Justice V.GIRI\n\n Dated :25\/06\/2008\n\n O R D E R\n                  V.GIRI, J.\n        -------------------------\n            W.P.(C).No.5356 of 2005 K\n        -------------------------\n       Dated this the 25th day of June, 2008.\n\n                    JUDGMENT\n<\/pre>\n<p>       According to the petitioner, she has been<\/p>\n<p>serving as a Casual Sweeper in the Champanthotty<\/p>\n<p>Veterinary Poly Clinic since 1.4.2004. She has<\/p>\n<p>approached this court seeking a direction to the<\/p>\n<p>respondents from terminating her services and also<\/p>\n<p>to give her salary and other service benefits with<\/p>\n<p>arrears as provided in G.O.(P)No.3000\/98 dated<\/p>\n<p>25.11.1998.    She   has   further   sought  for  a<\/p>\n<p>declaration that the decision in <a href=\"\/doc\/1544041\/\">Mercy v. State<\/p>\n<p>of  Kerala<\/a>  {2004(2)   KLT   848}  applies   to the<\/p>\n<p>petitioner.\n<\/p>\n<p>       2.    A detailed statement and a counter<\/p>\n<p>affidavit  have  been  filed   by  the   Government.<\/p>\n<p>Subsequent pleadings have also been placed on<\/p>\n<p>record.\n<\/p>\n<p>       3.   The absorption of casual sweepers in<\/p>\n<p>part-time service and regularisation of service<\/p>\n<p>and payment of wages on a par with the part-time<\/p>\n<p>sweepers  is  governed   by    G.O.(P)No.501\/05\/Fin<\/p>\n<p>dated 25.11.2005.\n<\/p>\n<p>       In   the  result,   the   writ  petition  is<\/p>\n<p>disposed of in the following terms.<\/p>\n<p>W.P.(C).NO.5356\/05<\/p>\n<p>                         :: 2 ::\n<\/p>\n<p>\n     (1) The     petitioner      shall   make   an<\/p>\n<p>         application before the 2nd respondent<\/p>\n<p>         for     absorbing     her  as   Part-time<\/p>\n<p>         Sweeper in the regular service.      This<\/p>\n<p>         may be done within one month from<\/p>\n<p>         today.\n<\/p>\n<p>     (2) The    2nd respondent    shall  cause  an<\/p>\n<p>         enquiry    to  be   made  into  the  said<\/p>\n<p>         application    and     if  there  is  any<\/p>\n<p>         proposal to reject the petitioner&#8217;s<\/p>\n<p>         application,     she     must  be   given<\/p>\n<p>         intimation stating specific reasons<\/p>\n<p>         on the basis of which her application<\/p>\n<p>         is to be rejected.\n<\/p>\n<p>     (3) If   the   2nd respondent    accepts  the<\/p>\n<p>         petitioner&#8217;s     application,   then   it<\/p>\n<p>         shall be forwarded to the Government<\/p>\n<p>         within two months from the date of<\/p>\n<p>         receipt of the application from the<\/p>\n<p>         petitioner.\n<\/p>\n<p>     (4) Thereupon, the Government shall pass<\/p>\n<p>         orders thereon within a period of two<\/p>\n<p>         months thereafter.\n<\/p>\n<p>     (5) Till the     aforementioned   process is<\/p>\n<p>         completed,    the petitioner    shall be<\/p>\n<p>         permitted    to  continue    in the  same<\/p>\n<p>         capacity in which she is currently<\/p>\n<p>         placed.\n<\/p>\n<\/p>\n<p>                                         Sd\/-\n<\/p>\n<p>                                       (V.GIRI)<br \/>\n                                         JUDGE<br \/>\nsk\/<br \/>\n         \/\/true copy\/\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Radhamani.K vs State Of Kerala on 25 June, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 5356 of 2005(K) 1.
