Aggrieved, the’edefen\u00e9jlants’,.rfil~eti~~l.l”an V’a’ppeal in the Court<\/p>\n
below,   below, the claim being
\nbased on__acqu’isi_tio:n–of’—t:itie”‘by way of adverse possession<\/p>\n
and;evnjoyrnent’or”the  property, the starting point of<\/p>\n
 hostVil\u00a7-gttlitude halsdnot been correctly pleaded and the<\/p>\n
 :startiing:’\u00ab\u00bbdVate.c~of adverse possession has not been spelt out<\/p>\n
and si,_nceVl’,ithle plaint is not having the averments which<\/p>\n
 shovvz the acquisition of title to the suit property by way of<\/p>\n
.\u00ab’–.._adv.e.rse holding and enjoyment of the same by the<\/p>\n
 V. _..plaintiffs, the order passed by the Trial Court is capricious.<\/p>\n
It has set aside the order impugned before it. However, it<\/p>\n
has directed both the parties not to cut and remove any<\/p>\n

5. Keeping in view the submissions__rnade.A_:’by <\/p>\n
learned counsel appearing for the\u00a7gpart_i’esg, it lsuninecessaryr<\/p>\n
for me to record any findingsivvith regard togthe
\nthe judgment under chaliengfv\u00e9irq”it wouid sufficfient, if
\nthe effect of the  o_rAde_rt yclavfri-fied. <\/p>\n
In the result_,_ I pjafss’   <\/p>\n

\n   defendants\/respondents as undertaken
\n shall not interfere with the
\nift”.i’-Epossession and enjoyment of the suit
\nproperty by the plaintiffs till the disposal of
\nthe suit. However, the plaintiffs shall not
\ncut and remove the existing eucalyptus
\ntrees or any other trees in the suit schedule
\nproperty. The plaintiffs shall take care to
\nsee that no damage of whatsoever nature is<\/p>\n
