No. 3675 of 2010\n\n                               Heard the parties.\n\n<\/pre>\n<p>                               The present interlocutory application has been<\/p>\n<p>                     filed by the appellants-defendants under Order 41 Rule 5<\/p>\n<p>                     read with section 151 of the Code of Civil Procedure for<\/p>\n<p>                     staying the further proceeding in Execution Case No. 01 of<\/p>\n<p>                     2009 pending in the Court of learned Munsif, Ara. By an<\/p>\n<p>                     order dated 30.08.2010 an order of ad interim stay was<\/p>\n<p>                     passed by a Bench of this Court and matter was adjourned at<\/p>\n<p>                     the instance of learned counsel appearing on behalf of the<\/p>\n<p>                     respondents\/plaintiffs, who has now filed an affidavit in<\/p>\n<p>                     opposition of the present interlocutory application. Hence,<\/p>\n<p>                     this matter has come up for final disposal.<\/p>\n<p>                               Learned counsel for the appellants submits that<\/p>\n<p>                     plaintiffs respondents herein brought Title Suit No. 63 of<\/p>\n<p>                     1981 for declaration of his right and title with respect to plot<\/p>\n<p>                     nos. 888 &amp; 889 and for declaring the defendants as<\/p>\n<p>                     encroachers over the same. The aforesaid title suit was<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>heard and finally decided by judgment and decree dated 4th<\/p>\n<p>October, 2002 by learned 3rd Munsif, Ara. By referring to<\/p>\n<p>paragraph 22 of the trial court judgment, learned counsel for<\/p>\n<p>the appellants submits that the learned trial court has<\/p>\n<p>declared the right and title of the defendants over the suit<\/p>\n<p>property and has further held that they are not the<\/p>\n<p>encroachers over the same. Finally suit was dismissed with<\/p>\n<p>cost by the aforesaid judgment and decree referred to above.<\/p>\n<p>Being aggrieved by the aforesaid judgment and decree<\/p>\n<p>passed by learned trial court, the plaintiffs filed Title Appeal<\/p>\n<p>No. 52 of 2002which was finally allowed by judgment and<\/p>\n<p>decree dated 22n   d<br \/>\n                       December 2003 passed by learned 2nd<\/p>\n<p>Additional District and Sessions Judge, Ara. The learned<\/p>\n<p>lower appellate court has decreed the suit of the plaintiffs<\/p>\n<p>respondents and has reversed the judgment of the learned<\/p>\n<p>trial court and further the defendants have been held to be<\/p>\n<p>encroachers over the lands in question. Being aggrieved by<\/p>\n<p>the aforesaid judgment and decree passed by learned lower<\/p>\n<p>appellate court, the present second appeal has been<\/p>\n<p>preferred, which has been admitted by a Bench of this Court<\/p>\n<p>by order dated 05.02.2009. Substantial questions of law<\/p>\n<p>have been framed and lower court records have been called<br \/>\n<span class=\"hidden_text\">                    3<\/span><\/p>\n<p>for. In the meantime, the plaintiffs decree holder levied the<\/p>\n<p>aforesaid Execution Case No. 01 of 2009. Admittedly, the<\/p>\n<p>present second appeal is against the judgment of reversal.<\/p>\n<p>The trial court has decided the issues regarding title over the<\/p>\n<p>suit land in favour of the defendants, whereas lower<\/p>\n<p>appellate court has decided the issues of title in favour of the<\/p>\n<p>plaintiffs. That being the position and in view of the fact, the<\/p>\n<p>present second appeal has been admitted by a Bench of this<\/p>\n<p>Court, it would not be appropriate to allow the execution<\/p>\n<p>case to proceed at this stage. Further ad interim stay has<\/p>\n<p>already been granted by an order dated 30.08.2010.<\/p>\n<p>          In the facts and circumstances a prima facie case<\/p>\n<p>is in favour of the defendants\/appellants. Accordingly, the<\/p>\n<p>present interlocutory application is allowed. The further<\/p>\n<p>proceeding in Execution Case No. 01 of 2009 is hereby<\/p>\n<p>stayed till disposal of the present second appeal. In view of<\/p>\n<p>the controversy at hands, it would be appropriate that the<\/p>\n<p>second appeal be listed for final hearing at an early date.<\/p>\n<p>Office may verify from the records as to whether the notices<\/p>\n<p>have been validly served on all the respondents or not.
