No.1 of 2007\n\n\n\n\nM.P.Marimuthu                           \t\t    ..Petitioner\n\n\n\t    Vs\n\n\n1.\tThe Inspector General of Registration\n  \tSanthome High Road\n  \tSanthome\n  \tChennai 600 004.\n\n2.\tThe Sub Registrar\n  \tKangeyam\n  \tKangeyam Taluk\n  \tErode District.\n\n3.\tThe Assistant Commissioner\n  \tHR &amp; CE Department\n  \tKangeyam\n  \tKangeyam Taluk\n  \tErode District.\n\n4.\tThe Executive Officer\n  \tArulmighu Prasanna Venkataraman Swamy Thirukovil\n  \tKangeyam\n  \tKangeyam Taluk\n  \tErode District.                       \t\t    ..Respondents\n\n\n\n\n       Writ   petition  filed  under  Article  226  of   the\n\nConstitution  of India praying for a writ of  certiorarified\n\nmandamus  to  call  for the records of  the  2nd  respondent\n\nculminating in and by his proceedings M.A.No.431\/2007  dated\n\n22.8.2007  and  quash the same and consequently  direct  the\n\nrespondents 1 to 2 to register the sale deed dated 22.8.2007\n\nand   release  the  same  after  due  registration  to   the\n\npetitioner.\n\n\n\n\n\n          For Petitioner      :  Mr.M.M.Sundaresh\n\n          For Respondents     :  Mr.L.S.M.Hasan Fizal\n                                 for RR1 and 2\n\n                                 Mr.T.Chandrasekaran\n                                 Special Government Pleader\n                                 for R3\n\n                                 Mr.B.Easwaran for\n                                 M\/s.Swaraj Associates\n                                 for R4\n                              \n\n\n                            ORDER\n<\/pre>\n<p>      Seeking a writ of certiorarified mandamus to quash the<\/p>\n<p>proceedings  of  the  second respondent  in  M.A.No.431\/2007<\/p>\n<p>dated  22.8.2007, and consequently direct the respondents  1<\/p>\n<p>to  2 to register the sale deed dated 22.8.2007, and release<\/p>\n<p>the  same  after  due registration, to the petitioner,  this<\/p>\n<p>writ petition has been brought forth.\n<\/p>\n<\/p>\n<p>      2.The affidavit in support of the petition is perused.<\/p>\n<p>The Court heard all the learned Counsel on either side.<\/p>\n<p>      3.The case of the petitioner who seeks the relief,  in<\/p>\n<p>short is that by the proceedings of the Tahsildar, Kangeyam,<\/p>\n<p>dated 27.1.1992, patta has been issued to 27 persons for the<\/p>\n<p>lands  situated in Old Survey No.144\/B corresponding to  New<\/p>\n<p>Survey No.340\/3 and 346\/2 situated in Kangeyam Village; that<\/p>\n<p>the said lands were purchased by one Karuppasamy and others;<\/p>\n<p>that the petitioner has paid the consideration for a portion<\/p>\n<p>of  the said lands to two of its owners who have executed  a<\/p>\n<p>sale deed in his favour on 22.8.2007; that the said document<\/p>\n<p>was placed for registration on the very day; that the second<\/p>\n<p>respondent  without registering the document,  has  returned<\/p>\n<p>the  same  by  stating that as per the instructions  of  the<\/p>\n<p>first  respondent,  registration could be  done  only  after<\/p>\n<p>waiting  for 45 days and thereby, has given time to  H.R.  &amp;<\/p>\n<p>C.E. Department to produce the court&#8217;s order in that regard;<\/p>\n<p>that  the  petitioner came to know from the said order  that<\/p>\n<p>there  was an objection which appeared to have been made  by<\/p>\n<p>the  fourth  respondent  towards the registration;  but,  no<\/p>\n<p>objection was raised at the time of the issuance of patta in<\/p>\n<p>favour  of the vendor, and thus, as on today, the vendor  of<\/p>\n<p>the  petitioner  is not only the owner, but also  in  actual<\/p>\n<p>possession  of  the property; that with the  owners  of  the<\/p>\n<p>property,   the  petitioner  has  also  entered  into   sale<\/p>\n<p>transaction  and paid the entire consideration;  that  while<\/p>\n<p>those documents are placed for registration, the registering<\/p>\n<p>authority  cannot  adjourn  the  registration  calling   for<\/p>\n<p>production  of  certain  documents  from  the  H.R.  &amp;  C.E.<\/p>\n<p>Department,  which raised objection, which is  illegal,  and<\/p>\n<p>under the circumstances, it becomes necessary that the order<\/p>\n<p>passed calling for production of the documents by the H.R. &amp;<\/p>\n<p>C.E.  