RAMACHANDRAN NAIR, J.\n                 ----------------------------------------\n                 WP (C) NO. 16549 of 2010\n                  ---------------------------------------\n             Dated this the 8th day of June, 2010\n\n\n                        J U D G M E N T\n<\/pre>\n<p>    The petitioners here in are the members of the fifth<\/p>\n<p>respondent Co-operative House Construction Society.<\/p>\n<p>They are also some of the allottees of plots in the Jawahar<\/p>\n<p>Nagar Project Scheme formulated by the fifth respondent<\/p>\n<p>Society. The scheme framed includes provision for<\/p>\n<p>common amenities like road, school, park, shopping<\/p>\n<p>complex etc. It is pointed out in the writ petition that the<\/p>\n<p>scheme and lay out were sanctioned by the Government<\/p>\n<p>under Section 12 of the Town Planning Act. The land<\/p>\n<p>value was fixed taking into consideration of the total<\/p>\n<p>value of the land purchased by the fifth respondent<\/p>\n<p>Society and the value of land earmarked for common<\/p>\n<p>amenities.\n<\/p>\n<p>    2. It is pointed in the writ petition that the fifth<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><br \/>\nWP (C) NO. 16549 of 2010<\/p>\n<p>respondent Society has approached respondents 1 to 4 to<\/p>\n<p>seek a variation of the scheme and to earmark these items<\/p>\n<p>of the properties for the construction of a multi-storeyed<\/p>\n<p>apartment building. It is the case of the petitioners that<\/p>\n<p>the same cannot be permitted.\n<\/p>\n<p>       3. Apprehending such action on the part of the<\/p>\n<p>respondents          the  petitioners have filed   various<\/p>\n<p>representations before the Chief Town Planner Secretary<\/p>\n<p>of the Local Self Government Department and the<\/p>\n<p>Secretary of the Cochin Corporation. As no positive reply<\/p>\n<p>has been given so far in the matter this writ petition has<\/p>\n<p>been filed.\n<\/p>\n<p>       4. Heard the learned Government Pleader appearing<\/p>\n<p>for the respondents 1 and 2 and the learned standing<\/p>\n<p>counsel appearing for the 3rd respondent Corporation. It<\/p>\n<p>was submitted that even though the 5th respondent<\/p>\n<p>submitted an application before the Corporation, so far no<\/p>\n<p>decision has been taken. The Government has also not<\/p>\n<p>taken a decision in the matter.\n<\/p>\n<p><span class=\"hidden_text\">                               3<\/span><br \/>\nWP (C) NO. 16549 of 2010<\/p>\n<p>       5. In that view of the matter there will be a direction<\/p>\n<p>that the objections raised by the petitioners will be<\/p>\n<p>considered by the Government and the Corporation<\/p>\n<p>before any final decision is taken. Till such orders are<\/p>\n<p>passed the status quo as on today will be maintained. No<\/p>\n<p>costs.\n<\/p>\n<\/p>\n<p>                                T.R.
