Justice R.BASANT\n\n Dated :12\/12\/2007\n\n O R D E R\n                               R.BASANT, J\n                       ------------------------------------\n                      Crl.M.C.No.3717 of 2007\n                       -------------------------------------\n             Dated this the 12th day of December, 2007\n\n                                 O R D E R\n<\/pre>\n<p>      Petitioner faces indictment in a prosecution under Section<\/p>\n<p>138 of the Negotiable Instruments Act.                      The petitioner had<\/p>\n<p>entered appearance before the learned Magistrate. He had taken<\/p>\n<p>part in the proceedings. The matter stood posted to 17.09.07 for<\/p>\n<p>final hearing. On that day, the petitioner, a native of Kottayam,<\/p>\n<p>could not proceed to the court at Hosdurg to appear in person.<\/p>\n<p>He allegedly had informed his counsel about his inability to<\/p>\n<p>appear. The grievance of the petitioner now is that his counsel<\/p>\n<p>reported no instructions on that day and consequently a warrant<\/p>\n<p>of arrest has been issued against the petitioner. The petitioner<\/p>\n<p>finds such warrant of arrest chasing him. The bail bond has also<\/p>\n<p>been cancelled, it is submitted.\n<\/p>\n<p>      2.    According to the petitioner, he is absolutely innocent.<\/p>\n<p>He had not shown any disrespect to the proceedings of the court.<\/p>\n<p>He had instructed his counsel and the report of no instructions by<\/p>\n<p>the counsel was an unexpected one. The petitioner is willing to<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3717 of 2007          2<\/span><\/p>\n<p>surrender before the learned Magistrate and seek regular bail.<\/p>\n<p>But he apprehends that his application for regular bail may not be<\/p>\n<p>considered by the learned Magistrate on merits, in accordance<\/p>\n<p>with law and expeditiously. It is therefore prayed that directions<\/p>\n<p>under Section 482 Cr.P.C may be issued in favour of the<\/p>\n<p>petitioner.\n<\/p>\n<p>      3.   It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate   and    explain   to  the    learned   Magistrate   the<\/p>\n<p>circumstances under which he could not earlier appear before the<\/p>\n<p>learned Magistrate. I have no reason to assume that the learned<\/p>\n<p>Magistrate would not consider such application on merits, in<\/p>\n<p>accordance with law and expeditiously. Every court must do the<\/p>\n<p>same. No special or specific direction appears to be necessary.<\/p>\n<p>Sufficient general directions have already been issued in <a href=\"\/doc\/147290035\/\">Alice<\/p>\n<p>George v. The Deputy Superintendent of Police<\/a> [2003(1)<\/p>\n<p>KLT 339].\n<\/p>\n<p>      4.   This Crl.M.C is, in these circumstances, dismissed, but<\/p>\n<p>with the specific observation that if the petitioner appears before<\/p>\n<p>the learned Magistrate and applies for bail after giving sufficient<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3717 of 2007          3<\/span><\/p>\n<p>prior notice to the Prosecutor in charge of the case, the learned<\/p>\n<p>Magistrate must proceed to pass appropriate orders on merits<\/p>\n<p>and expeditiously &#8211; on the date of surrender itself.<\/p>\n<p>      5.   In the peculiar facts and circumstances of this case,<\/p>\n<p>considering the submissions of the learned counsel for the<\/p>\n<p>petitioner, I direct that the warrant of arrest issued against the<\/p>\n<p>petitioner shall not be executed till 22.12.2007.