Department  and  adjourning  it  for  the  purpose  of<\/p>\n<p>registration  after  45 days has got to  be  quashed  and  a<\/p>\n<p>direction be issued to the second respondent to register the<\/p>\n<p>document as one required in law.\n<\/p>\n<\/p>\n<p>      4.The petitioner&#8217;s Counsel reiterated the averments in<\/p>\n<p>the petition.\n<\/p>\n<\/p>\n<p>      5.The learned Special Government Pleader for the third<\/p>\n<p>respondent  H.R.  &amp;  C.E. Department and  also  the  learned<\/p>\n<p>Counsel for the fourth respondent, the Executive Officer  of<\/p>\n<p>the  Temple,  have stated that it is a case  where  ryotwari<\/p>\n<p>patta  has been granted to the temple; that consequent  upon<\/p>\n<p>the  patta proceedings, patta has been issued to the vendor;<\/p>\n<p>that  the  temple was not even a party in those proceedings;<\/p>\n<p>but,  now  at  this stage, ryotwari patta has been  granted;<\/p>\n<p>that  the property is vested with the temple, and under  the<\/p>\n<p>circumstances, when the objection was raised before the  Sub<\/p>\n<p>Registry,   the  H.R.  &amp;  C.E.  Department  was  not   given<\/p>\n<p>sufficient time to produce the Court&#8217;s order in this regard.<\/p>\n<p>The  learned  Counsel would further add that a  third  party<\/p>\n<p>devotee  of  the temple filed a civil suit stating  that  no<\/p>\n<p>encumbrance should be created on the property; that the suit<\/p>\n<p>is also pending; that under the circumstances, the objection<\/p>\n<p>raised  by  the  H.R.  &amp; C.E. Department,  was  valid;  that<\/p>\n<p>finding  force  in the objection raised, the Department  was<\/p>\n<p>also directed to produce the documents within the stipulated<\/p>\n<p>period,  and  hence,  the  writ  petition  has  got  to   be<\/p>\n<p>dismissed.\n<\/p>\n<\/p>\n<p>      6.After  hearing  both sides, this  Court  is  of  the<\/p>\n<p>considered  opinion that it is a fit case where a  direction<\/p>\n<p>has  got to be issued.  Admittedly, the document was  placed<\/p>\n<p>by  the petitioner, who has entered into transaction of sale<\/p>\n<p>with  the  vendor of the property in respect of a  piece  of<\/p>\n<p>land.   The document is also placed for registration  before<\/p>\n<p>the  second respondent on 22.8.2007.  Instead of registering<\/p>\n<p>the document, the second respondent seems to have called for<\/p>\n<p>documents  from  the  H.R.  &amp; C.E. Department  which  raised<\/p>\n<p>objection  for registration of the same.  The  objection  of<\/p>\n<p>the department was that the property belonged to the temple,<\/p>\n<p>and  Ryotwari  patta  has also been issued,  and  hence,  it<\/p>\n<p>should  not  be  registered.  Now, at this juncture,  it  is<\/p>\n<p>pertinent  to point out that when a document is  placed  for<\/p>\n<p>registration  and  if  the conditions for  registration  are<\/p>\n<p>fulfilled,  a  duty  is cast upon the the  Sub  Registry  to<\/p>\n<p>register  the document.  Instead, in the case on  hand,  the<\/p>\n<p>second respondent Sub Registrar has called for the documents<\/p>\n<p>from  the  H.R. &amp; C.E. Department to sustain its  objection.<\/p>\n<p>This  Court is of the considered opinion that it  is  not  a<\/p>\n<p>case   where   the   Sub  Registry  could   call   for   any<\/p>\n<p>documents\/evidence from other party in order to  decide  the<\/p>\n<p>issue  between  them in respect of the title  or  possession<\/p>\n<p>over the same, and if it is allowed, then, in any given case<\/p>\n<p>where  an  objection is raised as to the title or possession<\/p>\n<p>of  the property, the Sub Registry will assume the power  of<\/p>\n<p>deciding  those questions which is outside their competency,<\/p>\n<p>power  and  jurisdiction.   Under  the  circumstances,  such<\/p>\n<p>practice has got to be deprecated.  Hence, it is a fit  case<\/p>\n<p>where  a  direction  has  got to be  issued  to  the  second<\/p>\n<p>respondent  Sub Registrar to register the document,  and  if<\/p>\n<p>there  is  any  dispute  as to the question  of  title,  the<\/p>\n<p>parties are at liberty to raise the same before the Court of<\/p>\n<p>civil  law and not before the Sub Registrar as one  done  by<\/p>\n<p>the H.R. &amp; C.E. Department in this case.<\/p>\n<p>      7.Accordingly,  a direction is issued  to  the  second<\/p>\n<p>respondent  to register the document, if the conditions  for<\/p>\n<p>the purpose  of registration  as one  warranted in  law, are<\/p>\n<p>fulfilled.   This writ petition is disposed of.
