Application for restoration<br \/>\nof Special Criminal Application No.467 of 2009.\n<\/p>\n<p>\tCr.\n<\/p>\n<p>Misc. Appln. was preferred since office objections raised by the<br \/>\nOffice in  Special Criminal Application No.467 of 2009 were not<br \/>\nremoved within prescribed time limit.\n<\/p>\n<p>\tHeard<br \/>\nlearned advocates for the parties and perused record of Special<br \/>\nCriminal Application No.467 of 2009 filed under Articles 226\/227 of<br \/>\nthe Constitution of India, where a prayer is made to issue direction<br \/>\nto give passport to the petitioner for the purpose of foreign visit.\n<\/p>\n<p>\tAdmittedly,<br \/>\ncriminal complaint under Section 138 of the Negotiable Instruments<br \/>\nAct was filed against the applicant and same is pending before<br \/>\nlearned JMFC, Ganderi and without approaching the concerned<br \/>\nMagistrate, the applicant has straightaway filed the petition under<br \/>\nArticles 226\/227 of the Constitution of India.\n<\/p>\n<p>\tNo<br \/>\ncase is made out to exercise powers under Article 226\/227 of the<br \/>\nConstitution of India in favour of the applicant since proceedings<br \/>\npertaining to Section 138 of the Negotiable Instruments Act are<br \/>\npending before the JMFC, Ganderi.\n<\/p>\n<p>\tAccordingly,<br \/>\nCriminal Misc. Application No.13668 of 2009 is dismissed.<br \/>\nConsequently, Criminal Misc.
