Shri Upendra Nath Mishra<br \/>\nappears for all the respondents.\n<\/p>\n<p> The petitioner is aggrieved by a decision of the Executive<br \/>\nCouncil, Lucknow University, Lucknow dated 4.11.2009<br \/>\ncommunicated to him by the Registrar of the University on<br \/>\n9.11.2009, deciding to end the suspension of the petitioner with<br \/>\nimmediate effect and to reinstate him in service with the condition<br \/>\nthat he will not be entitled to any amount other than the suspension<br \/>\nallowance during the period when he was under suspension.\n<\/p>\n<p>The petitioner has an alternative remedy of making representation<br \/>\nto the Chancellor under Section 68 of the U.P. State Universities<br \/>\nAct, 1973.\n<\/p>\n<p>Shri Raghvendra Singh submits that the initiation of the<br \/>\nproceedings by the Vice Chancellor was void abinitio. He had no<br \/>\npowers to initiate the proceedings and to suspend the petitioner.<br \/>\nThe ratification of the decision of the Vice Chancellor dated<br \/>\n7.12.2008 in the meeting of the Executive Council dated 14.2.2008<br \/>\nfor conducting enquiry against the petitioner was wholly illegal<br \/>\nand could not have cured the defect. He has relied upon judgments<br \/>\nin <a href=\"\/doc\/74936\/\">Dr. (Smt.) Kuntesh Gupta vs. Management of Hindu Kanya<br \/>\nMahavidyalaya, Sitapur and others<\/a>, (1987) 4 SCC 525; the<br \/>\njudgment in <a href=\"\/doc\/840793\/\">Marathwada University vs. Seshrao Balwant Rao<br \/>\nChavan AIR<\/a> 1989 SC 1582 and <a href=\"\/doc\/1593674\/\">Committee of Management vs.<br \/>\nVice Chancellor<\/a> 2009 AIR SCW 398 in submitting that the Vice<br \/>\nChancellor, did not have jurisdiction to suspend the petitioner and<br \/>\nto initiate the departmental enquiry.\n<\/p>\n<p>The petitioner had earlier filed a Writ Petition No. 353 (S\/B) of<br \/>\n2008 in which he had taken the same grounds. The Court,<br \/>\nhowever, found that since the enquiry has been concluded and that<br \/>\nthe disciplinary authority has to take a final decision, the matter<br \/>\n may be considered by the disciplinary authority. The Court made it<br \/>\nclear that it has not entered into merits of the case and left it open<br \/>\nbefore the appropriate forum.\n<\/p>\n<p>In Dr. (Smt.) Kuntesh Gupta (supra) the Apex Court considered<br \/>\nan order, by which the Vice Chancellor had reviewed the decision<br \/>\nand that in the Marathwada University (supra) the question<br \/>\ninvolved was whether the Vice Chancellor could have approved<br \/>\nthe order of removal. The Apex Court held that the Vice<br \/>\nChancellor did not have such powers and that the rectification of<br \/>\nthe decision, which was void abinitio, was not valid. In<br \/>\nCommittee of Management (supra) the Supreme Court held that<br \/>\nChancellor was not supposed to decide intricate question of law<br \/>\ninvolving interpretation of a statute.\n<\/p>\n<p>In the present case, the Vice Chancellor has exercised the powers<br \/>\nof initiating disciplinary enquiry and suspending the petitioner on<br \/>\n7.12.2008 as emergency measure for the reasons that the petitioner<br \/>\nwas involved in a criminal case in which a charge sheet was<br \/>\nsubmitted; he was not doing teaching work and had disobeyed the<br \/>\norders of the Head of the Department.\n<\/p>\n<p>Shri Raghvendra Singh submits that if the Vice Chancellor was<br \/>\nrequired to take any action in his emergency powers in deviation<br \/>\nof the Rules and Regulations of the University, the permission of<br \/>\nthe Chancellor is required. The submission, that the action was in<br \/>\ndeviation of the Rules of the University, is doubtful.
