Act, 1953 and entry No.4 was mutated.<br \/>\n\tThis was challenged by the petitioners and other persons by way of<br \/>\n\tRTS Appeal No.6 of 1965, however, it was dismissed by the Collector<br \/>\n\ton 2-4-1968. When it was carried before the Special<br \/>\n\tSecretary(Appeal) by way of revision, said revision was dismissed on<br \/>\n\t30-7-1971 directing the Collector to hold inquiry under the<br \/>\n\tprovisions of Jagir Abolition Act and then to mutate fresh entry.<br \/>\n\tThereafter on 11-5-1972, Mamlatdar, Palanpur, held that the<br \/>\n\tpetitioners were the permanent holders of the land as they held the<br \/>\n\tsame since long and remanded the case.  Order dated 11-5-1972 of<br \/>\n\tMamlatdar was set aside by Deputy Secretary (Appeals)  and ordered<br \/>\n\tfor a decision afresh. Thereafter, the  petitioners were held not<br \/>\n\tentitled for the land under the Jagir Abolition Act by the Mamlatdar<br \/>\n\tvide order dated 30-4-1973 which, when challenged before the Special<br \/>\n\tSecretary, was dismissed. On 11-10-1995, the petitioner requested<br \/>\n\tfor non-removal of his unauthorized occupation by approaching the<br \/>\n\tMamlatdar, Palanpur. The petitioners in March, 1996 requested for<br \/>\n\tregularization of their land bearing Survey No.504. Said application<br \/>\n\twas rejected by the Collector, Banaskantha on 29-12-1997.   They<br \/>\n\tchallenged the said order before Deputy Secretary (Appeals) by way<br \/>\n\tof revision. However, it was rejected vide order dated 26-4-2000 on<br \/>\n\tthe ground that land was mutated in the name of Government since<br \/>\n\tlong and it was decided to allot the said land to the affected<br \/>\n\tpersons of Sipu Project for rehabilitation. Hence, the present<br \/>\n\tpetition.\n<\/p>\n<p>Heard<br \/>\n\tlearned advocate, Mr.Mehul Rathod for the petitioners and learned<br \/>\n\tAGP, Ms.Manisha Narsinghani for the respondents.\n<\/p>\n<p>It<br \/>\n\tis submitted by Mr.Rathod that affected persons of Sipu Project<br \/>\n\trefused to take possession of the said land as being unsuitable and<br \/>\n\thence, possession of the said land kept reserved for the affected<br \/>\n\tpersons of Sipu Project came back to the Government. As per the<br \/>\n\torder passed by the Deputy Collector, Sipu Project, in February,<br \/>\n\t1984, it was decided that land in question was not required for<br \/>\n\trehabilitation of affected persons of Sipu Project and hence,<br \/>\n\tGovernment was requested to cancel the order for allotment of said<br \/>\n\tland to the affected persons of Sipu Project. It is further<br \/>\n\tsubmitted that in similar type of cases, the Collector, Banaskantha,<br \/>\n\tat Palanpur vide order dated 10-5-1992 regularized the encroachment<br \/>\n\tmade by other persons and order for allotment of land to the<br \/>\n\taffected persons of Sipu Project was also cancelled. Copy of said<br \/>\n\torder is placed on record from pages 27 to 36. This aspect was not<br \/>\n\tconsidered by the Collector while deciding the application as well<br \/>\n\tas  by the Deputy Secretary (Appeals) in revision.\n<\/p>\n<p>It<br \/>\n\tis an admitted fact that the petitioners have been in possession<br \/>\n\tover the disputed land since 1957-58 and till date, land is in their<br \/>\n\tpossession. In view of the above, in the opinion of this Court, if<br \/>\n\tthe orders passed by the Collector as well as Deputy Secretary<br \/>\n\t(Appeals) are quashed and set aside and matter is remanded to the<br \/>\n\tCollector for a decision afresh, ends of justice will be met.\n<\/p>\n<p>Thus,<br \/>\n\tthe orders dated 29-12-1997 passed by the Collector, Banaskantha,<br \/>\n\tand  26-4-2000 passed by the Deputy Secretary (Appeals) are quashed<br \/>\n\tand set aside and matter is remanded to the Collector, Banaskantha,<br \/>\n\tfor a decision afresh. The Collector,  after giving full<br \/>\n\topportunities of producing documents and hearing, will decide the<br \/>\n\tsame in light of the decision rendered qua other persons. Till such<br \/>\n\ta decision is rendered by the Collector, status quo prevailing as on<br \/>\n\ttoday shall remain in force.  This Special Civil Application stands<br \/>\n\tdisposed of.
