PUBLIC PROSECUTOR\nfor Appellant(s) : 1, \nMR\nKB ANANDJIWALA for Opponent(s) : 1 -\n6. \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 23\/11\/2010\n \n\nORAL\nJUDGMENT<\/pre>\n<p>The<br \/>\n\tappellant-State of Gujarat, has preferred this Appeal under<br \/>\n\tSection 378 of the Code of Criminal Procedure, 1973 against the<br \/>\n\tjudgment and order of acquittal dated 06th November 1993<br \/>\n\tpassed by the learned Additional Sessions Judge, Kheda camp at<br \/>\n\tAnand, in Special Case No.50 of 1991, whereby the learned Judge was<br \/>\n\tpleased to acquit the respondents-accused from the charges levelled<br \/>\n\tagainst them.\n<\/p>\n<p>The<br \/>\n\tshort facts of the prosecution case is that the complainant is a<br \/>\n\tmember of scheduled caste. The case of the complainant is that to<br \/>\n\tsatisfy the common intention, respondents-accused created unlawful<br \/>\n\tassembly. It is also the case of the complainant that the<br \/>\n\trespondents-accused insulted the complainant, beaten him and<br \/>\n\tthreatened the complainant. It is also the case against the<br \/>\n\trespondents-accused that by creating unlawful assembly, they gave<br \/>\n\tfeast blows to the complainant and also torn the clothes of the<br \/>\n\tcomplainant. The respondents-accused also used abusive language<br \/>\n\tagainst the complainant and called the complainant &#8220;Dheda&#8221;.<br \/>\n\tBecause of this incident, the complainant lodged the complaint with<br \/>\n\tDistrict Police Station, Anand who in turn send the said complaint<br \/>\n\tto Circle Police Inspector, Thasra. Therefore, a complaint against<br \/>\n\tthe respondents-accused was registered punishable under Sections\n<\/p>\n<p>\t14., 147, 149, 323, 504 of the Indian Penal Code and under Section<br \/>\n\t3(1)(10) of the Scheduled Castes and Scheduled Tribe (Prevention of<br \/>\n\tAtrocities)Act with Thasra Police Station being I-C.R. No.203 of<br \/>\n\t1991. Thereafter, as the Circle Police Inspector found the<br \/>\n\trespondents-guilty, charge-sheet was filed against the<br \/>\n\trespondents-accused before the Sessions Judge, Kheda camp at Anand.\n<\/p>\n<p>After<br \/>\n\tfiling closing pursis, statement under Section 313 of the Code of<br \/>\n\tCriminal Procedure, 1973 of the respondents-accused was recorded in<br \/>\n\twhich the respondents-accused have denied the case of the<br \/>\n\tprosecution.\n<\/p>\n<p>Thereafter<br \/>\n\tthe trial was conducted before the learned Additional Sessions<br \/>\n\tJudge. The prosecution has examined the witnesses and also relied<br \/>\n\tupon the documentary evidence. After considering the oral as well as<br \/>\n\tdocumentary evidence, the learned Judge by his judgment and order<br \/>\n\tdated 06th November 1993 acquitted the<br \/>\n\trespondents-accused of the charges levelled against them.\n<\/p>\n<p>Being<br \/>\n\taggrieved and dissatisfied with the said judgment and order of<br \/>\n\tacquittal dated 06th November 1993 passed by the learned<br \/>\n\tAdditional Sessions Judge, Kheda camp at Anand, the appellant-State<br \/>\n\tof Gujarat, has preferred the present Criminal Appeal.\n<\/p>\n<p>I<br \/>\n\thave heard Mr.H.L. Jani, learned Additional Public Prosecutor,<br \/>\n\tappearing on behalf of the appellant-State.  I  have also gone<br \/>\n\tthrough the papers and the judgment and order passed by the Courts<br \/>\n\tbelow.\n<\/p>\n<p>Mr.Jani<br \/>\n\thas taken me through the evidence of prosecution witnesses and the<br \/>\n\tdocumentary evidence and submitted that from the above evidence it<br \/>\n\tis established that the prosecution has successfully proved its case<br \/>\n\tbeyond reasonable doubt. He has contended that the trial Court has<br \/>\n\trightly held the respondents-accused guilty for the offences<br \/>\n\talleged against them. He has contended that witnesses have supported<br \/>\n\tthe case of the prosecution and the learned Sessions Judge has<br \/>\n\tcommitted grave error in disbelieving and discarding the evidence of<br \/>\n\twitnesses. He, therefore, contended that the judgment and order<br \/>\n\tpassed by the learned Additional Sessions Judge, Kheda camp at Anand<br \/>\n\tis without appreciating the facts and evidence on record and is<br \/>\n\trequired to be quashed and set aside.\n<\/p>\n<p>I<br \/>\n\thave gone through the judgment and order passed by the trial Court.<br \/>\n\tI have also perused the reasons assigned by the learned Judge.\n<\/p>\n<p>At<br \/>\n\tthe outset it is required to be noted that the principles which<br \/>\n\twould govern and regulate the hearing of appeal by this Court<br \/>\n\tagainst an order of acquittal passed by the trial Court have been<br \/>\n\tvery succinctly explained by the Apex Court in a catena of<br \/>\n\tdecisions. In the case of<br \/>\n\tM.S. Narayana Menon @ Mani Vs. State of Kerala &amp; Anr, reported<br \/>\n\tin (2006)6 SCC, 39,<br \/>\n\tthe Apex Court has narrated about the powers of the High Court in<br \/>\n\tappeal against the order of acquittal.