    Plaintiff in O.S.55\/1997 on the file of Sub<\/p>\n
Court, Manjeri is the petitioner.  Defendant is the<\/p>\n
respondent. A preliminary decree for partition was<\/p>\n
passed.  I.A.857\/2004 an application for passing a<\/p>\n
final  decree  was  filed.    A   Commissioner  was<\/p>\n
appointed to divide the property in accordance with<\/p>\n
the preliminary decree.     Commissioner submitted<\/p>\n
report  and  plan  identifying  the  property   and<\/p>\n
dividing the same.  Respondent filed I.A.1382\/2006<\/p>\n
an application to set aside the report and plan<\/p>\n
submitted by the Commissioner.  Under Ext.P3 order,<\/p>\n
learned Sub Judge allowed the application and set<\/p>\n
aside the report and plan and directed   respondent<\/p>\n
to deposit Rs.3000\/- as batta for appointment of<\/p>\n
another Commissioner to execute the work with the<\/p>\n
assistance of Taluk Surveyor.    This petition is<\/p>\n
filed under Article 227 of the Constitution of<\/p>\n
W.P.(C)6616\/2008             2<\/span><\/p>\n
India challenging Ext.P3 order.<\/p>\n
     2.        Learned  senior counsel  appearing   for<\/p>\n
petitioner       and  learned  counsel  appearing  for<\/p>\n
respondent were heard.\n<\/p>\n
     3.     Under Ext.P3 order learned Sub Judge found<\/p>\n
that the Commissioner has not identified the decree<\/p>\n
schedule        property  in   accordance   with    the<\/p>\n
descriptions in the decree and therefore found that<\/p>\n
the report and plan cannot be relied on and set<\/p>\n
aside the same.      The argument of the learned senior<\/p>\n
counsel is that the Commissioner can identify the<\/p>\n
property on the basis of the decree and even if<\/p>\n
there is discrepancy in the boundary, for that<\/p>\n
reason, it cannot be said that the property is not<\/p>\n
identified.      The decree shows that eight items were<\/p>\n
available for partition which are to be divided<\/p>\n
between      the   petitioner  and  respondent.     The<\/p>\n
Commissioner has to identify the property covered<\/p>\n
under the decree and thereafter divide the property<\/p>\n
as directed in the preliminary decree. The report<\/p>\n
and plan prepared by the Commissioner show that the<\/p>\n

properties were not properly identified.    It is in<\/p>\n
such circumstances, they were set aside and a new<\/p>\n
Commissioner was appointed.     If Commissioner finds<\/p>\n
any difficulty      for proper identification of the<\/p>\n
properties,      Commissioner  can   seek   necessary<\/p>\n
directions from the court.     Commissioner has first<\/p>\n
to identify the eight items of plaint schedule<\/p>\n
properties and thereafter divide the property in<\/p>\n
accordance      with the  preliminary decree.     The<\/p>\n
parties are entitled to file objection when the<\/p>\n
Commissioner     submits  the report  and  plan    in<\/p>\n
pursuant to Ext.P3 order.\n<\/p>\n
     Writ Petition is disposed of as above.<\/p>\n
