Parikh,  A.P.P. for the respondent   State\n\n \n\n======================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.L.DAVE\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n\t\t\t\tDate\n: 26\/03\/2010 \n\n \n\n \nCOMMON\nORAL JUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE BANKIM.N.MEHTA)<\/p>\n<p>1.\tThe<br \/>\nappellants   convicts have filed both these appeals   under Section<br \/>\n374 of the Code of Criminal Procedure, 1973 challenging the judgment<br \/>\nand order of conviction and sentence rendered by learned  Additional<br \/>\nSessions Judge, Fast Track Court No.1, Bhavnagar  in Sessions Case<br \/>\nNo. 32 of 2003 on 7-8-2003 convicting them   for the offences<br \/>\npunishable u\/ss   302, 201 and  34 of the  Indian Penal Code and u\/s<br \/>\n135 of the Bombay Police Act and sentencing them to undergo life<br \/>\nimprisonment   and other sentences.\n<\/p>\n<p>2.\tAs<br \/>\nboth these appeals arise out of the same judgment, they are heard and<br \/>\ndecided by this common judgment.\n<\/p>\n<p>3.\tAccording<br \/>\nto the prosecution case, on 30-9-2001 at about l9-30 hours  deceased<br \/>\nChandan  Rayabhai  the brother of first  informant Amarshi Rayabhai<br \/>\nwas breaking roof tiles of his house and was giving abuses. There<br \/>\nwere heated verbal exchanges as the accused told Chandan not to give<br \/>\nabuses. Thereafter, accused Hira Bijalbhai, Ashok Hirabhai and Kili<br \/>\nHirabhai made assault  with knife and axe  on Chandan and on account<br \/>\ninjuries Chandan died. Accused Kusumben  wife of Ashok Hirabhai<br \/>\ncaused disappearance of knife used in the commission of offence.\n<\/p>\n<p>4.\tOn<br \/>\nthe basis of First Information Report (FIR) lodged by Amarshi<br \/>\nRayabhai   offence was registered and investigation was started.<br \/>\nDuring the course of investigation, panchanama of scene of offence,<br \/>\npanchanama of discovery of weapons and panchanama of recovery of<br \/>\nclothes were drawn. Statement of the witnesses were recorded and<br \/>\nmuddamal recovered during investigation was sent to Forensic Science<br \/>\nLaboratory for examination. At the end of investigation,  accused<br \/>\nHira Bijalbhai and  accused Kusumben wife of accused Ashok  Hirabhai<br \/>\nalong with the appellants were arrested and charge sheet  came to be<br \/>\nfiled against the accused  for  offences punishable u\/ss 302, 201, 34<br \/>\nand 504 of the I.P. Code and u\/s 135 of the Bombay Police Act.\n<\/p>\n<p>5.\tAs<br \/>\nthe offence of murder was  triable by the court of Sessions, the case<br \/>\nwas committed to Sessions Court, Bhavnagar and  it was registered  as<br \/>\nSessions Case No. 32 of 2003. Learned Additional Sessions  Judge,<br \/>\nFast Track Court, Bhavnagar framed charge  at Exh. 7 against the<br \/>\naccused. The charge was read over and explained to them. The accused<br \/>\npleaded not guilty to the charge and claimed to be tried.  Therefore,<br \/>\nthe prosecution led  evidence. At the end of  recording of evidence,<br \/>\nthe incriminating circumstances appearing in  the evidence  against<br \/>\nthe accused were explained to them. The accused in their further<br \/>\nstatement recorded u\/s 313 of the Code of Criminal Procedure, 1973<br \/>\nstated that there was a cabin on the road  and  Amarshi had objected<br \/>\nto that cabin and hence false complaint  is filed. It was also stated<br \/>\nthat the witnesses are relatives of the deceased, and therefore,<br \/>\nthey are giving  false evidence.\n<\/p>\n<p>6.\tAfter<br \/>\nhearing   the learned Addl. Public Prosecutor learned advocate for<br \/>\nthe  accused and appreciating  the  evidence adduced by the<br \/>\nprosecution, the trial court by the impugned judgment convicted the<br \/>\nappellants   convicts for the aforesaid offences. Accused Hira<br \/>\nBijalbhai was convicted for the offence punishable u\/s 324 and  504<br \/>\nof the I.P. Code and u\/s 135 of the Bombay Police Act but acquitted<br \/>\naccused Kusumben wife of Ashokbhai Hirabhai of the charges levelled<br \/>\nagainst her. It is stated that accused  Hira  has not filed any<br \/>\nappeal against his conviction.  Being aggrieved by the said decision,<br \/>\nthe appellants   convicts have  preferred these appeals.\n<\/p>\n<p>7.\tWe<br \/>\nhave heard learned  Advocate Ms. Pratik Barot for appellants and<br \/>\nlearned A.P.P. Mr.  H.H. Parikh  for the respondent   State in both<br \/>\nthese appeals. at length and in great detail. We have also perused<br \/>\nthe impugned judgment and record and proceedings of the trial court.\n<\/p>\n<p>8.\tLearned<br \/>\n Advocate Mr. Barot for appellants  has mainly submitted that  he<br \/>\ndoes not dispute  the incident but  according to him,  the incident<br \/>\noccurred on account of  grave and sudden provocation on the part of<br \/>\nthe deceased and hence at the most the appellants   accused could<br \/>\nhave been convicted for the offence punishable u\/s 304 Part-I or<br \/>\nPart-II of the I.P. Code.  