Bhansali)\nMr. Suresh Kumbhat),for the petitioner.\nMr. Ashok Prajapat,P.P.\n\n\n     Heard learned counsel for the petitioner\n\nas   well    as       learned       Public         Prosecutor         and\n\nperused the material\/case diary made available\n\nto me during the arguments of the case.\n\n     It     is        contended         on        behalf       of     the\n\npetitioner that investigation in the matter is\n\ncomplete     and       challan         has    also       been       filed\n\nagainst     him        therefore,         nothing        is     to     be\n\ninvestigated or interrogated in the present\n\nmatter.     The petitioner is in judicial custody\n\nfor last more than two months, offences are\n\ntriable by the court of Magistrate.                                 It is\n\nfurther      contended             that       in         a      similar\n\ncircumstances,          the       learned         Sessions      Judge,\n\nJodhpur     has       granted     bail       to    the       petitioner\n\nunder     Sec.        439     Cr.P.C.        vide     order         dated\n\n29.5.2009        in     bail      application            No.    649\/09\n\ntherefore,        it        was   contended          that       accused\n                               2\n\npetitioner may now be enlarged on bail.\n\n       After   considering         the        submissions       of\n\nlearned counsel for the parties, examining the\n\nrecord and the facts and circumstances of the\n\ncase, but without expressing any opinion on\n\nits merits and demerits, I think it fit and\n\nproper to allow this application under Section\n\n439    Cr.P.C.       Hence,       it     is       directed     that\n\naccused-petitioner namely Shyam Kacholia                       S\/o\n\nShri Ramvallabh Kacholia, be released on bail\n\nunder Section 439 Cr.P.C.,in C.R.
