JUSTICE R.M. DOSHIT)<\/p>\n<p>\tHeard<br \/>\nthe learned advocates.\n<\/p>\n<p>\tAdmit.\n<\/p>\n<p>Learned advocates Mr. Mehta and Ms. Nair appear for the respondents<br \/>\nand waive service of notice of admission for the respective<br \/>\nrespondent. With the consent of the learned advocates, the Appeal is<br \/>\nheard and decided today.\n<\/p>\n<p>\tThis<br \/>\nAppeal preferred under clause 15 of the Letters Patent by the Dahegam<br \/>\nMunicipality [hereinafter referred to as,  the Municipality ]<br \/>\narises from the judgment and order dated 3rd February,<br \/>\n2006 passed by the learned Single Judge in above Special Civil<br \/>\nApplication No. 24184 of 2005.\n<\/p>\n<p>\tThe<br \/>\ndispute centers around a piece of land admeasuring 6 sq.m allotted to<br \/>\nthe respondent no.1 herein by the Collector, Gandhinagar for placing<br \/>\nhis cabin to carry on his profession of watch repairing in the town<br \/>\nof Dehagam. The said plot being part of a road, upon objection by the<br \/>\nMunicipality, the said sanad was later on cancelled. The Municipality<br \/>\nhas sought to evict the respondent no.1 from the said spot on the<br \/>\npremise that the said spot forms part of the road known as  Suvidha<br \/>\nPath . Against the decision of the Municipality, the respondent<br \/>\nno.1 approached this Court in the above Special Civil Application.<br \/>\nThe learned Single Judge was pleased to observe that,  ..Though<br \/>\nsufficiently long time has been granted to respondent, no denial to<br \/>\nthe above submissions have been made. It would appear that though the<br \/>\npetitioner was granted Sanad by the Government which would have<br \/>\nauthorized him to put his cabin at the place so assigned to him, at<br \/>\nthe request of Nagarpalika, the petitioner shifted the cabin. From<br \/>\nthe place where the cabin was shifted, Nagarpalika removed the cabin<br \/>\nof the petitioner.  In view of the above observations, the<br \/>\nlearned Single Judge was pleased to allow the petition and to issue<br \/>\nthe direction that,  ..the petitioner will be permitted to<br \/>\nput his cabin, as per rules, on the land so allotted to him by the<br \/>\nGovernment.  Feeling aggrieved, the Municipality has<br \/>\npreferred the present Appeal.\n<\/p>\n<p>\tIt<br \/>\nis not in dispute  that the piece of land in question is a Government<br \/>\nland. The said piece of land was allotted to the petitioner on<br \/>\npayment of charges for carrying on his profession as aforesaid. It is<br \/>\nalso not in dispute that the Municipality has constructed a road<br \/>\nknown as   Suvidha Path . The disputed cabin is right on<br \/>\nthe road. Undoubtedly, it hinders the traffic. Further, the<br \/>\nrespondent no.1 does not have a fundamental or statutory right to<br \/>\ncarry on business or profession on public land.\n<\/p>\n<p>\tIn<br \/>\nthe circumstances, we find it expedient that the respondent no.1<br \/>\nremoves his cabin which is situated within the road line. The<br \/>\nrespondent no.1 will, within five days from today, make<br \/>\napplication to the Collector, Gandhinagar to provide him alternative<br \/>\nsite of suitable size to facilitate him to carry on his profession at<br \/>\na suitable place. The application so made shall be considered by the<br \/>\nCollector, Gandhinagar within fifteen days from the date of<br \/>\nreceipt of the application. In the event, no other suitable site is<br \/>\navailable for allotment to the respondent no.1, the respondent no. 1<br \/>\nbe informed accordingly. In any event, whether or not he is allotted<br \/>\nanother piece of land, the respondent no.1 will remove his cabin from<br \/>\nthe disputed spot within one month from today i.e., by<br \/>\n8th September, 2008. If the respondent no.1 fails to<br \/>\nremove his cabin on or before 8th day of September, 2008,<br \/>\nthe appellant-Municipality will be at liberty to remove the<br \/>\nrespondent no.1 forcibly.\n<\/p>\n<p>\tSubject<br \/>\nto the above direction, the Appeal as well as Civil Application is<br \/>\ndisposed of.\n<\/p>\n<p>{Miss<br \/>\nR.M Doshit, J.}<\/p>\n<p>{Sharad<br \/>\nD.
