SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/05\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>Present<br \/>\n\tCivil Revision<br \/>\n\tApplication under sec.115 of the Code<br \/>\n\tof Civil Procedure  has been preferred by the petitioner<br \/>\n\t herein   original appellant\/defendant to quash and<br \/>\n\tset aside the impugned order dtd.27\/6\/2000 passed by the learned<br \/>\n\tJoint District Judge, Vadodara  below Ex.21 in Regular<br \/>\n\tCivil Appeal No. 135 of 1985.\n<\/p>\n<p>Against<br \/>\n\tthe judgement and decree of eviction passed by the learned trial<br \/>\n\tcourt, the petitioner<br \/>\n\t herein   original defendant has preferred Regular<br \/>\n\tCivil Appeal No. 135 of 1985 before the District Court,<br \/>\n\tVadodara. After a period of almost 12 years from the date of<br \/>\n\tpreferring the appeal, the petitioner<br \/>\n\t herein   original appellant submitted an<br \/>\n\tapplication below Ex.21 under Order 41 Rule 27 of the Code<br \/>\n\tof Civil Procedure  permitting the petitioner<br \/>\n\t to produce subsequent  notice issued by one of the<br \/>\n\tplaintiffs claiming rent exclusively by him from the tenant. The<br \/>\n\tsaid application came to be rejected by the appellate court by the<br \/>\n\timpugned order dtd.27\/6\/2000, hence the petitioner<br \/>\n\t has preferred the present Civil<br \/>\n\tRevision Application  under sec.115 of the Code<br \/>\n\tof Civil Procedure.\n<\/p>\n<p>Heard<br \/>\n\tMr.Jigar Raval, learned<br \/>\n\tadvocate appearing on behalf of the petitioner and considered the<br \/>\n\treasoning given by the learned appellate court in para 6 of the<br \/>\n\timpugned order, which reads as under:-\n<\/p>\n<p> [6].\t\tI<br \/>\nam of the opinion after hearing arguments of both the parties that it<br \/>\nis true that appellant or respondent may be permitted to lead<br \/>\nevidence in appellate stage also if there is a substantial cause and<br \/>\nif the document is necessary to adjudicate the real dispute between<br \/>\nthe parties. So far law is concerned, it is admitted facts that any<br \/>\nparty is entitled to lead the evidence at appellate stage. But in<br \/>\nthis appeal  this Yogendraprasad<br \/>\nNarayandas Mahant, Pushpaben Yogendraprasad Mahant, minor Vimalkumar<br \/>\nYogendrakumar, minor Ragvendraprasad Yogendraprasad Mahant, residing<br \/>\nat Laheripura, Ramgalola Mandir, Vadodara issued a notice to the<br \/>\nappellant and asked to pay the rent to them. But on other side it is<br \/>\nadmitted facts that there is a dispute  amongst the respondents. So<br \/>\nnotice is issued to the appellant but thereafter there is a<br \/>\ncompromise amongst the respondents and also they informed to the<br \/>\nrelevant parties regarding the compromise made in their family and in<br \/>\noriginal suit trial court relied upon the Will Exh.127 and the trial<br \/>\ncourt also passed its judgment on suit notice and decided issue No.5<br \/>\nin favour of the respondents and that notice is produced in the trial<br \/>\ncourt at Exh.16 and the trial court also not believed the contentions<br \/>\nof Exh.16 a suit notice and the same facts reveal in this notice.<br \/>\nTherefore, I am of the opinion that it  is not necessary to permit<br \/>\nthe appellant to produce that notice on record and to lead the<br \/>\nevidence regarding the contentions of the notice. So there is no<br \/>\nsubstance in submissions made by the appellant or his learned<br \/>\nadvocate Shri J.H. Mehta. So I do not permit the appellant to produce<br \/>\nthe notice on record and to lead the evidence.\n<\/p>\n<p>\tHaving<br \/>\nheard the learned advocate for the petitioner  and considering the<br \/>\nreasoning given by the learned appellate court in para 6 as<br \/>\nreproduced hereinabove, it cannot be said that the appellate court<br \/>\nhas committed any<br \/>\nerror in rejecting the application submitted by the petitioner  for<br \/>\nproducing additional evidence, which calls for interference of this<br \/>\nCourt in exercise of powers under sec.115 of the Code<br \/>\nof Civil Procedure  <\/p>\n<p>It<br \/>\n\tis to be noted that even the Civil Appeal is of the year 1985 and<br \/>\n\tstill pending for final hearing before the appellate court because<br \/>\n\tof the pendency of the present Civil<br \/>\n\tRevision Application before this Court even after a period of<br \/>\n\t25 years. Be that it may, as stated above, the impugned order cannot<br \/>\n\tbe said to be illegal and\/or without jurisdiction which calls for<br \/>\n\tinterference of this Court.\n<\/p>\n<p>In<br \/>\n\tview of the above and for the reasons stated above, present Civil<br \/>\n\tRevision Application deserves to be dismissed and is<br \/>\n\taccordingly dismissed. Rule is discharged.  Interim relief granted<br \/>\n\tearlier, if any, stands vacated forthwith.\n<\/p>\n<p>Considering<br \/>\n\tthe fact the Regular<br \/>\n\tCivil Appeal is of the year 1985, the learned appellate court<br \/>\n\tis hereby directed to decide and dispose of the Regular<br \/>\n\tCivil Appeal No. 135 of 1985 at the earliest but not later<br \/>\n\tthan 31\/12\/2010. The learned Principal District Judge, Vadodara  is<br \/>\n\thereby directed to see that the said appeal is decided and disposed<br \/>\n\t by the learned appellate court at the earliest but not later than<br \/>\n\t31\/12\/2010, failing which appropriate proceedings shall be<br \/>\n\tinitiated. All the concerned are directed to co-operate the learned<br \/>\n\tappellate court in early disposal of the aforesaid appeal and within<br \/>\n\tstipulated time stated hereinabove.
