Subhashini,<br \/>\nL.R.Singh, Pramod Kumar and Ms. Vimla Sinha, Advs. with them<br \/>\nfor the appearing parties.\n<\/p>\n<p>\t\t\t O R D E R<br \/>\nThe following Order of the Court was delivered.<br \/>\nSudip Mazumdar<br \/>\nV.\n<\/p>\n<p>State of Madhya Pradesh<br \/>\n\t\t\t O R D E R<br \/>\n     Application for intervention is allowed.<br \/>\n     The departed  soul of  Shri Govind\t Mukhoty would\tfeel<br \/>\nsatisfied for  the result as he had done yeomen&#8217;s service to<br \/>\nprotect the  precious lives of the tribals who used to go to<br \/>\ncollect firewood  etc. but  became victims of firing in\t the<br \/>\nrange. He  devoted his\tlife and  was an  ardent champion of<br \/>\nhuman rights  of underprivileged  and one of the cases which<br \/>\nhe had\tleft over  unfinished, is this case which we are now<br \/>\ndisposing or  partly. In  this case,  or,  account  of\ttest<br \/>\nfiring practices  being organised  at a\t test  firing  range<br \/>\nnear Itarasi  in Madhya Pradesh, several of the tribals\t are<br \/>\nbecoming victims  of the  firing and some of them succumb to<br \/>\nthe injuries  and several  sustain grievous  injuries.\tThat<br \/>\nresulted in  filing this writ petition. This Court, by order<br \/>\ndated March  13, 1994  by a Constitution Bench, had accepted<br \/>\nthe recommendations  made by  High-level  Committee  of\t the<br \/>\nGovernment constituted\tpursuant to  an order passed by this<br \/>\nCourt. The  recommendations, as\t accepted by this Court, are<br \/>\nas under:\n<\/p>\n<blockquote><p>\t  &#8220;(i) The  substitute plans  of<br \/>\n     erecting barbed wire fencing around<br \/>\n     the four  target  areas  have  been<br \/>\n     worked out\t and is\t as  per  sketch<br \/>\n     P.,Q. and Q1.\n<\/p><\/blockquote>\n<blockquote><p>\t  (ii)\tDSC  personnel\twill  be<br \/>\n     deplayed to patrol the target areas<br \/>\n     to prevent\t unauthorised  entry  by<br \/>\n     metal pickets  into the target area<br \/>\n     and to protect the barbed wire.\n<\/p><\/blockquote>\n<blockquote><p>\t  (iii)\t Watch\ttowers\twill  be<br \/>\n     constructed around\t the fencing  to<br \/>\n     provide\teffective    field    of<br \/>\n     observations to  the DSC  guards to<br \/>\n     carry out duties at (b) above.\n<\/p><\/blockquote>\n<blockquote><p>\t  (iv)\tApproach  roads\t to  the<br \/>\n     target areas  will\t be  constructed<br \/>\n     for easy access.\n<\/p><\/blockquote>\n<blockquote><p>\t  (v) Additional  transport will<br \/>\n     be provided  to CPE Itarsi to ferry<br \/>\n     DSC troops\t to and fro target areas<br \/>\n     and  to   convey  food   and  other<br \/>\n     essential\trequirements   to   them<br \/>\n     while on duty.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>     This Court\t gave the  direction  as<br \/>\n     under:\n<\/p><\/blockquote>\n<blockquote><p>     &#8220;We direct the Government to accord<br \/>\n     sanction in terms of its own prayer<br \/>\n     in\t Criminal   Misc.  Petition  No.<br \/>\n     1360\/94 immediately  so as to allow<br \/>\n     the tender\t process to be completed<br \/>\n     and the  work to  commence within 3<br \/>\n     months  from   today.  The\t  actual<br \/>\n     physical execution\t of the work for<br \/>\n     which 24  months&#8217; time is indicated<br \/>\n     in the  aforesaid\tNote,  shall  be<br \/>\n     reduced  to   and\tcompleted  in  a<br \/>\n     period of 18 months.&#8221;<\/p><\/blockquote>\n<p>     For compliance  thereof, the  matter was adjourned from<br \/>\ntime to time and ultimately time was extended by order dated<br \/>\nJanuary 12, 1996 to submit full compliance report. Today, an<br \/>\naffidavit has  been filed by Brigadier Kuppuswami Ramani who<br \/>\nis in-charge of Central Proof Establishment, Itarasi. As per<br \/>\nthe report, full compliance of the directions issued by this<br \/>\nCourt has  been made.
