JUSTICE R.R.PRASAD\n\n               For the Petitioner : Mr. Mukesh Kumar Sinha\n               For the Respondent : Mr. Anoop Kumar Mehta\n\n7.   16.1.09<\/pre>\n<p>         This writ application has been filed for quashing the order as<\/p>\n<p>               contained in letter no. BCCL\/S&amp;M\/PS\/F-19 points\/2409 dated<\/p>\n<p>               31.7.2007 as contained in Annexure 10 whereby Bharat Coking<\/p>\n<p>               Coal Limited has refused to allocate the coal to the petitioner&#8217;s<\/p>\n<p>               firm, namely, M\/s. Basic Fuels Pvt. Ltd.. Further prayer is to direct<\/p>\n<p>               the respondents to allocate the coal to the petitioner&#8217;s unit on the<\/p>\n<p>               terms and conditions of the linkage.\n<\/p>\n<p>                     It is the case of the petitioner that under the consultation of<\/p>\n<p>               CMPDI, Special Smokeless Fuel (S.S.F) plant was established at<\/p>\n<p>               Badgunda, District- Giridih.   Thereafter the officials of CMPDI as<\/p>\n<p>               well as Bharat Coking Coal Limited made inspection of the plant<\/p>\n<p>               and when everything was found in order for commissioning of the<\/p>\n<p>               said plant, Coal India Limited started supplying coal to the tune of<\/p>\n<p>               5000 M.T under the scheme of coal linkage. While everything was<\/p>\n<p>               going on smoothly,    Bharat Coking Coal Limited issued a notice<\/p>\n<p>               dated 30.11.2004, whereby detailed informations pertaining to 19<\/p>\n<p>               points indicated therein were sought from the consumers including<\/p>\n<p>               the petitioner&#8217;s unit which was complied with. Moreover, when<\/p>\n<p>               certain deficiencies were pointed out, those deficiencies were<\/p>\n<p>               removed by submitting rest of the documents.        In spite of that,<\/p>\n<p>               petitioner was surprised to find that     supply of coal has been<\/p>\n<p>               discontinued   to   140   units   including   to   petitioner&#8217;s   unit.<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>Subsequently, when Bharat Coking Coal Limited did find that coal<\/p>\n<p>supply has wrongly been stopped to the petitioner&#8217;s firm, it started<\/p>\n<p>supplying coal to the petitioner&#8217;s unit. But again in the year 2007,<\/p>\n<p>Bharat Coking Coal Limited stopped supplying the coal to the<\/p>\n<p>petitioner&#8217;s unit. Thereupon, it was intimated to the officials of the<\/p>\n<p>Bharat Coking Coal Limited      that   all the documents relating to<\/p>\n<p>petitioner&#8217;s firm which were sought to be produced, have already<\/p>\n<p>been submtted still supply of coal has been stopped. Meanwhile, it<\/p>\n<p>was informed by the officials of the Central Coalfield Limited to the<\/p>\n<p>Bharat Coking Coal Limited that on verification, petitioner&#8217;s unit was<\/p>\n<p>found to be established. Thereupon, Bharat Coking Coal Limited<\/p>\n<p>again resumed supply of coal to the petitioner&#8217;s unit.<\/p>\n<p>         Further case is that other day notice was published in the<\/p>\n<p>newspaper whereby consumers were asked to submit documents<\/p>\n<p>relating to 19 points\/ 13 points in order to ascertain the working<\/p>\n<p>condition     of the units. Pursuant to the said notice, all the<\/p>\n<p>documents relating to petitioner&#8217;s unit were submitted before the<\/p>\n<p>officials of the Bharat Coking Coal Limited.     Thereupon, General<\/p>\n<p>Manager (S &amp; M), Bharat Coking Coal Limited, vide its letter<\/p>\n<p>no.2409 dated 3.8.2007 (Annexure 10)             intimated that the<\/p>\n<p>committee constituted by Bharat Coking Coal Limited has found<\/p>\n<p>certain deficiencies in the documents pertaining to two items and<\/p>\n<p>as such, status of unit has been declared as &#8216;not established&#8217; and<\/p>\n<p>therefore, Bharat Coking Coal Limited would not be allocating coal<\/p>\n<p>to the petitioner&#8217;s unit.\n<\/p>\n<p>         Being aggrieved with that, this writ application has been<\/p>\n<p>field.\n<\/p>\n<p>         Learned counsel appearing for the petitioner submitted that<\/p>\n<p>by merely finding deficiencies in some of the documents, the firm<br \/>\n<span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>      cannot be said to be non-functional or not established and hence,<\/p>\n<p>      action of the respondents can certainly be said to be arbitrary.<\/p>\n<p>               It was further submitted that almost in similar nature of<\/p>\n<p>      case, certain direction has been given to the respondents and,<\/p>\n<p>      therefore, this writ application be disposed of in terms of the<\/p>\n<p>      direction given by this Court in W.P.(C) 5522 of 22006, W.P.(C)<\/p>\n<p>      No.3055 of 2007, W.P.(C) No.1228 of 2008 and several other<\/p>\n<p>      cases.\n<\/p>\n<p>               Mr. Mehta, learned counsel appearing for the Bharat Coking<\/p>\n<p>      Coal Limited though submitted that when certain deficiencies were<\/p>\n<p>      found, supply of coal has been suspended. But agreed to the<\/p>\n<p>      suggestion given by learned counsel appearing for the petitioner<\/p>\n<p>      that the writ application be disposed of in the terms of the cases<\/p>\n<p>      disposed of earlier.\n<\/p>\n<p>               Accordingly, this writ application is disposed of directing the<\/p>\n<p>      respondents to consider the petitioner&#8217;s claim by affording him<\/p>\n<p>      reasonable     opportunity to bring on record all the documents in<\/p>\n<p>      support of his claim which will be considered by the authorities<\/p>\n<p>      along with reply already given on each points by recording findings<\/p>\n<p>      with reason. For that purpose, the respondents shall fix the date<\/p>\n<p>      and communicate the same to the petitioner in writing. In case of<\/p>\n<p>      doubt about the existence of the units, the respondents shall make<\/p>\n<p>      spot verification by fixing a date with prior notice to the petitioner<\/p>\n<p>      and after taking into consideration the entire matter including the<\/p>\n<p>      explanations submitted,          documents filed and the report of<\/p>\n<p>      verification\/inspection, if any, the respondent shall take final<\/p>\n<p>      decision on each points by recording reasons. The entire exercise<\/p>\n<p>      should be completed within a period of three months from the date<\/p>\n<p>      of receipt\/production of a copy of this order.\n<\/p>\n<pre>ND\/                                                (R.
