Petitioner faces allegations<\/p>\n<p>for offences punishable, inter alia, under Section 376 I.P.C. The<\/p>\n<p>alleged victim is a young woman aged about 18 years. Crime<\/p>\n<p>has been registered on the basis of a complaint filed by the<\/p>\n<p>defacto complainant before the learned Magistrate and referred<\/p>\n<p>by the Magistrate to the police under Section 156(3) Cr.P.C. It<\/p>\n<p>would appear that admittedly a marriage was solemnised<\/p>\n<p>between the petitioner and the victim.                     Such marriage was<\/p>\n<p>solemnised under the provisions of the Special Marriage Act. The<\/p>\n<p>spouses are at loggerheads now. Proceedings are pending before<\/p>\n<p>the matrimonial court.       Declaration of nullity of marriage has<\/p>\n<p>been sought by the wife. Long later, she has filed this complaint<\/p>\n<p>alleging commission of offences of rape, abduction etc.<\/p>\n<p>Investigation is in progress. The petitioner apprehends imminent<\/p>\n<p>arrest.\n<\/p>\n<p><span class=\"hidden_text\">B.A.No.7708 of 2007              2<\/span><\/p>\n<p>     2.    The learned Public Prosecutor after taking instructions<\/p>\n<p>submits that while it is true that Crime 393 of 2007 of Parippally<\/p>\n<p>Police Station has been registered on the basis of the allegations<\/p>\n<p>raised by the defacto complainant, investigation has revealed<\/p>\n<p>that it is not necessary to arrest the petitioner or to further<\/p>\n<p>proceed against him. The learned Public Prosecutor submits that<\/p>\n<p>the petitioner shall not be arrested in this case.          In these<\/p>\n<p>circumstances I find that the apprehension of the petitioner is<\/p>\n<p>without any basis.    This application for anticipatory bail is, in<\/p>\n<p>these circumstances, dismissed accepting the submissions of the<\/p>\n<p>learned Public Prosecutor.\n<\/p>\n<p>     3.
