Justice K.HEMA\n\n Dated :06\/11\/2008\n\n O R D E R\n                             K.HEMA, J.\n                  ---------------------------------------------\n                         B.A.No.6667 of 2008\n                  ---------------------------------------------\n                 Dated this the 6th November, 2008\n\n\n\n                                O R D E R\n<\/pre>\n<p>      This petition is for anticipatory bail.\n<\/p>\n<p>      2.   According to prosecution, petitioner (A6) and other<\/p>\n<p>accused conspired to cheat defacto complainant, and in<\/p>\n<p>furtherance of common intention, A1 procured sale deed of the<\/p>\n<p>property belonging to defacto complainant under the pretext of<\/p>\n<p>raising some money for defacto complainant who was in need of<\/p>\n<p>money, but, instead of getting a mortgage deed executed, made<\/p>\n<p>the defacto complainant to execute sale deed in respect of the<\/p>\n<p>same property in favour of              second and third accused and<\/p>\n<p>thereafter, a loan was raised pledging the property and the<\/p>\n<p>accused obtained Rs.1 lakh. On coming to know of commission<\/p>\n<p>of offence, defacto complainant lodged a complaint before the<\/p>\n<p>police. Since, no action was taken by police, a private complaint<\/p>\n<p>was filed before the Magistrate court which was forwarded<\/p>\n<p>under Section 156(3) Crl.P.C. and a crime was registered.<\/p>\n<p>      3.   Learned counsel for petitioner submitted that as per<\/p>\n<p><span class=\"hidden_text\">BA No.6667\/2008                   2<\/span><\/p>\n<p>the allegations in the complaint, the role of sixth accused is very<\/p>\n<p>limited. He only introduced first accused to defacto complainant.<\/p>\n<p>There is no allegation that he conspired to commit any offence.<\/p>\n<p>There is nothing in the complaint to show that petitioner, who<\/p>\n<p>is the sixth accused, shared any common intention with other<\/p>\n<p>accused to commit offence, it is submitted. The role of petitioner<\/p>\n<p>is totally different from other accused and even the defacto<\/p>\n<p>complainant has not implicated petitioner as an accused and the<\/p>\n<p>complaint was filed only against A1 to A4. Because of political<\/p>\n<p>reasons, petitioner has been dragged into this case and included<\/p>\n<p>in the array of accused, it is submitted.\n<\/p>\n<p>     4.    Learned public prosecutor submitted that petitioner<\/p>\n<p>may be directed to surrender before the Investigating Officer<\/p>\n<p>and co-operate with the investigation. Subject to that, he has no<\/p>\n<p>objection in granting anticipatory bail, it is submitted.<\/p>\n<p>     On hearing both sides, I am satisfied that anticipatory bail<\/p>\n<p>can be granted to the petitioner and hence, the following order is<\/p>\n<p>passed:\n<\/p>\n<blockquote><p>     (1)   Petitioner shall surrender before the Investigating<\/p>\n<p>           Officer within seven days from today and co-operate<\/p>\n<p><span class=\"hidden_text\">BA No.6667\/2008                  3<\/span><\/p>\n<p>           with the investigation.\n<\/p><\/blockquote>\n<blockquote><p>    (2)    In the event of his arrest, petitioner shall be released<\/p>\n<p>           on bail on his executing bond for Rs.25,000\/- with two<\/p>\n<p>           solvent sureties each for like sum to the satisfaction of<\/p>\n<p>           the arresting officer on the following conditions:<\/p>\n<\/blockquote>\n<blockquote><p>                (i)  Petitioner    shall    report    before    the<\/p>\n<p>                     Investigating Officer as and when directed.<\/p>\n<\/blockquote>\n<blockquote><p>                (ii) Petitioner   shall    co-operate   with    the<\/p>\n<p>                     investigation.\n<\/p><\/blockquote>\n<blockquote><p>                (ii) Petitioner shall not tamper with evidence,<\/p>\n<p>                     influence or intimidate any witness or<\/p>\n<p>                     commit any offence while on bail.\n<\/p><\/blockquote>\n<blockquote><p>\n    The petition is allowed.<\/p><\/blockquote>\n<p>                                                K.HEMA, JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Harikrishnan T vs The State Of Kerala on 6 November, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 6667 of 2008() 1.
