Another application was moved<br \/>\nby the\ttenant\ton  12.1.1967.\t  That was also dismissed on<br \/>\n13.3.1967 for the same reason.\t Again\tan  application\t was<br \/>\nmade  by  the  tenant  on 15.2.1968 stating therein that the<br \/>\nstatement dated 13.1.1965 was not voluntarily  made  by\t him<br \/>\nand  in any case it was not conclusive as it was not made on<br \/>\noath.  He also alleged that no\tnotice\tregarding  statutory<br \/>\npurchase of  the land was received by him.  This application<br \/>\nwas rejected by\t the  Agricultural  Lands  Tribunal  on\t the<br \/>\nground\tthat  at  that stage evidence could be led only with<br \/>\nrespect to the proceeding under Section 32-P of the Act\t and<br \/>\nno evidence could be led to question the order passed in the<br \/>\n32-G proceedings.  The Tribunal than held that the statutory<br \/>\nsale  in  favour of the tenant having become ineffective the<br \/>\nlandlord was entitled to be put in possession of the land.<br \/>\nThis decision of the Tribunal was upheld  in  appeal<br \/>\nand also in the revision application.\n<\/p>\n<p>As  all the authorities have, after appreciating the<br \/>\nmaterial on record, come to the conclusion that the sale had<br \/>\nbecome\tineffective  and  the  landlord\t was   entitled\t  to<br \/>\npossession  of\tthe  land under Section 32-P of the Act, the<br \/>\nHigh Court was right in dismissing the writ petition.\tThis<br \/>\nappeal is, therefore, dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Pamchandra Hasha Dalvi &#8230; vs D.Patwardhan (Deceased) Through &#8230; on 14 October, 1998 Author: Nanavati.J.
