JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\nDate\n: 05\/08\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE JAYANT PATEL)<\/p>\n<p>The<br \/>\n\tbasis of the present petition is the alleged breach and<br \/>\n\tnon-compliance to the order dated 16.06.2008 passed by this Court in<br \/>\n\tSCA No.25107\/06, copy whereof is produced at Annexure-C, whereby the<br \/>\n\tdirection was given to the respondent to act as per the report.\n<\/p>\n<p>We<br \/>\n\thave heard Mr.Patel for the applicant.\n<\/p>\n<p>The<br \/>\n\tgrievance on the part of the applicant is that the aforesaid<br \/>\n\tdirection for acting as per the report has not been complied with,<br \/>\n\tbut the pertinent aspect is that in the very order, this Court has<br \/>\n\tobserved that if the applicant has any grievance, it will be open to<br \/>\n\tthe applicant to initiate appropriate proceeding before the<br \/>\n\tappropriate forum for redressal of any other or further grievance.<br \/>\n\tUnder these circumstances, it will be for the applicant to resort to<br \/>\n\tappropriate proceedings even if the report is not acted upon.<br \/>\n\tHence, we find that it would not be a case for initiating action<br \/>\n\tunder the Contempt of Court Act.\n<\/p>\n<p>Therefore,<br \/>\n\tthe present application is not entertained.