He has also submitted that no blood stain<br \/>\nwas found on  one of the knives, and therefore, the prosecution has<br \/>\nfailed to prove  use of one of the weapons. Hence, the learned trial<br \/>\nJudge  has committed error in convicting  the appellants   accused<br \/>\nfor the offence of murder and therefore both these appeals are<br \/>\nrequired to be allowed and the impugned judgment and order of<br \/>\nconviction and sentence  is required to be  altered and modified to<br \/>\nSection 304 Part-I or II of the I.P. Code.\n<\/p>\n<p>9.\tPer<br \/>\ncontra, learned A.P.P. Mr. Parikh  has stated that the medical<br \/>\nevidence indicates  that the deceased was  assaulted by the  accused<br \/>\nand several injuries were  caused to the deceased. Therefore, the act<br \/>\nwas premeditated and hence the learned trial Judge was justified in<br \/>\nrecording conviction  of the appellants   accused for the offence<br \/>\nof murder. He has also submitted that it is always  not necessary<br \/>\nthat  weapons used  in offence  must  contain blood  stains and<br \/>\ntherefore the  learned trial Judge  was justified in relying upon the<br \/>\nevidence  of the eye witnesses and hence no interference is warranted<br \/>\nin the impugned judgment  and both these appeals deserve to be<br \/>\ndismissed.\n<\/p>\n<p>10.\tThe<br \/>\nevidence of P.W. 3 Dr.  Sanjaybhai Omkarbhai Detha Exh. 19 who<br \/>\nperformed postmortem  of dead body of the deceased indicates that<br \/>\nfour injuries were found on the dead  body and  such injuries were<br \/>\npossible by  muddamal knife. According to  him, the injuries were<br \/>\nsufficient in the ordinary course of nature to cause death.<br \/>\nPostmortem Report Exh. 20 indicates the external injuries found on<br \/>\nthe dead body. According to him, the cause of  death was  shock and<br \/>\nhaemorrhage   and cardiorespiratory  failure as a result of multiple<br \/>\ninjuries sustained. In view of this  evidence, it clearly emerges<br \/>\nthat death was homicidal  in nature and it was neither incidental nor<br \/>\nsuicidal.\n<\/p>\n<p>11.\tAccording<br \/>\nto learned advocate Mr. Barot, the case would fall under Exception 4<br \/>\nto Section 300 of the I.P. Code as the incident occurred without<br \/>\npremeditation in  the heat of passion  upon a sudden  quarrel and<br \/>\nthe accused  not having taken undue advantage  or did not act in a<br \/>\ncruel or  unusual manner.  In order to ascertain whether the incident<br \/>\n occurred in a sudden quarrel, the evidence of the eye witnesses is<br \/>\nrequired to be analysed.\n<\/p>\n<p>12.\tThe<br \/>\nevidence of P.W. 1 Amarshi Rayabhai Exh. 16 indicates  that   when<br \/>\nhe  went inside the  house of Chandan, accused Hira Bijal  made<br \/>\nassault on Chandan  with axe and accused Ashok and accused Kili<br \/>\nassaulted him  with knife. The witness has been extensively<br \/>\ncross-examined but the defence has not been able to elicit  that<br \/>\nthere was sudden quarrel and in the heat of passion   the incident<br \/>\noccurred.\n<\/p>\n<p>13.\tThe<br \/>\n evidence of P.W.  2 Kalaben wife of  Amarshi  Rayabhai Exh. 18  also<br \/>\nindicates that the accused  made assault  on the deceased with deadly<br \/>\nweapons. The witness has been extensively cross-examined but the<br \/>\ndefence has not been able to elicit anything in favour of it.  The<br \/>\nevidence of this witness does not indicate that  there was sudden<br \/>\nquarrel and the accused attacked  the deceased in heat of passion.\n<\/p>\n<p>14.\tIn<br \/>\nview of above consistent evidence, it clearly emerges that    the<br \/>\naccused armed with deadly weapons  made assault on the deceased and<br \/>\ncaused him fatal injuries. This clearly indicates the accused with<br \/>\npre-determined mind armed with deadly weapons made assault  on the<br \/>\nvictim  who was unarmed. The manner in which  the incident has<br \/>\noccurred, it is difficult to believe that   in the heat of passion<br \/>\nupon a sudden quarrel, the accused attacked the deceased.<br \/>\nConsidering  the number of injuries, in our view,  the accused acted<br \/>\nin cruel manner and   took undue advantage. Therefore, in our<br \/>\nconsidered view,  the learned trial Judge was justified in  recording<br \/>\nconviction  for the offence punishable u\/s 302 of the I.P. Code.<br \/>\nHence, no inference is warranted  in the impugned judgment and both<br \/>\nthese appears are required to be dismissed.\n<\/p>\n<p>15.\tIn<br \/>\nview of above,  both these appeals fail and stand dismissed\t and the<br \/>\njudgment and order of conviction and sentence passed by  learned<br \/>\nAdditional Sessions Judge, Fast Track Court No.1, Bhavnagar  in<br \/>\nSessions Case   No. 32 of 2002 on 7th August, 2003,  is<br \/>\nconfirmed. The<br \/>\nmuddamal be disposed of as directed by the trial court.\n<\/p>\n<p>   \t\t\t\t\t(A.L. Dave, J.)\t\t\t<\/p>\n<p>\t\t\t\t\t\t(Bankim<br \/>\nN.
