Statistical information about the fresh NPA in the branch during the last one year.\n    2. How much amount was treated as bad debts?\n    3. How much amount was recovered?\n    4. Whether position has improved or worsened?\n\nReply of the PIO:\n   1. Around 2 crores.\n   2. Nothing was treated as bad debts.\n   3. Around 32% was recovered.\n   4. The situation has worsened.\n\nGrounds for the First Appeal\nNo information has been provided.\n\nOrder of the First Appellate Authority (FAA):\nInformation not provided since it is being gathered. However the FAA directed the PIO to provide the\ninformation.\n\nGround of the Second Appeal:\nIncomplete and unsatisfactory information.\n\nRelevant Facts<\/pre>\n<p> emerging during Hearing:\n<\/p>\n<p>The following were present<br \/>\nAppellant: Mr. Praful Chait on video conference from NIC-Agra Studio;<br \/>\nRespondent : Absent;\n<\/p>\n<p>        The Appellant has received all the information as admitted by him. He is saying that he has<br \/>\nfiled various RTI applications and has some problems with information received with respect to some<br \/>\nof the other RTI applications. However, in the RTI application being considered in this appeal the<br \/>\ninformation has been provided to the Appellant as admitted by him.<br \/>\n Decision:\n<\/p>\n<p>The Appeal is disposed.\n<\/p>\n<p>      It appears that the information has been provided late.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by the<br \/>\nPIO within 30 days as required by the law.\n<\/p>\n<p>From the facts before the Commission it appears that the PIO is guilty of not furnishing information<br \/>\nwithin the time specified under sub-section (1) of Section 7 by not replying within 30 days, as per the<br \/>\nrequirement of the RTI Act. He has further refused to obey the orders of his superior officer, which<br \/>\nraises a reasonable doubt that the denial of information may also be malafide. The First Appellate<br \/>\nAuthority has clearly ordered the information to be given.\n<\/p>\n<p>It appears that the PIO&#8217;s actions attract the penal provisions of Section 20 (1). A showcause notice is<br \/>\nbeing issued to him, and he is directed give his reasons to the Commission to show cause why penalty<br \/>\nshould not be levied on him.\n<\/p>\n<p>He will give his written submissions showing cause why penalty should not be imposed on him as<br \/>\nmandated under Section 20 (1) before 30 August, 2011.\n<\/p>\n<p>This decision is announced in open chamber.\n<\/p>\n<p>Notice of this decision be given free of cost to the parties.<br \/>\nAny information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.\n<\/p>\n<p>                                                                                                    Shailesh Gandhi<br \/>\n                                                                                          Information Commissioner<br \/>\n                                                                                                     17 August 2011<br \/>\n(In any correspondence on this decision, mention the complete decision number.)
