The ESI Court has come to conclusion that death of Maheshbhai<br \/>\nGangadhar Kulkarni is considered to be an employment injury and ESI<br \/>\nCorporation has to pay the benefits under the provisions of Section<br \/>\n52 and Schedule I of ESI Act to the dependents of deceased ?  Mahesh<br \/>\nGangadhar Kulkarni.\n<\/p>\n<p>\tThis<br \/>\nCourt has admitted the First Appeal on 9th May 2008 and<br \/>\nissued rule made it returnable on 18th June 2008. On 1st<br \/>\nAugust 2008, this Court has passed the following order in Civil<br \/>\nApplication No.4872 of 2008 which is quoted as under :\n<\/p>\n<p>\t?SHeard.\n<\/p>\n<p>\tAd-interim<br \/>\nrelief in terms of Para 4(c) is granted, on condition that the amount<br \/>\nn question will be deposited before the Registry of this Court on or<br \/>\nbefore 21st August 2008. Upon depositing the said amount,<br \/>\nthe original claimant will be permitted to withdraw 50% of the amount<br \/>\nupon furnishing security and 50% amount shall be permitted to be<br \/>\nwithdraw without security.\n<\/p>\n<p>\tWith<br \/>\nthe aforesaid directions, the application stands disposed of. Rule is<br \/>\nmade absolute.?S<\/p>\n<p>\tAccording<br \/>\nto aforesaid order, stay is granted by this Court on condition that<br \/>\namount in question will be deposited before registry of this Court on<br \/>\nor before 21st August 2008. By depositing the said amount,<br \/>\noriginal claimant will be permitted to withdraw 50% of the amount<br \/>\nupon furnishing security and 50% amount shall be permitted to be<br \/>\nwithdrawn without security.\n<\/p>\n<p>\tThe<br \/>\nESI Corporation has deposited Rs.1,07,258\/- before this court and<br \/>\naccording to Corporation, this much amount is to be available to the<br \/>\ndependents as per order passed by Corporation. However, learned<br \/>\nadvocate Mr. Modi disputed the statement and some more amount is<br \/>\nrequired to be disbursed in favour of minor and dependents. This part<br \/>\nis not calculated by Corporation.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr. Vasavada submitted that he will file necessary affidavit<br \/>\non behalf of Corporation within some reasonable time.\n<\/p>\n<p>\tTherefore,<br \/>\nthis Court is giving reasonable opportunity of hearing to Corporation<br \/>\nand Corporation may file affidavit and point out that whatever amount<br \/>\nis deposited can satisfy the direction issued by ESI Court or not. If<br \/>\nany short fall for, the ESI Corporation shall have to deposit<br \/>\nremaining amount on or before next date of hearing.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr. Modi submitted that from depositing Rs.1,07,258\/-, no<br \/>\namount is disbursed in favour of applicant till date.\n<\/p>\n<p>\tTherefore,<br \/>\nit is directed to registry to pay Rs.60,000\/- in favour of<br \/>\nSangeetaben widow of Maheshbhai Gangadhar Kulkarni by account payee<br \/>\ncheque immediately after proper verification. This Court will pass<br \/>\nfurther order about rest of the amount after considering the<br \/>\nguarantee submitted by applicant before this Court.\n<\/p>\n<p>\tLet<br \/>\nCorporation may file necessary affidavit before this Court on or<br \/>\nbefore 24th November 2008.\n<\/p>\n<p>\tNo<br \/>\ndoubt, this Court has granted stay on 1st August 2008<br \/>\nagain execution of ESI Court order, but, from the date on which the<br \/>\nclaimants are entitled the benefits that all the benefits up to the<br \/>\ndate of order passed by this court on 1st August 2008<br \/>\nshall have to be deposited by Corporation including monthly<br \/>\ndependency benefits including minor. That part must have to be made<br \/>\nclear by ESI Corporation in his affidavit.\n<\/p>\n<p>\tIt<br \/>\nis made clear to ESI Corporation that on 1st August 2008,<br \/>\nthis Court has granted ad-interim relief, but, this Court has not<br \/>\ngranted interim relief.
