Justice V.GIRI\n\n Dated :26\/05\/2008\n\n O R D E R\n                        V.GIRI, J\n                      -------------------\n                   W.P.(C).15294\/2008\n                      --------------------\n           Dated this the 26th day of May, 2008\n\n                      JUDGMENT\n<\/pre>\n<p>     Petitioner, who was a constable in the Border<\/p>\n<p>Security Force applied for deputation in the Central<\/p>\n<p>Bureau of Investigation and was originally sent on<\/p>\n<p>deputation as per Ext.P1 order dated 7.2.2002. It was<\/p>\n<p>extended by a further period of two years as per Ext.P2<\/p>\n<p>order. In the meanwhile, as evidenced by Exts.P3 and P4,<\/p>\n<p>Central Bureau of Investigation           has considered the<\/p>\n<p>absorption of Constables\/Head Constables who have been<\/p>\n<p>serving in their department on deputation for a period of<\/p>\n<p>four years. Apparently, petitioner is desirous of availing<\/p>\n<p>the said opportunity, but is aggrieved that respondents 1<\/p>\n<p>and 2 have not forwarded the &#8216;No Objection Certificate&#8217;.<\/p>\n<p>Hence the writ petition.\n<\/p>\n<\/p>\n<p>2.   Learned Standing counsel for respondents 1 and 2<\/p>\n<p>submits   that   the  petitioner        has not  approached<\/p>\n<p>respondents 1 and 2 for NOC, expressing absence of any<\/p>\n<p>objection in the matter of absorption of the petitioner by<\/p>\n<p>W.P.(C).15294\/2008<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>the CBI.     Obviously respondents 1 and 2 cannot be<\/p>\n<p>faulted with, if there has been no request on the part of<\/p>\n<p>the petitioner .\n<\/p>\n<\/p>\n<p>3.    After having heard learned counsel for the<\/p>\n<p>petitioner, learned counsel for respondents 1 and 2,<\/p>\n<p>and the learned Standing Counsel for CBI, writ petition<\/p>\n<p>is disposed of in the following terms:-<\/p>\n<blockquote><p>      If the petitioner approaches respondents 1<\/p>\n<p>      and 2 for an NOC, for the purpose of<\/p>\n<p>      enabling him to be considered by the CBI<\/p>\n<p>      for absorption into CBI in terms of Exts.P3<\/p>\n<p>      and P4 within a period of two weeks from<\/p>\n<p>      today, respondents 1 and 2 shall take a<\/p>\n<p>      decision on his request in that regard<\/p>\n<p>      within one month thereafter.<\/p><\/blockquote>\n<p>                                       V.GIRI,<br \/>\n                                       Judge<\/p>\n<p>mrcs<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Joseph V.R vs Union Of India on 26 May, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 15294 of 2008(U) 1.
