DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 14\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tThis<br \/>\napplication is filed under Section 438 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered<br \/>\nbeing  CR No.I- 9 of 2010 with Kevadia Police Station for the<br \/>\noffences punishable under Sections 407, 409, 420, 477A and 34 of<br \/>\nthe Indian Penal Code.\n<\/p>\n<p>2.\t\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase,  following aspects have been considered.\n<\/p>\n<p>3.\t\tThat<br \/>\nthe applicant  has deposited an amount of Rupees One Lakh, no doubt,<br \/>\nas per the learned Advocate for the applicant, it was under duress<br \/>\nand pressure exerted by the high ranking officers.   Besides, the<br \/>\napplicant is placed under suspension.\n<\/p>\n<p>4.\t\tConsidering<br \/>\nthe above, I am inclined to  grant Anticipatory Bail on  imposing<br \/>\nsuitable  conditions:\n<\/p>\n<p>\t\tLearned<br \/>\ncounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe result, this application is allowed by directing that in the<br \/>\nevent of the applicant herein being arrested pursuant to FIR being<br \/>\nCR No.I- 9 of 2010  registered with Kevadia  Police Station,  the<br \/>\napplicant shall be released on bail on furnishing a bond of Rs.<br \/>\n5,000\/- (Rupees Five Thousand only) with one surety of like amount on<br \/>\nfollowing conditions :-\n<\/p>\n<p>shall<br \/>\n\tcooperate with the investigation and make available for whenever<br \/>\n\trequired;\n<\/p>\n<p>shall<br \/>\n\tremain present at the concerned Police Station on 22.12.2010 at<br \/>\n\t11.00 a.m.;\n<\/p>\n<p>shall<br \/>\n\tnot hamper the investigation in any manner nor shall directly or<br \/>\n\tindirectly make any inducement, threat or promise to any witness so<br \/>\n\tas to dissuade them for disclosing such facts to the Court or to any<br \/>\n\tPolice Officer;\n<\/p>\n<p>at<br \/>\n\tthe time of execution of bond, furnish the address to  the<br \/>\n\tInvestigating Officer and the court concerned and shall not change<br \/>\n\tthe residence till the final disposal of the case of till further<br \/>\n\torders;\n<\/p>\n<p>will<br \/>\n\t not  leave India without the permission of the Court and, if is<br \/>\n\tholding a passport, shall surrender the same before the trial Court<br \/>\n\twithin a week;\n<\/p>\n<p>it<br \/>\n\twould be open to the Investigating Officer to file an application<br \/>\n\tfor remand, if he considers it just and proper and the concerned<br \/>\n\tMagistrate would decide it on merits;\n<\/p>\n<p>this<br \/>\n\torder will be operative if the applicant is arrested at any time<br \/>\n\twithin a period of 90 days;\n<\/p>\n<p>within<br \/>\n\ta period of ten days from the date of arrest, the applicant shall<br \/>\n\tapply for regular bail which application shall be decided by the<br \/>\n\tcompetent Court in accordance with law without being influenced by<br \/>\n\tthe fact that anticipatory bail was granted.\n<\/p>\n<p>6.\t\tWith<br \/>\nthese directions, this Criminal Misc.
