie from its decrees.  In&#8217; the case of  a<br \/>\nCivil  Court from whose decrees no appeal  ordinarily  lies,<br \/>\nthat  Court  is deemed subordinate to  the  principal  Court<br \/>\nhaving ordinary original civil jurisdiction within the local<br \/>\nlimits\tof whose jurisdiction the former Court\tis  situate,<br \/>\neven though normally such a Court will not be subordinate to<br \/>\nthe   principal\t  Court\t having\t ordinary   original   civil<br \/>\njurisdiction within whose local limits it is situate.<br \/>\nIt was urged by the learned Advocate for Narain Das that the<br \/>\norder of the learned single Judge under<br \/>\n<span class=\"hidden_text\">\t\t\t    679<\/span><br \/>\ns.476  did  not amount to a decree and\tthat  therefore\t the<br \/>\nprovisions  of\ts. 195(3) were not applicable.\t It  is\t not<br \/>\nnecessary  for\tus  to express an opinion  on  the  question<br \/>\nwhether\t the order of the learned single Judge under s.\t 476<br \/>\nis appealable under cl. 10 of the Letters Patent or not.   A<br \/>\nright  of  appeal  against  that  order\t is  given  by-\t the<br \/>\nprovisions  of\ts.  476\t B. The\t forum\tof  appeal  is\talso<br \/>\ndetermined by the provisions of s. 476B read with s. 195(3),<br \/>\nand the only relevant consideration to determine the  proper<br \/>\nforum  for  an appeal against such an order  of\t the  single<br \/>\nJudge  is as to which Court the appeals\t against  appealable<br \/>\ndecrees\t of the single Judge ordinarily lie.   Such  appeals<br \/>\nlie to the High Court under cl. 10 of the Letters Patent  of<br \/>\nthe Allahabad High Court, and therefore this appeal lies to&#8217;<br \/>\nthe High Court.\n<\/p>\n<p>Learned counsel for the appellant relied on the decision  of<br \/>\nthis  Court in <a href=\"\/doc\/500548\/\">M. S. Sheriff v. The State of Madras<\/a>  (1)  in<br \/>\nsupport\t of his contention that an appeal under s. 476B\t lay<br \/>\nto this Court from the decision of a single Judge of a\tHigh<br \/>\nCourt refusing to file a complaint under s. 476 of the Code.<br \/>\nThat  case is distinguishable as the question considered  in<br \/>\nthat  case was whether an appeal lay to this Court under  s.<br \/>\n476B of the Code from an order of a Division Bench of a High<br \/>\nCourt.\tIt did not deal with the question whether an  appeal<br \/>\nlay to this Court under s. 476B of the Code from an order of<br \/>\na  single  Judge of the High Court.  No appeal lies  to\t the<br \/>\nHigh  Court against the decision of a Division Bench of\t the<br \/>\nHigh  Court  and therefore an appeal under s. 476B  from  an<br \/>\norder  of the Division Bench of the High Court must  lie  to<br \/>\nthis Court.\n<\/p>\n<p>The fact that an appeal lies to this Court from the order of<br \/>\na  single  Judge  of the High Court  where  the\t High  Court<br \/>\ncertifies, under Art. 132 of the Constitution, that the case<br \/>\ninvolves   a   substantial  question  of  law  as   to\t the<br \/>\ninterpretation\tof the Constitution, is of no assistance  to<br \/>\nthe appellant&#8217;s contention &#8216;that this appeal is competent in<br \/>\nthis  Court.   It cannot be said that an  appeal  ordinarily<br \/>\nlies to this Court from the<br \/>\n(1)  [1954] S.C.R. 1144.\n<\/p>\n<p><span class=\"hidden_text\">87<\/span><br \/>\n<span class=\"hidden_text\">680<\/span><\/p>\n<p>judgment  of a single Judge of a High Court because such  an<br \/>\nappeal lies with a certificate granted under Art. 132.<br \/>\nWe  therefore hold that the present appeal does not  lie  to<br \/>\nthis Court and that it lies to the High Court of  Judicature<br \/>\nat  Allahabad.\tWe therefore direct that the  memorandum  of<br \/>\nappeal be returned for presentation. to the proper Court.<br \/>\nAppeal incompetent.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Narain Das vs The State Of Uttar Pradesh on 14 September, 1960 PETITIONER: NARAIN DAS Vs.
