BASANT, J.\n\n              -------------------------------------------------\n\n                        B.A. No. 1005 of   2008\n\n              -------------------------------------------------\n\n          Dated this the  26th  day of  February, 2008\n\n\n                                 ORDER\n<\/pre>\n<p>      Application   for   anticipatory   bail.     The   petitioners   are<\/p>\n<p>accused 1 to 4.   The crux of the allegations is that the accused<\/p>\n<p>persons   in   furtherance   of   their   common   intention,   unleashed<\/p>\n<p>an   attack   on   the   de   facto   complainant.       Dangerous   weapons<\/p>\n<p>were   used.     Serious   injuries   were   inflicted   on   the   de   facto<\/p>\n<p>complainant.   Prior   animosity   is   the   alleged   motive.<\/p>\n<p>Investigation is in progress.   The crime was initially registered<\/p>\n<p>only under Secs.324 and 323 read with Sec.34 of the IPC.   All<\/p>\n<p>the four petitioners are named in the F.I.R.     In the course of<\/p>\n<p>investigation,   allegation   under   Sec.308   of   the   IPC   has   been<\/p>\n<p>included.     Investigation   is   in   progress.       The   petitioners<\/p>\n<p>apprehend imminent arrest.\n<\/p>\n<\/p>\n<p>      2.     The learned counsel for the petitioners submits that<\/p>\n<p><span class=\"hidden_text\">  B.A. No. 1005 of   2008                -: 2 :-<\/span><\/p>\n<p>the   petitioners   are   absolutely   innocent.       The   allegations   are<\/p>\n<p>untrue.       At   any   rate,   the   inclusion   of   the   allegation   under<\/p>\n<p>Sec.308 of the IPC is totally unjustified.   That section of offence<\/p>\n<p>has   been   included   solely   for   the   purpose   of   vexation   and   to<\/p>\n<p>ensure   that   the   petitioner   continues   in   custody   for   as   along     a<\/p>\n<p>period as possible.\n<\/p>\n<\/p>\n<p>       3.   The learned Public Prosecutor opposes the application.<\/p>\n<p>The learned Public Prosecutor submits that there are very valid<\/p>\n<p>reasons for the inclusion of the allegation under Sec.308 of the<\/p>\n<p>IPC.     The learned Public Prosecutor, in particular, requests the<\/p>\n<p>court   to   peruse   the   wound   certificate   issued   after   the<\/p>\n<p>examination of the injured.   He also prays that the statement of<\/p>\n<p>the Doctor, who issued the said certificate, may also be perused.<\/p>\n<p>       4.     I   have   perused   the   same.       I   have   perused   the   First<\/p>\n<p>Information Statement also.  I have considered the nature of  the<\/p>\n<p>weapons   used   as   also   the   nature   of   the   injuries   which   are<\/p>\n<p>described in the wound certificate dated 29\/1\/08.     At this early<\/p>\n<p>stage   of   the   investigation,   I   shall   not   embark   on   any   detailed<\/p>\n<p>discussions   on   merits   about   the   acceptability   of   the   allegations<\/p>\n<p>under Sec.308 of the IPC or the credibility of the data collected<\/p>\n<p>in   support   of   such   allegations.       Suffice   it   to   say   that     I   have<\/p>\n<p>carefully perused all the relevant inputs, particularly the nature<\/p>\n<p><span class=\"hidden_text\">  B.A. No. 1005 of   2008              -: 3 :-<\/span><\/p>\n<p>of the injuries described   in the wound certificate.     I need only<\/p>\n<p>mention   that   I   have   considered   all   the   relevant   inputs.     I   am<\/p>\n<p>unable   to   agree   that   the   inclusion   of   the   allegation   under<\/p>\n<p>Sec.308   of   the   IPC   is   not   justified   or   that   the   same   has   been<\/p>\n<p>done   with   vexatious   and   mala   fide   intent.       I   have   been<\/p>\n<p>particularly taken through the 5 injuries described in the wound<\/p>\n<p>certificate.\n<\/p>\n<\/p>\n<p>        5.   This,  I am satisfied, is  an eminently  fit case where  the<\/p>\n<p>petitioners   must   resort   to   the   ordinary   and   normal   course   of<\/p>\n<p>appearing   before   the  Investigating   Officer  or   the   learned<\/p>\n<p>Magistrate having jurisdiction and then seek regular bail in the<\/p>\n<p>normal and usual course.\n<\/p>\n<\/p>\n<p>        6.   In the result, this bail application is dismissed; but with<\/p>\n<p>the   observation   that   if   the   petitioners   surrender   before   the<\/p>\n<p>Investigating  Officer  or the  learned  Magistrate  and  seek  bail,<\/p>\n<p>after giving sufficient prior notice to the Prosecutor in charge of<\/p>\n<p>the   case,   the   learned   Magistrate   must   proceed   to   pass<\/p>\n<p>appropriate orders on merits and expeditiously.<\/p>\n<p>                                                                     Sd\/-<\/p>\n<pre>\n\n                                                       (R.
