JUSTICE SABINA\n\n\nPresent: Mr. Kulvir Narwal, Advocate\n         for the petitioners.\n\n             Mr. Sanjay Mittal, Advocate\n             for the respondents.\n\n\nSabina, J.\n<\/pre>\n<p>             Election for the post of Sarpanch, Gram Panchayat<\/p>\n<p>Lakria, was held on 23.03.2005.              Four persons including the<\/p>\n<p>petitioners filed nomination papers. Last date for withdrawal of<\/p>\n<p>nomination was 22.03.2005.           Petitioners        withdrew        their<\/p>\n<p>nominations      on      22.03.2005.        Petitioners    affixed      their<\/p>\n<p>signatures\/thumb      impressions       in     the     relevant      register,<\/p>\n<p>maintained by the returning officer.          Consequently, respondent<\/p>\n<p>no.1   was    declared    Sarpanch     of    Village   Lakria   as    elected<\/p>\n<p>unopposed. Aggrieved by the same, petitioners filed the suit,<\/p>\n<p>challenging the election of the respondent. Vide impugned<br \/>\n<span class=\"hidden_text\"> Civil Revision No. 484 of 2007                     2<\/span><\/p>\n<p>judgment, the suit of the petitioners was dismissed. Hence, the<\/p>\n<p>present revision petition.\n<\/p>\n<p>              After hearing the learned counsel for the parties, I am<\/p>\n<p>of the opinion that the instant petition is devoid of any merit and<\/p>\n<p>deserves dismissal.\n<\/p>\n<p>              The      petitioners   had   challenged        the   factum    of<\/p>\n<p>declaration of the respondent having been declared elected as<\/p>\n<p>unopposed Sarpanch of Village Lakria on the ground that they<\/p>\n<p>had been kidnapped by the respondent and were forced to<\/p>\n<p>withdraw      their     nomination     papers.         FIR    NO.34,     dated<\/p>\n<p>22.03.2005, under Sections 365\/342\/34 of the Indian Penal<\/p>\n<p>Code, was registered at Police Station Beri (hereinafter referred<\/p>\n<p>to as the &#8220;FIR&#8221;). The respondent had confessed his guilt in the<\/p>\n<p>Gram Sabha. However, the petitioners failed to lead any cogent<\/p>\n<p>evidence in support of their pleas and thus, failed to prove their<\/p>\n<p>case. FIR was registered on the basis of written application made<\/p>\n<p>by the petitioner Rup Chand. Hence, the plea taken by the<\/p>\n<p>petitioners     that     the   name   of    the   respondent       had    been<\/p>\n<p>deliberately excluded by the police in the FIR, was                      rightly<\/p>\n<p>discarded by the learned trial Court. It has been noticed by the<\/p>\n<p>trial Judge in the judgment that in the application Ex:R-1 before<\/p>\n<p>the police, the time of occurrence was stated as 4:30 p.m. and<\/p>\n<p>the petitioner while appearing in the witness box had stated that<\/p>\n<p>he had withdrawn his nomination on 22.03.2005 at 12:30 p.m.<\/p>\n<p>Hence, the learned trial Judge             rightly held that in case the<\/p>\n<p>nomination paper had already been withdrawn by the petitioner,<br \/>\n<span class=\"hidden_text\"> Civil Revision No. 484 of 2007                   3<\/span><\/p>\n<p>then there was no occasion for the respondent to get the<\/p>\n<p>petitioners       kidnapped   at   4:30   p.m.   The   petitioners   had<\/p>\n<p>themselves withdrawn their nomination papers and consequently,<\/p>\n<p>respondent no.1 was declared as elected Sarpanch unopposed.
