CHOUBEY SON OF BADABABU CHOUBEY.\n                                           Versus\n                                THE STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>2   11.04.2011                 Heard learned counsels for the petitioner and<\/p>\n<p>                 the State.\n<\/p>\n<p>                               The petitioner has renewed his prayer for<\/p>\n<p>                 anticipatory bail in connection with Bagha P.S. Case<\/p>\n<p>                 No. 106 of 2006 pending in the court of learned Chief<\/p>\n<p>                 Judicial Magistrate, West Champaran registered under<\/p>\n<p>                 Section 304 of the Indian Penal Code.<\/p>\n<p>                               It is submitted by learned counsel for the<\/p>\n<p>                 petitioner that the informant has subsequently, retracted<\/p>\n<p>                 from the initial accusation and has filed a petitioner to<\/p>\n<p>                 that effect before the learned court below.<\/p>\n<p>                               I am not inclined to interfere, only because,<\/p>\n<p>                 this is the second anticipatory bail application of the<\/p>\n<p>                 petitioner.\n<\/p>\n<p>                               Let the learned court below consider the<\/p>\n<p>                 regular bail of the petitioner in view of the fact that the<\/p>\n<p>                 case was registered under Section 304 of the I.P.C and<\/p>\n<p>                 the informant has retracted from initial accusation and<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>             if possible, dispose off the regular bail application of<\/p>\n<p>             the petitioner on the same day.\n<\/p>\n<p>                       With the above observation, this application<\/p>\n<p>             is, accordingly, disposed off.\n<\/p>\n<\/p>\n<p>                                          (Dinesh Kumar Singh, J.)<br \/>\nAmrendra\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Dr. I.C.