\n<\/p>\n<p>It<br \/>\n\tis a settled principle that while exercising appellate power, even<br \/>\n\tif two reasonable conclusions are possible on the basis of the<br \/>\n\tevidence on record, the appellate court should not disturb the<br \/>\n\tfinding of acquittal recorded by the court below.\n<\/p>\n<p>Even<br \/>\n\tin a recent decision of the Apex Court in the case of State<br \/>\n\tof Goa V. Sanjay Thakran &amp; Anr. Reported in (2007)3 SCC 75,<br \/>\n\tthe  Court has reiterated the powers of the High Court in such<br \/>\n\tcases.\n<\/p>\n<p>Similar<br \/>\n\tprinciple has been laid down by the Apex  Court in the cases of<br \/>\n\tState of<br \/>\n\tUttar Pradesh Vs. Ram Veer Singh &amp; Ors, reported in 2007 AIR SCW<br \/>\n\t5553 and<br \/>\n\tin Girja<br \/>\n\tPrasad (Dead) by LRs Vs. state of MP, reported in 2007 AIR SCW 5589.<br \/>\n\tThus, the powers which this Court may<br \/>\n\texercise against an order of acquittal are well settled.\n<\/p>\n<p>It<br \/>\n\tis also a settled legal position that in acquittal appeal, the<br \/>\n\tappellate court is not required to re-write the judgment or to give<br \/>\n\tfresh reasoning, when the reasons assigned by the Court below are<br \/>\n\tfound to be just and proper. Such principle is laid down by the Apex<br \/>\n\tCourt in the  case of State<br \/>\n\tof Karnataka Vs. Hemareddy, reported in AIR 1981 SC 1417.\n<\/p>\n<p>Thus,<br \/>\n\tin case the appellate court agrees with the reasons and the opinion<br \/>\n\tgiven by the lower court, then the detailed discussion of evidence<br \/>\n\tis not necessary.\n<\/p>\n<p>I<br \/>\n\thave gone through the judgment and order passed by the trial court .<br \/>\n\tI have also perused the oral as well as documentary evidence led<br \/>\n\tbefore the trial Court and also considered the submissions made by<br \/>\n\tlearned Additional Public Prosecutor.\n<\/p>\n<p>The<br \/>\n\tSessions Court after appreciating the oral as well as documentary<br \/>\n\tevidence, has found that there are contradiction between N.C.<br \/>\n\tComplaint filed with Thasra Police Station at Exhibit 35 and the<br \/>\n\tcomplaint filed with the office of D.S.P. at Exhibit 28. Even<br \/>\n\twitnesses are interested witnesses. It is also observed by the<br \/>\n\tlearned Judge that independent witnesses are not examined by the<br \/>\n\tprosecution. Even Prosecution Witness Nos.3 and 4 are declared<br \/>\n\thostile. It is also observed that medical witness has explained that<br \/>\n\tinjuries are simple in nature. Thus, the prosecution has failed to<br \/>\n\testablish prima-facie case against the respondents-accused.\n<\/p>\n<p>Thus,<br \/>\n\tthe appellant could not bring home the charge against the<br \/>\n\trespondents-accused in the present Appeal. The prosecution has<br \/>\n\tmiserably failed to prove the case against the respondents-accused.<br \/>\n\t Thus, from the evidence itself it is established that the<br \/>\n\tprosecution has not proved its case beyond reasonable doubt.\n<\/p>\n<p>Mr.H.L.\n<\/p>\n<p>\tJani, learned learned Additional Public Prosecutor for the<br \/>\n\tappellant, is not in a position to show any evidence to take a<br \/>\n\tcontrary view in the matter or that the approach of the Sessions<br \/>\n\tCourt is vitiated by some manifest illegality or that the decision<br \/>\n\tis perverse or that the learned Judge has ignored the material<br \/>\n\tevidence on record.\n<\/p>\n<p>In<br \/>\n\tabove view of the matter, I am of the considered opinion that the<br \/>\n\tSessions Court was completely justified in acquitting the<br \/>\n\trespondents- accused of the charges leveled against them. I<br \/>\n\tfind that the findings recorded by the Sessions Court are absolutely<br \/>\n\tjust and proper and in recording the said findings, no illegality or<br \/>\n\tinfirmity has been committed by it.\n<\/p>\n<p>I<br \/>\n\tam, therefore, in complete agreement with the findings, ultimate<br \/>\n\tconclusion and the resultant order of acquittal recorded by the<br \/>\n\tSessions Court and hence find no reasons to interfere with the same.<br \/>\n\tHence the appeal is hereby dismissed.\n<\/p>\n<p>In<br \/>\n\tview of above, present Appeal is dismissed. TThe<br \/>\n\tJudgment and Order of acquittal dated 06th<br \/>\n\tNovember 1993 passed by the learned Additional Sessions Judge, Kheda<br \/>\n\tcamp at Anand, in Special Case No.50 of 1991 is hereby confirmed.<br \/>\n\tRecord and Proceedings, if any, be sent back to the trial Court<br \/>\n\tconcerned forthwith.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
