Sections 114 and 34 of the IPC.\n<\/p>\n<p>Considering<br \/>\n\tthe facts of the case and with consent of both the sides, the matter<br \/>\n\tis taken up for final hearing today.\n<\/p>\n<p>Mr.J.B.Pardiwala,<br \/>\n\tlearned advocate for Mr.Rushabh R.Shah, learned advocate for the<br \/>\n\tpetitioner submitted that the petitioner is an advocate by<br \/>\n\tprofession and perusing the FIR, so also the affidavit of<br \/>\n\tInvestigating Police Officer, which he filed before the trial Court<br \/>\n\tin the bail application of the petitioner, it has been specifically<br \/>\n\tstated that what the present petitioner did was his professional<br \/>\n\twork, and as an advocate, upon the details and documents supplied to<br \/>\n\thim, he acted. It is further submitted that, however, so far as the<br \/>\n\tFIR is concerned, name of the petitioner does not reflect. It is<br \/>\n\tsubmitted that during the course of investigation, the name of the<br \/>\n\tpetitioner came to the surface, only when the statements of<br \/>\n\tco-accused persons, namely, Babubhai and Ajay Patil came to be<br \/>\n\trecorded. However, in this respect, it is submitted that so far as<br \/>\n\tco-accused Ajay Patil is concerned, the Sessions Court granted<br \/>\n\tanticipatory bail to him. Perusing the FIR and the affidavit of the<br \/>\n\tInvestigating Police Officer, it clearly transpires that co-accused<br \/>\n\tpersons, namely, Babubhai and Ajay Patil hatched the conspiracy and<br \/>\n\tcreated documents and they provided details to the<br \/>\n\tpetitioner-advocate and the petitioner- advocate completed the<br \/>\n\tremaining formalities before Sub-Registrar. It is submitted that<br \/>\n\twhen one of the main co-accused persons, namely, Ajay Patil has been<br \/>\n\tgranted anticipatory bail, whom more serious role is attributed by<br \/>\n\tthe prosecution than the role attributed to the petitioner, this<br \/>\n\tapplication may be allowed.\n<\/p>\n<p>\tPer<br \/>\n\tcontra, Mr.R.C.Kodekar, learned APP representing the respondent &#8211;<br \/>\n\tState of Gujarat vehemently opposed this application and stated that<br \/>\n\tconsidering the statements of co-accused persons, namely, Babubhai<br \/>\n\tand Ajay Patil, it is revealed that it was the present petitioner,<br \/>\n\twho advised them to prepare forged documents in the name of one<br \/>\n\tdeceased person and pose somebody else in capacity as deceased<br \/>\n\tperson. It is further submitted that considering Section 120(B) of<br \/>\n\tthe IPC r\/w.Section 10 of the Evidence Act, the statements of<br \/>\n\tco-accused can be read. Therefore, it is submitted that the<br \/>\n\tapplication may be dismissed.\n<\/p>\n<p>Having<br \/>\n\tconsidered the submissions advcanced on behalf of both the sides, so<br \/>\n\talso considering the FIR, wherein the name of the petitioner does<br \/>\n\tnot reflect, and considering the affidavit of the Investigating<br \/>\n\tPolice Officer filed before the trial Court during the pendency of<br \/>\n\tthe bail application of the petitioner before the trial Court, it<br \/>\n\tclearly transpires that co-accused persons, namely, Babubhai and<br \/>\n\tAjay Patil hatched the conspiracy for preparing bogus documents in<br \/>\n\tthe name of one deceased person and it was co-accused Ajay Patil,<br \/>\n\twho purchased the stamp papers and supplied those stamp papers and<br \/>\n\tother details to petitioner &#8211; advocate. It further transpires<br \/>\n\tthat co-accused Ajay Patil has been granted anticipatory bail by the<br \/>\n\ttrial Court. Moreover, considering the nature of the offence, it<br \/>\n\tclearly transpires that more or less, it depends upon the evidence<br \/>\n\tin the form of documents. It further transpires that the offences<br \/>\n\talleged against the petitioner are such, which are triable by the<br \/>\n\tCourt of learned Judicial Magistrate First Class. Thus, considering<br \/>\n\tthe facts and circumstances of the case and in light of the above<br \/>\n\tdiscussions, I am of the opinion that subject to laying down certain<br \/>\n\tconditions, if the anticipatory bail application is granted, it<br \/>\n\twould meet the ends of justice.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tthe present application is allowed. The petitioner is ordered to be<br \/>\n\treleased on bail in the event of his arrest in connection with<br \/>\n\tJalalpor police station, Navsari M.Case No.6 of 2010 in respect of<br \/>\n\tthe offences alleged against him on his executing bond of Rs.5,000\/-<br \/>\n\t(Rupees Five thousand only) with one solvent surety of like amount,<br \/>\n\tby him, by the concerned Police Officer and on conditions that he<br \/>\n\tshall;\n<\/p>\n<p> a)\tremain present before the trial Court regularly as and when directed on the dates fixed;\n<\/p>\n<p>b)\tremain present at the Jalapor police station, Navsari on 1.11.2010 between 9.00 a.m. to 5.00 p.m;\n<\/p>\n<p>c)\tmake himself available for interrogation by Police Officer, whenever and wherever required;\n<\/p>\n<p>d)\tnot directly or indirectly make any inducement, threat or promise to any person acquainted with the fact of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer;\n<\/p>\n<p>e)\tnot to obstruct or hamper the police investigation and not to play mischief with the evidence collected or yet to be collected by the police;\n<\/p>\n<p>f)\tat the time of execution of bond, furnish his address to the Investigating Officer and the Courts concerned, and shall not change his residence till the final disposal of the case or till further orders;\n<\/p>\n<p>g)\tnot leave India without the permission of the Court and if having Passport, shall deposit the same before the trial Court within a week;\n<\/p>\n<p>h)\tIt<br \/>\nshould be open to the Investigating Officer to file an application<br \/>\nfor remand if he considers it proper and just; and the learned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>This<br \/>\n\torder will hold good if the petitioner is arrested at any time<br \/>\n\twithin 90 days from today. The order for release on bail will remain<br \/>\n\toperative only for a period of ten days from the date of her arrest,<br \/>\n\tduring which it will be open to the petitioner to make fresh<br \/>\n\tapplication for being enlarged on bail in usual course which when it<br \/>\n\tcomes before the competent Court, will be disposed of in accordance<br \/>\n\twith law, having regard to all the attending circumstances and the<br \/>\n\tmaterials available at the relevant time, uninfluenced by the fact<br \/>\n\tthat anticipatory bail was granted.\n<\/p>\n<p>Rule<br \/>\n\tis  made absolute.
