On<br \/>\n\t21\/1\/1985 Manabhai Shanabhai was working as per instruction of<br \/>\n\topponent no.1 and 2 and at about 4:30 p.m. he was erecting one pole<br \/>\n\tand at that time Manabhai Shanabhai had received electric shock due<br \/>\n\tto coming into contact of one electric wire and as a result of which<br \/>\n\the has died.  Death has occurred during the course of employment and<br \/>\n\ttherefore, employer is liable to pay compensation.\n<\/p>\n<p>Heard<br \/>\n\tthe learned advocates for the respective parties.\n<\/p>\n<p>On<br \/>\n\tthe point of quantum of compensation, the Workmen Compensation<br \/>\n\tAuthority has arrived at proper conclusion.  The learned counsel for<br \/>\n\tthe appellant was not in a position to dispute the same.\n<\/p>\n<p>Other<br \/>\n\tside has filed Cross Objection since insurance company was not held<br \/>\n\tliable for penalty in view of the decision of Hon&#8217;ble Supreme Court<br \/>\n\tof India in the case of New India Assurance Co. Ltd. vs.<br \/>\n\tHarshadbhai Amrutbhai Modhiya and another, reported in 2006 ACJ<br \/>\n\t1699.  Therefore, it is contended that for penalty and interest,<br \/>\n\tit is duty and liability of employer to pay said amount.\n<\/p>\n<p>As<br \/>\n\tregards first contention regarding penalty, in my view, discussion<br \/>\n\tmade by the Workmen Compensation Authority is just and proper.<br \/>\n\tNothing is pointed out to exercise the discretionary powers by this<br \/>\n\tCourt.  However, regarding interest, the contention raised by the<br \/>\n\tappellant is just and proper.  They are entitled to get interest<br \/>\n\tfrom the date of application till the amount is paid.  Cross<br \/>\n\tObjection of the insurance company is required to be accepted in<br \/>\n\tview of the decision of the Hon&#8217;ble Apex Court in case of New India<br \/>\n\tAssurance Co. Ltd. (supra).\n<\/p>\n<p>In<br \/>\n\tview of the above, it is held that the appellant is entitled to<br \/>\n\tinterest at the rate of 6% from the date of application till<br \/>\n\trealisation from employer.  The Cross Objection of the insurance<br \/>\n\tcompany is allowed.  If the amount of interest which was deposited<br \/>\n\tby the insurance company will be refunded to the Insurance Company<br \/>\n\tand if the same is withdrawn by the claimant, it will be open for<br \/>\n\tinsurance company to recover from employer insured.\n<\/p>\n<p>First<br \/>\n\tAppeal stands disposed of accordingly.
