Respondents\n                                   ----------------------------------\n<\/pre>\n<p>                        For the Petitioner : Mr. Umesh Kumar Roy, Advcoate<br \/>\n                        For the State        : Mr. Bibhakar Tiwary, AC to SC 21\n<\/p>\n<p>                                                  &#8212;&#8211;\n<\/p>\n<p>3   04.08.2011                Heard learned counsel for the petitioner and<\/p>\n<p>                       the State.\n<\/p>\n<p>                              Petitioner claims that respondent nos. 5 to 7<\/p>\n<p>                       have encroached upon a public land which is a public<\/p>\n<p>                       &#8216;Rasta&#8217; and petitioner along with others had made<\/p>\n<p>                       representation before the respondents but no action<\/p>\n<p>                       could be taken by them.\n<\/p>\n<p>                              This writ application has been filed in the year<\/p>\n<p>                       2005, however, no counter affidavit has been filed on<\/p>\n<p>                       behalf of the State. In above view of the matter, this<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>        has to be disposed of in absence of the same.<\/p>\n<p>               In view of the fact that the petitioner has<\/p>\n<p>        moved before the respondent authorities, but it is<\/p>\n<p>        urged that no action has been taken by them, let him<\/p>\n<p>        file a proper petition under the Bihar Public Land<\/p>\n<p>        Encroachment Act, 1956 before the competent<\/p>\n<p>        authority along with a copy of this order. If such<\/p>\n<p>        petition is filed then the authority concerned shall<\/p>\n<p>        proceed in accordance with law and after considering<\/p>\n<p>        the matter on merit and after giving opportunity of<\/p>\n<p>        hearing to all the parties concerned including the<\/p>\n<p>        respondent nos. 5 to 7 and pass final order within six<\/p>\n<p>        months thereafter.
