Parikh Science College, Mahuva, Bhavnagar, with<br \/>\n\teffect from 25th November 1988.  On 30th<br \/>\n\tDecember 1991,  No Objection Certificate  has been issued for<br \/>\n\tfilling in the post of lecturer in various subjects by the<br \/>\n\tDepartment. Thereafter, on 01st January 1992 a new  No<br \/>\n\tObjection Certificate  was issued by the Department making change<br \/>\n\tthat the post of Chemistry Lecturer is to be filled in by appointing<br \/>\n\ta candidate belonging to Scheduled Caste as per the Government<br \/>\n\tResolution. However, the learned Tribunal vide impugned judgment and<br \/>\n\torder dated 10th March 1993 allowed the application<br \/>\n\tpreferred by the respondent No.1 declaring that the  respondent No.1<br \/>\n\tis entitled to be permitted and appointed to the post of full-time<br \/>\n\tlecturer in Chemistry with effect from 01st April 1993.<br \/>\n\tHence, present petition.\n<\/p>\n<p>\tIt<br \/>\n\tis further the case of the petitioner that a full-time appointment<br \/>\n\tis an appointment where the selection procedure would come into play<br \/>\n\tand a part-timer cannot be promoted as a matter of rule from his<br \/>\n\tpart-time position to that of a full-timer in the subject. It is<br \/>\n\tsubmitted that the Tribunal has exceeded his jurisdiction while<br \/>\n\tdirecting that the respondent No.1 is to be appointed as a full-time<br \/>\n\tlecturer in the respondent-College and his salary as a full-time<br \/>\n\tlecturer should be held admissible for the purpose of grant. It is<br \/>\n\tsubmitted that the post was reserved for S.T.\/ S.C. candidate and,<br \/>\n\ttherefore, the impugned judgment and order is bad in the eye of law.\n<\/p>\n<p>\tMs.Vasavdatta<br \/>\n\tBhatt, learned advocate for the respondent No.1, has relied upon the<br \/>\n\taffidavit-in-reply filed by the respondent No.1 and has submitted<br \/>\n\tthat the impugned direction is against the respondent-College and<br \/>\n\tnot against the State and, therefore, the petition at the instance<br \/>\n\tof petitioner-State is not maintainable in the eye of law.  It is<br \/>\n\tsubmitted that no backward class candidate had applied in response<br \/>\n\tto  two advertisements given by the college for inviting<br \/>\n\tapplications for the subject of Chemistry. It is submitted that the<br \/>\n\tprocedure tangles cannot override the powers of the Tribunal under<br \/>\n\tthe provisions of the Act. Thus, the order passed by the Tribunal is<br \/>\n\tjust and proper.\n<\/p>\n<p>\tHaving<br \/>\n\tconsidered the contentions raised by the learned advocates for the<br \/>\n\trespective parties, documents produced on record as well as the<br \/>\n\taverments made in the petition as well as the affidavit-in-reply, it<br \/>\n\tclearly transpires that the selection committee, including<br \/>\n\trepresentative of the Education Department had to note that no<br \/>\n\tcandidate is available from the backward class category for the post<br \/>\n\tof lecturer in Chemistry. Hence, it is rightly observed  by the<br \/>\n\tTribunal that the view of the department that the interest of<br \/>\n\tbackward class candidate can best be served by rightly fixing a<br \/>\n\tsubjectwise backward class post, does not appear to be sound.<br \/>\n\tEquality and equal opportunities are to be afforded to equals. A<br \/>\n\tpart-timer who is serving in the college is little distinguished<br \/>\n\tfrom other seekers of employment. He is an unequal. Therefore, if an<br \/>\n\tunequal opportunity is afforded to him, it cannot be said to be<br \/>\n\tbreach of opportunity of equality. In view of the same, the view<br \/>\n\ttaken by the Tribunal is just and proper. The Tribunal has assigned<br \/>\n\tcogent and convincing reasons while arriving at the conclusion.\n<\/p>\n<p>\tFurther,<br \/>\n\tthe learned advocate for the petitioner has failed to dislodge the<br \/>\n\treasons assigned by the respondent in order to convincing me to take<br \/>\n\ta different view contrary to the one already taken by the Tribunal.<br \/>\n\tTherefore, I am of the opinion that the impugned order is just and<br \/>\n\tproper. The present petition is devoid of any substance and merit<br \/>\n\tand the same is required to be dismissed.\n<\/p>\n<p>\tIn<br \/>\n\tview of aforesaid observations and discussion, the present petition<br \/>\n\tfails and is, accordingly, dismissed. Rule is discharged with no<br \/>\n\torder as to costs.
